The Dakota County Grand Jury met on September 30, 2009 and October 1 and 2, 2009, regarding the

investigation into the facts and circumstances surrounding the death of Nicholas Arthur Miller.

At least 16 members of the Grand Jury were present during this investigation and at least 12 members of the

Grand Jury have returned the following indictment(s):

COUNT I – MURDER IN THE FIRST DEGREE (WHILE COMMITTING CHILD ABUSE – ASSAULT
IN THE THIRD DEGREE)

That on or about June 19, 2009, in Dakota County, Minnesota, TYLAR JAMES HOKANSON caused the death of

a minor child while committing child abuse (assault in the third degree), and he has engaged in a past pattern of

child abuse upon the child or another child, and the child’s death occurs under circumstances manifesting an

extreme indifference to human life.

COUNT II – MURDER IN THE FIRST DEGREE (WHILE COMMITTING CHILD ABUSE –

MALICIOUS PUNISHMENT OF A CHILD)

That on or about June 19, 2009, in Dakota County, Minnesota, TYLAR JAMES HOKANSON caused the death of

a minor child while committing child abuse (malicious punishment of a child), and he has engaged in a past pattern

of child abuse upon the child or another child, and the child’s death occurs under circumstances manifesting an

extreme indifference to human life.

circumstances manifesting an extreme indifference to human life.

COUNT IV – MURDER IN THE SECOND DEGREE (COMMISSION OF FELONY – ASSAULT IN THE

THIRD DEGREE)

That on or about June 19, 2009, in Dakota County, Minnesota, TYLAR JAMES HOKANSON caused the death of

a human being while committing or attempting to commit the felony offense of assault in the third degree.
