Brian Cowen Photography Wedding Agreement

ENTIRE AGREEMENT: This agreement contains the entire understanding between Brian Cowen Photography
and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to
add or change this agreement is to do so in writing, signed by all the parties.
RESERVATION: Upon your signature, Brian Cowen Photography will reserve the time and date agreed upon,
and will not make other reservations for that time and date. For this reason, the Reservation Deposit of
$500.00 is non-refundable, even if date is changed or wedding canceled for any reason, including acts of
God, fire, strike, and extreme weather. The Reservation Deposit is to be paid at time of signing the contract.
The Reservation Deposit is applied towards the contracted wedding photography package. The remaining
amount is due the day of the wedding, if not before. At least a partial payment should be made on the
day of the wedding.
COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result
within the definition of this assignment. Brian Cowen Photography is not responsible if key individuals’ failure
to appear or cooperate during photography sessions or for missed images due to details not revealed to Brian
Cowen Photography. Brian Cowen Photography recommends that CLIENT designate an "event guide" to point
out important individuals for informal or candid photographs to the photographer during the wedding that
they wish to have photographed.
DIGITAL NEGATIVES, PRINTS AND COPYRIGHTS: The photographs, digital negatives or prints produced
by Brian Cowen Photography are protected by Federal Copyright Law (all rights reserved) and may not be
reproduced in any manner without Brian Cowen Photography’s explicitly written permission. The Client must
obtain written permission from and compensate Brian Cowen Photography prior to the CLIENT or its friends
and relatives publishing or selling the photographs for profit. In addition, any CD given to the Bride and
Groom is to be used by the Bride and Groom only. Any friends or relatives that wish to make copies of the CD
or have pictures printed MUST go through Brian Cowen Photography. Any pictures that are printed outside of
the Bride and Groom’s personal use are considered to be a breach of contract.
MODEL RELEASE: The CLIENT hereby grants to Brian Cowen Photography and its legal representatives and
assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the
CLIENT may be included, for advertising and any other purpose and in any manner and medium; to alter the
same without restriction; and to copyright the same. The CLIENT hereby releases Brian Cowen Photography
and its legal representatives and assigns from all claims and liability relating to said photographs.

COMPLETION SCHEDULE: Digital processing takes at least 2 months, possibly longer


depending upon current workload. During the summer months, especially, processing will
take longer. The Bride and Groom agree to not hold the photographer legally responsible if the
photos are not finished in a time that they see fit, and the photographer agrees to give the Bride
and Groom free personal use of the photos upon completion. Also, Bride and Groom understand
that the album is a different process altogether and they will not receive the album at the same
time that the CD/Prints of the photos are given. The completion process will be as follows:
1. Photos will be taken the day of the event.
2. A proof CD consisting of resized, copyrighted photos will be made within 2-3 weeks of the
wedding date from which the Bride and Groom will pick the photos they wish to have
edited.
3. The Bride and Groom will email Brian Cowen Photography with a list of photos that they
wish to have edited.
4. The photos will be edited and the Bride and Groom will receive a CD of the full resolution
photos.
5. If purchased, the album will be created, and a PDF of the album will be sent to the Bride
and Groom for approval before printing.
6. Any changes that need to be made will be done, then the album will be printed and sent
directly to the Bride and Groom.
Also, please note that editing includes color correction and artistic use of color (such as
black and white or a vintage tone), but does not include any alteration of the original
content of the photos, such as removing blemishes, people, or objects from photos.
Any alterations of this kind will cost $10/photo.

RIGHT OF WITHDRAWAL: The studio's discovery of new information, changes, or other factors tending to
circumvent its policies could result in its withdrawal. Non-cooperation; changes of locations, facilities or times
available; missed appointments; bad or returned checks, or late payments are examples of contributing
factors. Should the studio initiate the withdrawal, all fees and deposits will be returned, excepting fair market
value for all services/products already provided. In case of withdrawal, $75 an hour is billed for all
photography services already provided, and $20 an hour is billed for all other services, consultations, and all
driving time, rounded up to the nearest half-hour. If the studio withdraws -- the client will not be billed for any
services in excess of their deposits (except if deposit was in form of returned checks).
LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergency it could be
necessary to retain a different photographer. Brian Cowen Photography will make every effort to secure a
replacement photographer. If the situation should occur and a suitable replacement is not found,
responsibility and liability is limited to the return of all payments received for the event package. Brian Cowen
Photography takes the utmost care with respect to exposure, transportation, and processing the photographs
including using professional grade equipment and professional grade backup equipment. However, in the
unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond Brian
Cowen Photography control, Brian Cowen Photography liability is limited to the return of all payments
received for the event package. The limit of liability
for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of
total number of originals.
AMENDMENTS: This contract has been freely negotiated and shall be recognized as the entirety of the
agreement, and only those changes or modifications specifically placed in writing, attached, signed and dated
by the CLIENT and the studio at the time of this contract’s signing shall be recognized as amendments to this
contract.
