Payment Guarantee Bond Information

DATE: 01-10-2009 We, Bundu Innovations (Pty) Ltd, (The Obligee) are in the possession of an payment guarantee bond issued to our company by TOTM Commodities in the USA. We herewith formally present proof of ownership of this bond to your client and the bank to clearly show our capability and intent to purchase the delivered gold as agreed per the referenced contract between our two companies. We attach a copy of the bond undertaking letter to this mail for your reference. You are free to confirm the fact that we have been issued this payment guarantee bond with Oceanic Insurance, which will secure payment to your company if the listed buyer defaults on payment after the refinery assay report is issued. We had the intention to present to your client an assignment of Proceeds as stated from ABSA bank, but my bank informed me today when we received the bond document that they first have to present this to their Risk management team and this can take up to 14 days for review, before finally deciding to issue the documents as requested. This review had never been mentioned to us before today and thus it came as a big surprise. Neither we nor your client would want to face such a delay in the conclusion of this initial transaction. I will attach the Letter of Undertaking received from the Insurance company to this mail for your perusal which includes all the relevant bond information from the insurance company.
