l, the undersigned,

Hereby declare under oath as follows:

'l . I am an admitted attorney and partner of Frans Schutte & Mathews

Phosa attorneys in Nelspruit and also an experienced businessman. I

was the first premier of the province of Mpumalanga.

2. I attended court on 19 February 2018 in the above matter.

3. ln the course of the above proceedings under the Protection From

Harassment Act no 1 7 of 2011 , I was surprised that the presiding

magistrate, Mr Grabe allowed an ad hominem on the complainant, to the

extend that he did.

4. As an officer of the court I was taken aback when I observed counsel for

the respondent in private conversation with the presiding magistrate in

his office, without the presence of counsel for the complainant.
