JOINT MOTION TO PLACE DEFENDANT ON PRETRIAL DIVERSION

Defendant, Stephan Orchard, and the United States jointly move to place Mr. Orchard on

pretrial division based on the following grounds:

1. Presently pending before this Court is an indictment which charges Mr. Orchard with

Conspiracy, mail fraud and wire fraud, and obstruction.

2. A pretrial diversion agreement has been reached between Mr. Orchard and the

government. This agreement incorporates all of the conditions and provisions by which Mr. Orchard

must abide during the next 18 months.

3. Mr. Orchard will continue to report to Pretrial Services as directed during the

pendency of the diversion period, will maintain full time employment, and will refrain from any

violation of federal, state or local laws.

4. A proposed order for the Court’s review is attached.

WHEREFORE, the parties to this agreement respectfully request that this Court enter an

order whereby the pretrial diversion agreement is adopted as the disposition to this cause.

ORDER ON JOINT MOTION TO PLACE DEFENDANT ON PRETRIAL DIVERSION

This cause is before the Court upon joint motion by the defendant and the government to

adopt an agreement for pretrial diversion as the disposition of defendant’s pending case before this

Court. This Court being fully advised as to the facts and circumstances surrounding this agreement

for pretrial diversion, it is

ORDERED AND ADJUDGED that the Agreement for Pretrial Diversion entered into

between defendant and the government is hereby adopted as the disposition of this case.

Accordingly, defendant is hereby placed on pretrial diversion for a period of 18 months subject to

the terms and conditions as set forth in the Agreement for Pretrial Diversion.
