Overview of License Terms

The Geometer's Sketchpad is licensed to the Government of Malaysia, as represent ed by the Ministry of Education Malaysia, and your installation and use of this software is subject to the terms of the license with the Ministry for the softwa re. The terms under which you may install and use this new software are summariz ed below. You are authorized to install The Geometer's Sketchpad and the program documentation on the computers of educational institutions under the direct aut hority of the Ministry of Education Malaysia, which includes Malaysia's public s chools, public universities, teachers' training colleges, community colleges, an d on the personal home computers of current instructors, staff, and students at such institutions. The license does NOT allow distribution of the software or do cumentation to any other persons or to private institutions. The license does NO T allow distribution via the Internet or the World Wide Web unless such distribu tion prohibits non-authorized parties from accessing the Sketchpad software and documentation. In addition, the Malaysian Government license for The Geometer's Sketchpad includes the use of JavaSketchpad on the Internet for noncommercial pu rposes. The purpose of the JavaSketchpad license is to allow you to post sketche s to a Web site that you or your students have created using The Geometer's Sket chpad. The JavaSketchpad license is granted and considered noncommercial provide d your site can be freely visited by anyone on the Internet (that is, it's not p assword-protected or available only to subscribers) and no direct or indirect pr ofit is being made from people visiting your site. For more details, see the add itional terms set forth below and the full license of the Ministry of Education Malaysia. B. Sketchpad Documentation

Your Malaysian Ministry of Education Sketchpad Edition includes several electron ic books of documentation about Sketchpad, including a Learning Guide, the compl ete Reference Manual, a Quick Reference Guide, a booklet of 101 Project Ideas, a nd Teaching Mathematics with The Geometer's Sketchpad. Consult these books if yo u're new to Sketchpad, starting with the Learning Guide. All of these books are located in the "GSP Documentation (PDF)" folder and can be opened with Adobe Acr obat or other PDF software. NOTE: Sketchpad PDF books are NOT installed onto your computer by the Installer (since they take up lots of space). If your copy of Sketchpad is on a CD-ROM, y ou can access them from the CD-ROM directly, or drag them from the CD-ROM to you r hard disk like any other file. (The Installer does install "Sketchpad Help," a n on-line version of the Reference Manual accessible from within Sketchpad progr am.) C. Sample Documents

The Sketchpad installer places many sample documents in the folder called "Sampl es" next to your Sketchpad application. Feel free to browse them at any time for example applications, Sketchpad tips and techniques, and miscellaneous mathemat ical inspiration! D. Key Curriculum Press License Agreement

When You Install the Malaysian Ministry Education Edition of The Geometer's Sket chpad, You Acknowledge and Agree that Your Use of the Software is Restricted By and Subject To the Terms of the License Agreement of the Ministry for The Geomet er's Sketchpad.

Important: The Government of Malaysia as represented by the Ministry of Educati on Malaysia ("Government of Malaysia") and Key Curriculum Press, Inc., 1150 65th Street, Emeryville, CA 94608, USA, ("Key Curriculum Press") have entered into a License Agreement with respect to The Geometer's Sketchpad software and documen tation. That license governs your right to use this special edition of the softw are. Read the following license terms ("License Terms") before installing and us ing The Geometer's Sketchpad software or its documentation. By installing and us ing the software or its documentation on any computer, you acknowledge and agree to comply with these License Terms. If you do not agree with these License Term s, do not install or use the software or its documentation. E. 1. License Terms Definitions.

The following terms shall have the following meanings: (a) "Sketchpad" means The Geometer's Sketchpad Version 4 software for Window s computers and the on-line reference files titled "Sketchpad Help," in any form or format including, but not limited to, CD-ROM format, and bearing the seal of the Government of Malaysia, or identified on a computer screen as licensed to t he Government of Malaysia by Key Curriculum Press. The term also includes all co pies of any part of the program, but does not include the data files that the pr ogram produces. (b) "Sketchpad Documentation" means the user documentation for Sketchpad, in cluding the Sketchpad Reference Manual, Learning Guide, 101 Project Ideas bookle t, and Quick Reference Guide for Sketchpad, whether in PDF, other electronic, or printed form, each bearing the seal of the Government of Malaysia, or identifie d on a title screen or printed page as licensed to the Government of Malaysia by Key Curriculum Press. (c) "Licensed Government Educational Institution" means any educational inst itution under the direct authority of the Ministry of Education Malaysia. For gr eater certainty, the term "Licensed Government Educational Institution" does not include private schools or private educational institutions. (d) "Authorized Personal User" means any student enrolled in a Licensed Gove rnment Educational Institution, and any teacher or other educational personnel e mployed or otherwise engaged in educational activities within a Licensed Governm ent Educational Institution. (e) "JavaSketchpad" is that portion of the Sketchpad program identified by t he initials JSP, written in the Java computer language, and provided for the pur pose of displaying HTML-compatible Sketchpad documents over the World Wide Web. 2. License of Sketchpad.

Sketchpad and the Sketchpad Documentation are owned and/or licensed by Key Curri culum Press, and are protected by the laws of Malaysia and the United States, an d by international intellectual property laws. If you are a teacher or other educational staff engaged in educational activitie s within a Licensed Government Educational Institution, you may: - Install and/or use Sketchpad on the hard drives of computers at the Licensed G overnment Educational Institution. - Install Sketchpad on a compatible computer network system provided the distrib ution of Sketchpad through the network does not cause it to be accessed from out

side the Licensed Government Educational Institution. - Make copies of the Sketchpad Documentation for use at the Licensed Government Educational Institution. - Make and distribute copies of Sketchpad and the Sketchpad Documentation for us e by Authorized Personal Users enrolled, employed, or engaged in educational act ivities at a Licensed Government Educational Institution so long as each Authori zed Personal User who receives and/or uses Sketchpad and/or the Sketchpad Docume ntation accepts these License Terms. - Use JavaSketchpad (and only that portion of Sketchpad defined as JavaSketchpad ) on the Internet or the World Wide Web for noncommercial purposes to post sketc hes created using Sketchpad to a Web site so long as that Web site is served fro m a Licensed Government Educational Institution. Noncommercial purposes means th at your site can be freely visited by anyone on the Internet; that it is not pas sword-protected or restricted only to subscribers; and that no direct or indirec t profit is being made from people visiting your site. You may not: - Install and/or use Sketchpad on computers of institutions not under the author ity of the Ministry of Education Malaysia. - Distribute Sketchpad or the Sketchpad Documentation, allow access to Sketchpad or the Sketchpad Documentation, or otherwise cause Sketchpad or the Sketchpad D ocumentation to be distributed through the Internet or the World Wide Web (excep t for that portion of Sketchpad defined as JavaSketchpad) unless such distributi on and access is strictly limited by password or other means to Licensed Governm ent Educational Institutions and their respective Authorized Personal Users. - Rent, lease, or grant sublicenses or other rights in Sketchpad or the Sketchpa d Documentation. - Provide use of Sketchpad in a service business, network, or multiple-user arra ngement to users who are not employed, enrolled, or engaged in an educational ac tivity at a Licensed Government Educational Institution. - Make alterations to, disassemble, decompile, or reverse-engineer any part of S ketchpad. If you are an Authorized Personal User enrolled, employed, or engaged in an educ ational activity at a Licensed Government Educational Institution, you may: - Install and/or use Sketchpad and/or the Sketchpad Documentation on a single pe rsonal computer for your personal use whether at home or at another location and retain the original for archival purposes. You may not: - Install or use Sketchpad on a personal computer if you are not an Authorized P ersonal User. - Distribute Sketchpad or the Sketchpad Documentation, allow access to Sketchpad or the Sketchpad Documentation, or otherwise cause Sketchpad or the Sketchpad D ocumentation to be distributed through the Internet or the World Wide Web. - Make copies of Sketchpad or the Sketchpad Documentation except as stated above .

- Operate Sketchpad over a computer network. - Rent, lease, or grant sublicenses or other rights in Sketchpad or the Sketchpa d Documentation. - Make alterations to, disassemble, decompile, or reverse-engineer any part of S ketchpad. 3. Termination.

Failure to comply with any of the License Terms terminates your right to use Ske tchpad. If you are an Authorized Personal User, your right to install and use Sk etchpad terminates when you are no longer enrolled, employed, or engaged in educ ational activities at a Licensed Government Educational Institution. Upon termin ation, you must immediately delete Sketchpad and the Sketchpad Documentation fro m your computer and destroy Sketchpad and the Sketchpad Documentation and any co pies you have made or transfer Sketchpad and the Sketchpad documentation and any copies you have made to a Licensed Government Educational Institution or to a c urrently Authorized Personal User. 4. No Direct License; Disclaimer of Warranties; Limit of Liability.

Your right to install and use Sketchpad and the Sketchpad Documentation is solel y as an Authorized Personal User under the license of the Government of Malaysia . These License Terms are not intended to, and shall not be construed to create, a license or any other agreement or arrangement directly between Key Curriculum Press and any Authorized Personal User or any other person. WITHOUT LIMITING TH E GENERALITY OF THE FOREGOING, IN NO EVENT SHALL KEY CURRICULUM PRESS BE LIABLE TO ANY AUTHORIZED PERSONAL USER OR ANY OTHER PERSON PURSUANT TO THESE LICENSE TE RMS FOR ANY WARRANTY OR BREACH OF WARRANTY, EXPRESS, IMPLIED OR STATUTORY INCLUD ING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILIT Y, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL KEY CURRICULUM PRESS, ITS DISTRIBUTORS, OR ITS LICENSORS INCLUDING THE MINISTRY OF EDUCATION M ALAYSIA, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS (COLLECTIVELY KEY C URRICULUM PRESS, ITS DISTRIBUTORS, OR ITS LICENSORS) BE LIABLE TO YOU FOR ANY CO NSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSI NESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SKETCHPAD EVEN IF KEY CURRICULUM PRE SS, ITS DISTRIBUTORS, OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF S UCH DAMAGES. 5. General Provisions.

Unauthorized copying or other reproduction of Sketchpad and the Sketchpad Docume ntation by written, electronic, or any other means whatsoever is strictly prohib ited. Copyright to Sketchpad is protected by laws of Malaysia, the United States , and by international intellectual property laws. You acknowledge that you have read these License Terms and understand and agree to be bound by them. If any o f the provisions, or portions thereof, of these License Terms are invalid under any applicable statute or rule of law, they are to that extent to be deemed omit ted. All other provisions shall remain in full force. These License Terms shall be governed by the laws of the State of California and the federal laws of the U nited States of America.
