UNIVERSITY OF PESHAWAR TEACHERS’ TENURE TRACK

STATUTES 2010

CHAPTER 1

INTRODUCTION

Preamble: Whereas it is necessary to make the teaching assignments at this


University so attractive as to persuade men and women of letters and experts to
join this University as teachers with a view to bringing academic standards at par
with international levels, as also to stopping brain drain;

Now, therefore, in pursuance of powers conferred by section 27 (1) (b) of the


University of Peshawar Act, 1974 (Act No. II of 1974), these statutes are hereby
enacted as follows:

1. Short title, extent and commencement. - (1) These statutes may be


called the University of Peshawar Teachers’ Tenure Track Statutes,
2010.

(2) These Statutes shall come into force at once.

(3) These Statutes shall apply to future appointments of University


teachers. These Statutes shall have no overriding effects as
respects the existing teachers of the University, who shall continue
to be governed by the University of Peshawar Teachers’ National
Scales of Pay Statutes, 1975 as amended upto date.

(4) The existing teachers may opt to join the University service under
these statutes.

2. Interpretation. - (1) In these Statutes, unless there is anything


repugnant in the subject or context :

(a) “Schedule” means a schedule annexed to these


Statutes;

(b) “Basic Pay Scales” mean the Basic Pay Scales 2001;

(c) “Dismissal Review Committee” means the Dismissal Review


Committee constituted under these Statutes;

(d) “Existing Statutes” mean the University of Peshawar Service
Statutes, 1977 and the University of Peshawar Teachers’
National Scales of Pay Statutes, 2001.

(e) “Existing University Teacher” means the person who is a


University teacher at the time of commencement of these
Statutes;

(f) “Existing Pay” and “Existing Pay Scale” mean the pay which
the existing University teacher is drawing at the time of
commencement of these Statutes or on such date on or upto
which, he opts for the Tenure Track Pay Scale, under the
Basic Pay Scales;

(g) “Technical Review Panel” means the Technical Review


Panel constituted under these Statutes; and

(h) “Tenure Track Pay Scales” mean Tenure Track Pay Scales
under these Statutes.

(2) All words and expressions used herein and defined in the
University of Peshawar Act, 1974 (Act No. II of 1974) and the
statutes framed thereunder, and not hereinbefore defined shall
have the same meanings as have respectively been assigned to
them by the University of Peshawar Act, 1974 (Act No. II of 1974)
and the statutes framed thereunder.

CHAPTER 2

APPOINTMENTS

3. Appointments on Tenure Track Pay Scales. - (1) The University


may, in addition to appointments under the existing Statutes, also
make the appointments of following faculty members under these
Statutes:

i. Lecturer (on contract)

ii. Assistant Professor;

iii. Associate Professor; and

iv. Professor.

(2) The existing University teachers shall, subject to the qualifications,
experience and criteria prescribed in these Statutes, have the right
to opt for appointment on a post under the Tenure Track Pay
Scales.

(3) All such appointments under these Statutes shall be made purely
on fitness-cum-merit basis.

Explanation: Fitness-cum-merit basis includes the best higher


qualifications, research work of standard quality, experience of
teaching, knowledge and excellent skills of written communication
and presentation in the relevant field of study, aptitude for teaching
at post graduate level as a permanent career and quality of
creativity etc.

4. Qualifications and experience for recruitment. - The qualifications and


experience for recruitment to the posts under these Statutes shall be as
follows:

(a) Lecturer (on contract):


First Class Master’s Degree in Arts or Science, First Class M.Sc.
Engineering, First Class LL.B. Degree preferably LL.M. Degree
from a recognized University:

Provided that a lecturer shall be appointed with the understanding


that he would have no right to ask for his appointment to a higher
professional post unless he obtains a Ph.D. Degree in the relevant
field from a recognized University.

Provided further that such lecturer shall draw the pay under the
Basic Pay Scales.

(b) Assistant Professor:


Ph.D/Relevant terminal qualification from a recognized institution:

Provided that he must be excellent in written communication and


oral presentation skills.

(c) Associate Professor:


Ph.D/Relevant terminal qualification from a recognized and
reputable Institution in the relevant field with either 6-years post-
Ph.D./Relevant terminal degree or minimum of 4-years of post-
Ph.D. experience with at least 6-years of teaching/research
experience in a recognized University or a post-graduate Institution
or professional experience in the relevant field in a National or
International Organization prior to the Ph.D. plus 10 research

publications in journals recognized by the Higher Education
Commission with at least 4 publications in the past 5 years in
Internationally Abstracted Journals, recognized for the purpose of
appointment on Tenure Track by the Higher Education
Commission.

Provided that for appointment in the disciplines of Law,


Clinical Medicines, and Arts & Design (Studio Practice),
instead of Ph.D. the qualifications prescribed for appointments
under the Basic Pay Scales will be applicable.

Provided further that Post terminal Degree experience will


remain unchanged.

(d) Professor:
Ph.D./Relevant terminal qualification from a recognized and
reputable Institution in the relevant field with either 11-years post-
Ph.D./Relevant terminal degree or minimum of 7-years of post-
Ph.D experience with at least 12-years of teaching/research
experience in a recognized University or a post-graduate Institution
or professional experience in the relevant field in a National or
International Organization prior to the Ph.D. plus 15 research
publications in journals recognized by the Higher Education
Commission with at least 5 publications in the past 5 years in
Internationally Abstracted Journals, recognized for the purpose of
appointment on Tenure Track by the Higher Education
Commission.

Provided that the conditions of qualification, experience and research


publication shall in no case be relaxed.

Provided that for appointment in the disciplines of Law, Clinical


Medicines, and Arts & Design (Studio Practice), instead of
Ph.D. the qualifications prescribed for appointments under the
Basic Pay Scales will be applicable.

Provided further that Post terminal Degree experience will


remain unchanged.

5. Temporary Appointments.
(1) Subject to the provisions of these Statutes, in case any post of such
teacher becomes vacant due to resignation or otherwise, the
University may make appointment against such post on purely
temporary basis only for a period of one year, extendable to three
years.

(2) The University shall, as soon as possible, make permanent appointment


on such vacant post in accordance with these Statutes.

(3) In case the permanent appointment is not made on a vacant post within a
period of one year or the extended period as aforesaid, the post so
vacant shall automatically stand abolished and the services of temporary
appointee shall be dispensed with immediately:

(4) Full-time temporary appointments shall not exceed a total of three


years except in the case of an explicit exception granted by the
University Senate.

Provided that such temporary appointments may also be made


for the positions of Research Associates working towards
their Ph.D. degree or Post Doctoral Fellows working with a
research group for a limited period.

CHAPTER 3

REMUNERATION

6. Tenure Track Pay Scales. - Subject to the provisions of the


University of Peshawar Act, 1974 (Act No. II of 1974) and the rules,
statutes and regulations framed there under, the Tenure Track Pay
Scales shall apply to the University teachers appointed or holding
posts under these Statutes.

7. Right of option. – (1) Every existing teacher shall have the right to opt for
appointment to a post carrying Tenure Track Pay Scales under these
Statutes.

(2) In case an existing University teacher is appointed to a post under


these Statutes, these Statutes shall govern the services of such
teacher after such appointment.

(3) The existing University teachers, who do not exercise the right of
option for appointment to posts carrying Tenure Track Pay Scales,

shall continue to be governed by the statutes, rules, regulations and
orders etc., regarding the terms and conditions of their service
including promotions, scales of pay, allowances, pension, gratuity etc.,
which were applicable to them before the coming into force of these
Statutes.

8. Initial pay. - The pay of every University teacher appointed or holding a post
under these Statutes shall be fixed in Tenure Track Pay Scales as prescribed in
Schedule “A”, which may be revised by the Higher Education Commission
as and when required.

9. Increment in Tenure Track Pay Scales. - The annual increment on the


Tenure Track Pay Scales shall fall due on the 1st day of December, following the
completion of not less than six months service at a stage in the Tenure Track
Pay Scales.

10. Advance increments on account of higher education etc.- Every University


teacher appointed under these Statutes shall be entitled to such advance
increments on account of higher educational qualifications etc, as are provided
for the Schedule “B”.

11. Fixation of pay on joining higher post. - In case of selection from a lower to a
higher post under these Statutes, where the stage in the Tenure Track Pay
Scales of higher post next above the substantive pay of the University teacher
concerned in the Tenure Track Pay Scales of the lower post, gives a pay
increase equal to or less than a full increment in the pay scale of the higher post,
the initial pay in the Tenure Track Pay Scales of the higher post will be fixed after
allowing a premature increment in the Tenure Track Pay Scales of the higher
post:

Provided that in case of a University teacher, who has opted to be


appointed on a post under these Statutes, his pay shall be fixed in a way
that it shall in no case be less than the substantive pay he was drawing in
the National Pay Scales of his post at the time of his selection or
appointment under these Statutes.

12. Pension and/or Gratuity. – The relevant rules shall be framed by the Syndicate
per policy of the government.

CHAPTER 4

RESIGNATION AND TERMINATION

13. Resignation. – A faculty member appointed or holding a post under these


Statutes, who desires to resign his office, shall give in writing to the Vice-
Chancellor a notice of three months period, and in the event of his failure to do
so, he shall forfeit to the University the salary due to him for the period of notice.

14. Suspension. - A University teacher appointed or holding a post under these
Statutes shall be governed, during the period of his suspension from service, in
accordance with the University of Peshawar Service Statutes, 1977.

15. Termination. – (1) Subject to the provisions of these Statutes, every University
teacher appointed or holding a post under these Statutes shall, in relation to a
misconduct, be governed in accordance with the University of Peshawar
Employees Efficiency and Discipline Statutes, 1977.

(2) In case of charge of inefficiency, no proceedings under the University of


Peshawar Employees Efficiency and Discipline Statutes, 1977 against
such University teacher shall be initiated. Such University teacher shall
be liable to be dealt with on such charge in the manner prescribed
hereinafter.

(3) For the purpose of proceeding against such teacher on a charge of


‘inefficiency’, the Registrar shall send the complaint to the Dean of the
Faculty concerned who shall, after obtaining views of the Head of the
Department concerned and after hearing such University teacher, submit
his report to the Registrar.

(4) The Registrar shall, after hearing the complainant, if any and also the
University teacher, send his report alongwith the report of the Dean,
views of the Head of the Department concerned and the explanation
given by the University teacher, to the Vice-Chancellor for disciplinary
action or otherwise.

(5) If it is proposed in the report that it is necessary to take disciplinary action


against the University teacher for misconduct on account of inefficiency,
the Vice-Chancellor shall refer the matter to the Syndicate for the purpose
of constituting a Dismissal Review Committee.

(6) The Syndicate shall constitute a Dismissal Review Committee consisting


of:

(a) Two members from amongst the University teachers appointed or


holding posts under these Statutes, who must be senior in rank to the
University teacher against whom the proceedings are being
undertaken;

(b) One member from amongst the officers holding senior administrative
post in the University;

(c) One member from out side the University, who must be holder of
some senior administrative post in any other University or national
organization or government; and

(d) One member from amongst the senior most University academicians,
who shall be the Chairperson of such Committee.

(7) The Syndicate shall frame a statement of charges and communicate
it to such University teacher with such other documents as are
essential to inform him of the circumstances which have led to such
proceedings.

(8) Such University teacher shall be further required to put in his


written defence thereto within a period not exceeding fifteen days
and to state at the same time whether he desires to be heard in
person.

(9) The Committee shall proceed to Investigate the charges against such
University teacher. The Committee may record such evidence as it
deems appropriate in respect of charge of misconduct on account of
inefficiency and such other evidence of the teacher concerned as he
desires to produce. The Committee shall, after giving chance of personal
hearing to the parties, record its report and send it alongwith its findings
to the Syndicate.

(10) On receipt of such report, if it is proposed that the University teacher is


guilty of misconduct on account of inefficiency, the Syndicate shall serve
him with final show cause notice in writing about the action
proposed to be taken against him and the grounds of the action..

(11) Such University teacher shall have right to show cause against such
action.

(12) The report alongwith the findings of the Committee shall be provided to
the University teacher at the time of serving the final show cause notice
upon him.

(13) The Committee shall hold its sittings at such place or places as the
Syndicate may direct in this behalf. It shall hold the proceedings, from day
to day, and keep the Vice-Chancellor and the Syndicate informed of
adjournment, if any and the grounds thereof.

(14) The Committee shall conclude its enquiry and finalize its report within
one month of the commencement of proceedings.

(15) The Syndicate, after receiving explanation of such University


teacher, and on considering the case in the light of report and
proceedings of the Committee and the defence produced by such
University teacher, shall pass such orders, as are deemed proper,

including dispensing with the services of such University teacher on
the charge of inefficiency.
CHAPTER 5

TENURE TRACK APPOINTMENT PROCEDURE

16. Mode of Appointment. - All appointments to the posts referred to in section-3


(1) (ii), (iii) and (iv), on Tenure Track Pay Scales shall be made in accordance
with the University of Peshawar Act, 1974 (No. II of 1974) and the rules, statutes
and regulations framed thereunder.

17. Criteria for selection. - For appointment to such posts, the candidate shall be
tested in the following four major areas:

(a) Teaching;

(b) Scholarship, research and other creative work;

(c) Service; and

(d) Personal characteristics.

18. Basis for Evaluation.-The evaluation of a candidate in the four major areas shall
be conducted and worked out on the basis of criteria laid down in Evaluation
Proforma “a”, “b” and “c” in Schedule “C”.

19. Technical Review Panel. - Before holding the Selection Board for selection of
University teachers under these Statutes, the applications and data provided by
the candidates in the form of dossiers as per Schedule “C” shall be sent to
Technical Review Panel for examination and its views.

20. Composition of Technical Review Panel (TRP). - The Syndicate shall


constitute a Technical Review Panel composed of two eminent
international academics and researchers in the relevant area drawn only
from technologically and academically advanced countries. A copy of the
dossier, alongwith names of the technical review panel members should
also be sent to the Higher Education Commission.

The following criteria set by the Higher Education Commission shall be


followed while selecting members of the TRP.

i. He/She shall not have served as Supervisor/Co-Supervisor of the candidate


under review.
ii. Shall not have been a student of the candidate.
ii. Shall not have been a Co-author of the candidate of any publication.

iv. Must have the rank of an Associate Professor or above in a recognized
university or equivalent position in a recognized research organization.
v. Must not have a lower rank than the applicant.

21. Functions of the Panel. – The Technical Review Panel shall examine the
dossiers of each candidate in the light of qualifications, experience, publications
and other criteria prescribed for such posts in these Statutes and submit its
evaluation report alongwith its views on each candidate separately to the Vice
Chancellor.

22. Value of Report of Panel: The favourable recommendations from the panel
alongwith its views thereon in respect of such candidate shall be placed before
the Selection Board of the University for consideration at the time of selection.

23. On Job Performance reviews. – (1) Every University teacher appointed


Assistant Professor under these Statutes shall be under ‘on job
performance reviews’ for a period of three years for permanent tenure
appointment. His fitness for permanent tenure appointment under these
Statutes shall remain under scrutiny during the said initial term appointment.

(2) Every University teacher appointed as Associate Professor or


Professor under these Statutes shall be under ‘on job performance
reviews’ for a period of four years for permanent tenure appointment. His
fitness for permanent tenure appointment under these Statutes shall
remain under scrutiny during the said initial term appointment.

(3) The Chairman of the Department, in consultation with other Faculty


members who are having Ph.D. Degree and also after collaboration with
the Dean of the Faculty concerned, shall prepare a review report, at the
end of 3rd quarter of each educational year, on the performance and
efficiency of the teacher concerned in the light of criteria laid down in
Schedule “C”:

Provided that all such reviews shall include the evaluation of a


teacher by the students and peers.

(4) Every such review report shall be placed before the Vice-Chancellor for
consideration and such other orders as he deems appropriate in the
circumstances of the case.

(5) In case any such teacher is found unfit for further retention in service, his
services may be dispensed with after providing him a chance of hearing.

(6) In the case of Assistant Professor, initial term appointment for three years
may be followed by a second term appointment for an additional period of
three years, if his performance is satisfactory but it needs to be further
improved upon:

Provided that the decision in this regard shall be taken in the 2nd
quarter of third year of his initial term appointment;
Provided further that the additional period of three years of second
term appointment shall also be subject to ‘on job performance
reviews’ for permanent tenure appointment.

24. Consideration of Review Reports for Permanent Tenure Appointment. –


(1) The case of every such teacher, alongwith all review reports shall be placed
before the Technical Review Panel for consideration at least three months before
the expiry of initial term appointment or second term appointment in the case of
Assistant Professor, as the case may be.

(2) The Panel shall examine the review reports and record its views for onward
transmission to the Vice-Chancellor.

(3) The Vice-Chancellor shall place the review reports alongwith the views of the
Panel before the Syndicate for consideration and approval or such other orders
as are deemed appropriate in the circumstances of each case.

(4) The University teacher appointed under these Statutes, on successful completion
of such first term appointment or second term appointment in the case of
Assistant Professor, as the case may be, will be confirmed for permanent
tenure. The services of unsuccessful University teacher would be liable to be
dispensed with immediately.

Provided that the existing University Teachers who have exercised the
right of option for appointment to posts carrying Teachers Tenure Pay
Scales shall be reverted to the Basic Pay Scale at the appropriate level
with due protection to seniority.

25. Finances and Funding for appointments under these Statutes.- All the
expenditure on salaries etc. in respect of appointments made under these
Statutes shall be meted out of the grant given by the Higher Education
Commission for this purpose.

26. Saving Clause.- (1) Notwithstanding anything contained in these Statutes, the
existing University teachers, who do not exercise the right of option for
appointment to posts carrying Tenure Track Pay Scales, shall continue to be
governed by the statutes, rules, regulations and orders etc., regarding the terms
and conditions of their service including promotions, scales of pay, allowances,
pension, gratuity etc., which were applicable to them before the coming into force
of these Statutes.

(2) These Statutes shall have no overriding effects in so far the terms and conditions
of the service of the existing teachers of the University are concerned.

(f) A faculty member may be awarded advanced increments that may be
based on the following factors.

i. Quality and number of HEC recognized International refereed


journal publications, conference presentations and publications
and reports.
ii. Number of Ph.D. and MS theses supervised.
iii. Funding record: Amount of funding received from sources other
than one's own Institution.
iv. Professional and Community service record.
v. Market factors.

(g) Total number of advanced increments awarded can be a fractional


number.
