PARTITION DEED

This DEED OF PARTITION is made on 2/12/2020 (the 2nd day of the


December Month 2020) BETWEEN (1) Rathnamma Somarajan, aged
70 years residing at Kothamangalam, of the first part (hereinafter called
the “first party”) AND (2) Mr. Sukumaran, aged 47 years of the second
part (hereinafter called the "second party") AND (3) Mr. Muraly, aged
44 years of the third part (hereinafter called the "third party").

WHEREAS the first party is the widow and the second party hereto are
direct brothers and are the sons and legal heirs of late Sri. Somarajan
who died on the 2nd day of November month 2020 and

WHEREAS the properties specifically and fully described in the


Schedule A hereto were acquired, owned and possessed by the said late
Sri. Somarajan as per Sale Deed No. 920/1973 of Kothamangalam of
Sub Registry; and

WHEREAS on the death of the said late Sri. Somarajan, the said
properties devolved equally and simultaneously on the first and second
party hereto as the only legal heirs, and are thereby in their joint
ownership, possession and enjoyment; and

WHEREAS the first party, second party and the third party hereto are
co-sharers and are entitled to equal shares, that is, one third each in the
said properties; and

WHEREAS the parties hereto have agreed to partition and have


separate
posession by metes and bounds for the purpose of more convenient and
better and exclusive enjoyment of the said properties; and
WHEREAS the first party hereto has agreed to accept the properties set
out in the Schedule A as his share, and the second party hereto has
agreed to accept the properties set out in the Schedule B as his share and
the third party hereto has agreed to accept the properties set out in the
Schedule C as his share;
Now this deed WITNESSES as follows
1. That in consideration of the mutual transfers and releases hereunder
effected, the parties hereto and hereunder mutually grant, convey,
transfer, assure, assign, confirm and release the properties set out in
Schedule A to the said Rathnamma Somarajan the first party, and
the properties set out in Schedule B to the said Mr. Sukumaran the
second party, and the properties set out in Schedule C to the said
Mr. Muraly the third party, to hold the same respectively as sole
and absolute owners free from encumbrances;
2. That each party hereto shall hold and enjoy the property allotted as
aforesaid in severalty, and freed and discharged from all rights,
claims and demands whatsoever of the other party;
3. That the parties hereto agree that each party shall be entitled to one
third of the property which was in the possession late Mr.
Somarajan;
4. That if any charge or encumbrance beyond the knowledge of the
parties hereto is found subsequently on the said properties, the
parties shall bear the liability in equal shares;
5. That the properties hereby allotted shall be entered upon and held in
severalty by each party without any disturbance by the other party
or any other person claiming under him;
6. That each party shall, at the cost and expense of the other party, do
every such act or thing as may be reasonably required for more
perfectly assuring to the other, his share allotted thereby;
7. That the first party shall have, and undertakes, the safe custody of
all the title deeds and other documents relating to the property
hereby partitioned and also the original of this deed, and will, at the
request and cost of the second party and third party; or successors
or assigns, produce or cause to be produced all or any of them for
inspection or for other lawful purposes.
8. That no party shall be entitled to any easements or quasi easements
over the allotments made to the other party, which are hereby
extinguished;
9. That none of the parties shall be entitled to sell or otherwise transfer
his allotment to a stranger unless he has first offered the same to the
other party and in cases only when the other party has refused to
take the same; and
10. That the area of all the properties being the subject-matter of this
deed is 32.3749 Are and the value of the share of each party is
10.788 Are of property.
