THE LAW (Extract )
The applicant complains that in proceedings before the Austrian Patent
Office he was refused recognition of a patent in respect of his invention, an
allegedly new production method for ceramic products . He submits, in
particular, that this result of the proceedings is due to the fact that the
proceedings did not provide the guarantees of a judicial procedure in accord-
ance with Article 6 111 of the Convention .

refusal of a patent have effect erga omnes, and the legal position as between
the person seeking the patent and the persons filing objections is only the
outflow of the general situation whether or not the particular invention gives
rise to the right to be granted a patent (Section 4 of the Patent Act) and
consequently to claim the exclusive use thereof (Section 22), which is subject
to the continued observance of certain administrative duties such as the
regular payment of contributions to . the Patent Office . The Commission
considers that under these circumstances the registration of patents must be
considered as an essentially administrative matter which is outside the scope
of Article 6 of . the Convention .
It follows that the applicant's above complaint is incompatible ratione
materiae with the provisions of the Convention, and must be rejected under
Article 27 (2) . The same is true with regard to the applicant's complaint
under Anicle 14 of the Convention that the above proceedings before the
Patent Office were discriminatory .

Le requérant se plaint qu'au cours d'une procédure devant le . Bureau
autrichien des Brevets, la reconnaissance d'un brevet lui ait été refusée pou r

son invention, un nouveau mode de fabrication d'articles en céramique . Il
prétend notamment que ce résultat est dû à ce que la procédure n'offrait pas
les garanties d'une procédure judiciaire conforme à l'article 6, paragraphe 1,
de la Convention .
Toutefois, la Commission fait remarquer que l'article 6 ne s'applique
qu'aux procédures qui mènent à une décision sur une contestation sur des
droits et obligations de caractére civil ou sur le bien-fondé d'une accusation
pénale . Comme il ne s'agit nullement d'une accusation pénale en l'espèce, la
Commission doit donc examiner si la procédure en question concernait les
droits et obligations de caractère civil du requérant . '
Il ne fait aucun doute que les droits de propriété intellectuelle, une fois
ie brevet accordé, doivent être considérés comme des droits civils au sens de
l'article 6, paragraphe 1, ainsi que la Commission l'a confirmé dans sa
jurisprudence (voir par exemple sa décision sur la recevabilité de la requête
N° 6958/75, Décisions et Rapports 3, p . 155) .

prend naissance entre le candidat au brevet et les opposants n'est qu'une
conséquence de la situation générale issue du point de savoir si l'invention
est brevetable (article 4 de la Loi sur les brevets) et donc susceptible d'usage
exclusif larticle 22), sous réserve de l'observation réguliére de certaines
obligations administratives, tel le paiement ponctuel des annuités dues au
Bureau des Brevets . La Commission estime que, dans ces conditions, l'enre-
gistrement des brevets doit être considéré comme une question essentielle-
ment administrative qui échappe à l'article 6 de la Convention .
