2. Applicants must submit two (2) copies of Form 1 (Regulation 3) to the Licensing
Division through the appropriate Regional Licensing Offices. All application forms
must be signed by the director and bear the company’s stamp.

If qualified or approved, the Ministry will issue a temporary granted in-principle letter
valid for two (2) months to enable the preparation of the operating premises, which

• For inbound license (diving) RM50,000.00 paid-up capital is required for all
locations

1. Application must use Form 1 (Regulation 3). Application must include objectives

3. Application for licence for additional scope is allowed after a company has been in
active operation for more than 1 year.
4. Current license must be valid before applying for additional scope license.

SUPPORTING DOCUMENTS
ii. Letters certifying outbound and inbound tourism experience of members of Board of
Directors/shareholders or staff of the company
1. Application must use Form 3 (Regulation 7). Application must include objectives
and the necessity for additional branch.
2. A processing fee of RM50.00 must be submitted for every application in the form of
bank draft/money order/postal order made payable to Pesuruhjaya Pelancongan
(Commissioner of Tourism).
3. Application for licence for additional branch is allowed after a company has been in
active operation for more than 1 year.
4. Current license must be valid before applying for additional branch license.
5. Applicants must have satisfactory annual business turnover. For this purpose, an
audited financial statement is required.
6. Licence for additional branch will be considered based on the needs in the areas
concern.
7. Branch office(s) is not allowed to move outside operating area without the consent of
the Commissioner of Tourism.
9. Applicants must not have any outstanding offer of compounds under AIP 1992 and
APKP 1999 before any application could be processed.
10. If approved, the ministry will issue a conditional approval letter valid for two (2)
months to enable the preparation of the operating premises so that business
can be carried out after office rental agreements, floor plans and operating
premises have been prepared.
11. A licence fee will be charged upon issuance of new license. Original license must be
returned to be replaced with a new license.
GUIDELINES ON APPLICATION TO APPEAL FOR TOUR OPERATING/TRAVEL
AGENCY BUSINESS LICENCE
1. Applications for appeal must be made within 14 days from the date of the rejection
letter/notification to the applicant.
3. Applicants must not have any outstanding offer of compounds under AIP 1992 and
APKP 1999 before any application could be processed.
4. If approved, the ministry will issue a conditional approval letter valid for two (2)
months to enable the preparation of the operating premises so that business
can be carried out after office rental agreements, floor plans and operating
premises have been prepared.
5. A licence fee will be charged upon issuance of new license. Original license must be
returned to be replaced with a new license.
1. Application must use Form 5 (Regulation 9) for main office or Form 6 (Regulation
9) for branch licence renewal.
2. All completed applications must reach the Licensing Division through the appropriate
Regional Licensing Offices within 30 days the expiry date of current license. All
application forms must be signed by the director and bear the company’s stamp.
3. A processing fee of RM20.00 must be attached for every application in the form of
bank draft/money order/postal order made payable to Pesuruhjaya Pelancongan
(Commissioner of Tourism).
4. Applicants must not have any outstanding offer of compounds under AIP 1992 and
APKP 1999 before any application could be processed.
Licence is valid between 1 to 3 years. The number of years for licence approval will be
considered as follows:
i) 3 years :
• Current annual audit report has been submitted
• Company has settled all penalties (if any)
• Company has recorded a profit
• Submit current membership certificate of a recognised travel agency association.
• Company has complied with all other requirements for renewal.
ii) 2 years :
• Annual audit report has been submitted.
• Company has incurred a loss but does not exceed paid-up capital or 50% of
turnover/revenue.
• Submit current membership certificate of a recognised travel agency association.
• Company has complied with all other requirements for renewal.
iii) 1 year :
• Company did not submit annual audit report (however, the company must
submit a verification letter from an appointed accredited auditor)
• Company has incurred a loss but does not exceed paid-up capital or 50% of
turnover/revenue.
• Submit current membership certificate of a recognised travel agency
association.
• Company has complied with all other requirements for renewal.
FEES FOR LICENCE RENEWAL
4. Applicants must not have any outstanding offer of compounds under AIP 1992 and
APKP 1999 before any application could be processed.
6. Companies with inbound and ticketing licences must not allow more than 30%
foreign equity.
7. Application for change of status which reduces the percentage of bumiputera shares
and number of bumiputera members of Board of Directors are not allowed.
9. Completed, signed and dated application forms must be submitted to the Licensing
Division through the appropriate Regional Licensing Offices.
GUIDELINE ON APPLICATION FOR CHANGE OF PAID-UP CAPITAL
1. Applicants must submit a letter stating purpose of change of paid-up capital in the
company.
2. Any change without the approval of the Commissioner of Tourism will be imposed a
penalty according to the Tourism Industry Act 1992.
3. Applicants must settle the penalty (if any) as required by the Tourism Industry Act
1992 before the applications can be processed.
1. Applicants must submit a letter justifying change of business premise location and
provide new address.
2. Any change without the approval of the Commissioner of Tourism will be imposed a
penalty according to the Tourism Industry Act 1992.
3. Applicants must settle the penalty (if any) as required by the Tourism Industry Act
1992 before the applications can be processed.
4. Change of business premises location outside operating area without the consent of
the Commissioner of Tourism is not allowed. (To prevent a situation where a branch
operates in a main town whereas the main office operates in small town. This
situation must be controlled as the paid-up capitals for main towns and other towns
differ.)
1. Applicants must be private limited companies which have been incorporated under
the Companies Act 1965.

GUIDELINES ON TOUR OPERATING LICENCE RENEWAL – MALAYSIA MY
SECOND HOME (MM2H)
2. Renewals must be submitted to the Regional Licensing Office within 30 days from
the expiry of the licence.
3. The completed form must be submitted to the Regional Licensing Office together
with the necessary documents.
4. A processing fee of RM20.00 must be attached for every application in the form of
bank draft/money order/postal order made payable to Pesuruhjaya Pelancongan
(Commissioner of Tourism).
5. Applicants must settle the penalty (if any) as required by the Tourism Industry Act
1992 before the applications can be processed.
Documents required :
The licence will only be issued if documents submitted are complete and information
provided are true. Issued licence will be revoked, if during inspection of the premise, the
information provided are false.
GUIDELINES ON NEW TOBTAB/MM2H INSPECTION
1. The company must provide a suitable premise within 2 months from issuance of the
granted-in principle letter.
vi. Check the company information before the inspection is conducted. Ensure that
comments made on the earlier inspection have been rectified.
vii. Take photographs of the premise (interior & exterior). Ensure that the
photographs submitted display the true physical condition of the premises.
viii. Ensure that the company has a representative present during the inspection.
ix. Obtain the company stamp and signature of the representative after the
inspection is completed.
x. Prepare a report of the premises after the inspection is completed.
2. Profiles of the tour operating companies must be attached with the applications.
3. Application must provide the followings:
i. Biodata of the expatriates
ii. Photographs and passports of the expatriates
iii. Profiles of the expatriates
iv. Employment offer letters to the expatriates from the tour operating companies.
4. Application can only be considered for positions where local expertise unavailable.
