Specific response to Request for Mediation

I am more than willing to move forward with the mediation process. If you would graciously forward the
request for documents I can begin the necessary diligence necessary to prepare. Please forward these
documents as soon as possible as I am anxious to comply and move towards resolution of this matter. I
would respectfully ask your willingness to allow the necessary time to review. Respectfulyy,

According to the Florida State Statutes 720, a homeowner is entitled to request copies in written form
pertaining to issues involving my protection from items that can only be received by the HOA. The HOA
has (10) ten days to comply with the request or upon failure pay $100 dollars a day up to a maximum of
$1000 dollars. More than 30 days has gone by since this request. I request that the 1000.00 be forwarded
to me immediately.

As I have stated previously I was in a discussion as to whether this item was approved during a resolved
matter 2 years prior with the prevailing President at that time. I was assured by Milt Geller not to worry as
he would look into this matter and get back to me. On May 13, 2010 after Milt Geller advised that I resubmit
an application to the board the request for approval to the architectural committee was resubmitted. I
have not yet received a response as to the approval or disapproval of the application. According to the
HOA Documents in the event that the APPROVING PARTY fails to disapprove any request within such 30
day period. The request shall be deemed approved and upon request the APPROVING PARTY shall give
written notice of such approval. I do hereby request such approval.

I understand that the community has set guidelines that are required by each homeowner. However, it is
my opinion had my previous requests be responded to, it would be clear that this could be considered
³Selective Enforcement´ to me and my property. There are other homes in the community which also
have the same hedge around their home and have not been penalized.

Based on the information provided I am asking that the Association to some responsibility having not met
up to their responsibility in this matter. This situation never should have been dragged through the mud

this long. I hope this will suffice and not cause myself and my neighbors any addition expense.
