Attempt any Two questions. (15x2=20)
Q.6 State briefly Inquisitorial system and Adversarial legal system. Do these systems influence
on Nepalese Legal System? Give reason with suitable examples.
Q.7 “Constitution is issued in the name of the people”. Justify this statement. What do you
mean by constitutional development process? State briefly about Nepalese Constitutional
Development.
Q.8 “Judiciary is the mother of democracy and it protect constitution and people’s fundamental
rights and legal rights” Explain this statement in your own words and write short note on
Nepalese Judicial system and judicial structure.

9. Read the following legal situation and answer the questions that follow (5x3=15)

Every country has its own legal system. Legal system of a country represents its history. Legal system
reflects not only social behavior it also reflects the political and cultural trends of any nation. Legal
system represents the history and civilization of a particular country. A legal system can’t remain static.
It is dynamic. It changes with the mind and will of the people. So, legal system has been instrumental
for social change. Legal system is supposed to reflect the will of the people. Nepalese legal system has
been changed with the ups and downs of Nepalese society. In particular political change has brought
massive changes into law and legal system. Every legal system aims at establishing the egalitarian
society. Legal system works as a means and endeavors to achieve the justice as an end in the society.
Questions:
a. What are the elements that constitute the legal system?
b. Does legal system remain stable? If so, how? If not so, why does it change?
c. Do you agree Nepali legal system is stable? What will we expect from all legal systems?
