Other relevant Information: Uttar Pradesh has a notorious distinction in police brutality cases in India. Recently reported two custodial deaths as the men in the lockup died after being beaten up with lathis and rifles by policemen in Allahabad. Another case of police brutality registered in Amethi of Uttar Pradesh where police inspector beating up a Dalit woman to extract a confession while a woman constable views as a mute spectator has emerged. The policeman, identified as SHO of Musafirkhana police station Kailash Dwivedi, was caught on camera beating up a Dalit woman and tearing her clothes. Sangeeta Kori was the woman being questioned in connection with her husband's murder. Please see the URL: http://news.oneindia.in/2010/02/18/up-policeman-suspended-for-beating-up-dalit-woman.html. The video, available from a newsfeed by The Times of India is available http://timesofindia.indiatimes.com/videos/news/Shocking-UP-cop-assaults-woman-oncamera/videoshow/5585356.cms.All above mentioned cases are clear cut violation of order/instruction of Honorable Supreme Court in case of DK Basu V/S Government of West Bengal as guideline of detention. Please see: http://testimony-india.blogspot.com/2010/02/shri-dk-basu-v-state-of-west-bengal.html The primitiveness of this institution is reflected in its intellect that still depends on brute force as an accepted means of crime investigation. Its colonial mindset is echoed in the acts of police officers, who believe that it is their lawful right to punish people at will. According to the information received National Human Rights Commission 23852 & 21014 cases has been registered in year 2008 & 2009 respectively in Uttar Pradesh. According to Government statistics, the number of custodial deaths has registered an increase in the last fiscal by 70 compared to 2006-07.

Prevention of Torture Bill, 2008) is more important piece of legislation, the Prevention of Torture Bill, 2008 is subjected to the legislative deepfreeze since the day it was drafted.

Neverthless the family heard that Sanjay would be encountered and spent two days writing letters to state ministers, senior police and state human rights organization. On 16th June they organized a sit in protest at the district magistrates office with more than 200 people. In June 2006, the Ghazipur police killed one Sanjay Singh of Pai village of Chandauli district, claiming that he was a gangster carrying a reward of Rs 25,000 on his head. Singhs family found that he never had a single FIR lodged against him anywhere in the state, let alone a reward. Police refused to give Sanjay bodies to his family for burial. They approached to Peoples Vigilance Committee on Human Rights (PVCHR), which, after a legal battle of three years, managed to get an FIR lodged against the 13 police officers on August 4, 2009 .

After his death the petitioner is in great financial hardship for the survival ship due to illegal act of the police. As the Ajay Singhs family member were very much in trauma and their life was full of grief & sorrow. They were seeing no any silver line of justice but testimonial therapy has increased their confidence level.

Then they were forcefully taken to Bhainsa Kund, Lucknow for cremation. The family of the victim was not given the permission to take the dead body back home but the S.H.O. Ghazipur mistreated them, abused them and warned them of dire consequences similar to those of the victim. WHAT DID THE SHO SAY TO THEM? DID HE PHYSICALLY HARM THEM? The y did lathi charge

The cremation of the victim was also done by the police officials. Even the newspaper reporters were present there who published the same in the daily newspaper. WAS AN AUTOPSY COMPLETED? WAS IT VIDEO-TAPED? IS THERE A REPORT FROM THE CREMATION? IS THERE A NEWSPAPER CLIPPING FROM THE CREMATION? No autopsy and video tapped. WHO ARE THE PERPETRATORS IN THIS? The officer said rape and sexual humiliation of female prisoners also happened during this period. He added that many of these forms of torture were a part of routine policing even now across the country. Please see the URL http://www.flonnet.com/fl2620/stories/20091009262002700.htm
