ECIL has a 1000 Sq.Mtr. plot (Size 20 Meter X 50 Meter) in Udyog Vihar, Plot No. 75, Phase- 1,
Gurgaon, Haryana. HSIIDC permits 250% FAR for construction of IT Hub, with a parking for about
50 cars accommodated in Basement. As per building by-laws for IT services buildings about 40 %
can be constructed on Ground Floor which means 400 Sq.Mtrs. Thus the building will have a
Basement, Ground and five upper floors. Present plans are to construct Basement, Ground and two
floors. The user Department will be National Population Register (NPR) in ECIL. Initial planning
will be to construct a Data Centre and a Perso- Machine Complex to meet the needs of Delhi State
and IAF NPR and also a centre for NPR – 57. The Ground Floor will thus have a corporate layout
with proper reception, elegant office access, lift and the rear part will have the Perso Centre. Some
Offices will also be there. The First Floor will have offices and Data Centre. The Surveillance
Laboratory will be on the Second Floor along with some office cabins and rooms. Though the plan is
to be submitted for complete - Basement, Ground and five upper floors, where as Basement, Ground
and two upper floors will be constructed for the time being. However approval from HSIIDC is to be
obtained for Basement, GF + Five upper floors.
Sealed tenders are invited in two bid system (Technical & Financial / Price Bid) from eligible,
reputed, qualified consultancy firms with sound Technical and financial capabilities for the following
work.
Tender documents can be purchased from the office of under signed or Zonal Manger (North), ECIL,
B-7, DDA Local Shopping Complex, A Block, Ring Road, Naraina, New Delhi-110028 on any
working day from 02.02.2011 to 23.02.2011 on payment of Rs. 500/- (non-refundable) in cash or
demand draft in favour of Accounts Officer, ECIL, payable at Hyderabad. The tender documents can
also be seen/downloaded by visiting our website www.ecil.co.in or www.tenders.gov.in
In case the tender documents are downloaded from the website, the required tender fee of Rs.500/-.
shall be deposited along with the EMD In the form of DD favouring Accounts Officer, ECIL and
payable at Hyderabad & placed, sealed in technical bid (envelope-1) along with the tender.
The last date of submission of tender is 24.02.2011 Up to 11:00 Hrs. and Part 1 of the tender
(Technical bid) will be opened on 24.02.2011 at 11:30 am in the office of Head, ESD, ECIL, P.O
ECIL, Hyderabad, 500062, Andhra Pradesh. The envelope “2” containing price bid will be opened of
only those firms who qualify for the work in the technical evaluation. The date of opening of
envelope -2 (Price Bid) will be intimated separately to the firms who qualify in the technical
evaluation.

The EMD of the firms, who do not qualify will be returned after finalisation of list of qualified firms
for the subject work and before opening of the price bid of qualified firms.
A: Prequalification Criteria:
The Principal Architect shall meet the following prequalification criteria to be eligible for this
work:-
1. The Architectural Firm should have at least 08 years experience after registration of their
firm in providing comprehensive architectural consultancy services for the residential &
Institutional projects and should have in-house facilities or should have outside consultants
for Engineering works i.e. design of Structural, HVAC, lighting, sanitation, water supply and
other services etc. Bio-data of the key personnel of the Architectural Firm especially
Architects, Engineers and associated Firms involved in design and providing detailed
architectural and engineering services are to be furnished.
2. The Consultancy firm should have the experience of having satisfactorily completed Three
similar works each value not less than 40% value of the estimated cost of project or Two
similar works each valued at not less than 50% of estimated cost of project, or one work
valued at not less than 80% similar work of “Architectural and Engineering Design
consultancy services” during the last five years at the time of submission of tender. Similar
works means rendering planning, designing & detailing of Architectural, Structural and other
engineering services for construction of corporate offices / Institutional buildings of
Government/ MNC / PSU or IT / IT enabled services buildings etc.
4. Should have minimum annual average turnover from the architectural services rendered of
not less than Rs.15 Lakhs each during the years 2007-08, 2008-09 and 2009-10 (Attested
photocopies of the audited balance sheet along with Profit and Loss account statement to be
enclosed).
6. Should have valid enlistment / registration with any Local municipal / Statutory authority/
Metropolitan city development authorities/PSU’s of State or Central Government
organisations like HSIIDC/HUDA/DDA/NOIDA/CPWD/DMRC/IRCON etc.
In addition to the above, the applicant will submit the following documents / information:-
1. Complete Name and mailing address of the applicant along with Telephone numbers, Fax no.,
Mobile Numbers and E-Mail address.
2. Information regarding firm registration details, the constitution of the applicant / firm e.g.
Proprietorship, Partnership, Private etc. along with copy of certificate of
Incorporation/Partnership deed etc.
3. Details of projects in hand indicating the name, value, nature & scope of work and stipulated
dates of completion. This shall be accompanied with the copies of the work orders or
purchase orders issued by respective clients.
4. The experience certificates from the clients for whom the works have been satisfactorily
completed indicating the brief details of the projects of minimum of five additional works
may also be submitted. If the experience certificate is from a private client, TDS Certificates
issued by the client for subject work, shall also be submitted along with the documents.
Photographs of the completed projects shall have to be necessarily enclosed along with
completion certificates.

5. Details of Associate Consultancies along with their consent letters to work on this project.
8. The applicant firm should have a running office in or around Delhi or undertake to open an
office in NCR Delhi area, preferably Gurgaon at least for the period of contract.
9. Details of Key technical Personnel on rolls along with their qualification and experience.
Should have sufficient manpower and resources to carry out such works.
11. Any other relevant details and information that the agencies may like to furnish.
12. A declaration to the effect that applicant was not blacklisted by any CPSU or by Government
of India in the past shall be submitted by the Applicant along with the application.
1. The intending bidders shall submit all the aforesaid documents duly signed & stamped by the
bidders.
2. The experience certificates & other registration certificate shall be attested by Notary Public
in addition to signature & stamp of the bidder. The bids of the consultants, who do not submit
the prequalifying documents as stated above, shall be summarily rejected.
3. Tender should be placed in two sealed cover marked as “1” (Technical Bid) and “2” (Price
Bid) separately.
4. Envelope - “1” shall contain Earnest Money Deposit, an undertaking for non stipulation of
any condition by the firm/ agency and the documents in support of eligibility and other
documents asked for in NIT. The Annexure-III at page no. 25, duly filled in and signed,
stamped.
5. Envelope - “2” should contain only Price bid.
6. These two envelope shall be placed in separate cover duly wax or cello taped and all the
envelopes shall be placed in one single cover super scribed with the name of the work
“Architectural, Structural & Engineering Design Consultancy Services for construction of the
ECIL IT Hub RCC Framed structure building proposed at Udyog Vihar, Gurgaon, Haryana”
and addressed to Head, Engineering Services Division, ECIL, Hyderabad. 500062, Andhra
Pradesh and shall reach on or before 24-02-2011 upto 11:00 Hrs. either by registered post /
courier or drop by person in the tender box placed at our office i.e Engineering Services
Division, ECIL, Hyderabad, Andhra Pradesh, 500062.
7. Application received after the due date of receipt will not be entertained. ECIL takes no
responsibility for delay, loss or non-receipt of the application sent by post / courier.
8. Further details / clarifications if any, can be had from Sr. Manager (Civil), ECIL. The
working hours of the Company on all working days are 0830 Hrs. to 1600 Hrs. The
communication facilities available are E-mail: headesd@ecil.co.in or smcivil@ecil.co.in
and Telefax No. 040-27182550 and Telephone Nos.040-27182511, 040-27120665.
9. ECIL reserves the right to accept or reject any or all the tenders in part or full without
assigning any reason thereof, and in such case the bidders shall not have any claim on ECIL.

D: Important Note:
1. The envelope “2” containing price bid will be opened of only those firms who qualify in the
Technical Evaluation for the work.
3. If at any stage, any information / documents submitted by the applicant are found to be false,
the agency shall be liable for rejection, apart from any other appropriate /legal action by
ECIL.
4. The Applicant shall extend all assistance in facilitating the designated screening committee of
ECIL in accessing the Completed project sites.
5. The tenderers shall affix their signatures and seal on all pages and enclosures of the
application.
6. The Architect shall be in a position to furnish the original letter of Appointment and
Completion Certificate to ECIL on demand for verification purpose, from the owner /client
for whom the project has been executed in respect of experience quoted for this work.
7. The tenderer, who did not wish to attend the tender opening, shall send a “No
Objection” for opening of bids in his absence. In case no one is deputed on behalf of
agency/company/architect, then they should forward a written request expressing
your inability to send any one for opening of the tender specifying the reasons for the
same and also confirm that you have full faith in the tender opening process to be
adopted at ECIL and have “NO OBJECTION”.
8. The tenderer will be required give clarifications to any question that the Technical
Committee may ask over telephone/fax/mail/letter after the bids are opened.

1.1 Background:

1.3 Submission of Tender / Opening of tender: tender shall be submitted in the office of Head,
Engineering Services Division, ECIL, Hyderabad- 500062, Andhra Pradesh on or before 11:00 Hrs, of
24.02.2011. The Technical bids shall be opened on 24.02.2011 at 11:30 Hrs in the presence of
tenderers or their authorised representatives. The tenderer, who did not wish to attend the tender
opening, shall send a “No Objection” for opening of bids in his absence. Tenders received after due
date and time shall not be accepted.
1.4 Earnest Money Deposit (EMD): The earnest money deposit for this work is the amount as stated at
section –I, NIT. Earnest Money Deposit in the form of Demand Draft drawn on any
Nationalized/Scheduled Bank, in favour of Accounts Officer, M/S Electronic Corporation Of India
Ltd., shall be kept in the Envelope-I of the Bid. The Demand Draft shall be payable at Hyderabad.
The EMD so submitted in the form of Demand draft, will be adjusted into Security Deposit in case
of successful tenderer and shall be returned in case of unsuccessful tenderers after award of work to
successful Bidder.
1.5 Validity of offer: 120 (one hundred twenty) days from the date of submission of tender.

ENVELOPE-I
This envelope shall be super scribed as “EMD and undertaking for Rendering Architectural,
Structural & Engineering Design consultancy services for the construction of ECIL IT Hub RCC
Framed structure building proposed at Udyog Vihar, Gurgaon, Haryana.” clearly written on top of the
Envelope. This envelope shall contain the following documents:
i) EMD as per clause 1.4 of this section shall be enclosed in a separate envelope as part of
Envelope-I (Technical Bid). The Bids without EMD shall be summarily rejected.
ii) Undertaking of acceptance of terms & conditions (specified in these tender documents as
Annexure III), on the letter head of the company/or firm as the case may be duly signed and
stamped by the authorised representative.
iii) Demand draft for cost of tender document in case the tender documents are downloaded directly
from the website.
iv) All the documents of prequalification mentioned in the Tender Document Section I to IV.
v) Annexure-III at page 25, duly filled in, signed and stamped by authorised signatory.
Envelope-I shall be opened first on the date and time mentioned herein. The Technical Bids shall be
opened only of those consultants who have submitted the requisite EMD, Tender fee for downloading (if
applicable) and Undertaking as mentioned above in the Envelope-I. All the documents shall be duly
signed and stamped and notarized wherever applicable. The technical evaluation committee of ECIL will
check pre-qualification documents and evaluate each tenderer’s technical capabilities including visits to
see the buildings for whom the consultancy services rendered by the tenderer before qualifying them.
ENVELOPE-II
Envelope –II contain the price bid – section V of the tender document. This envelope shall be super
scribed as “Tender Conditions & Price-Bid for Rendering Architectural, Structural & Engineering
Design Consultancy Services for the construction of ECIL IT Hub RCC Framed structure building
proposed at Udyog Vihar, Gurgaon, Haryana.” clearly written on top of the envelop. This document shall
be duly signed and stamped on each page by the authorised person of the firm.
1.7 The price quoted by the tenderer shall be in Rupee Term basis as consolidated amount. The
Estimated Cost has been put as 390 Lakhs. This Cost put to tender for construction work does not
include the following:-
1.8 ECIL reserves the right to accept/or reject any or all the tenders received without assigning any
Reason whatsoever.

1.10 As the consultant has to frequently visit ECIL office at Delhi & Site of work at plot No. 75, Udyog
Vihar, Phase-1, Gurgaon for approval of concept plans, BOQ, specification etc. and to give
presentation at Hyderabad twice for which no extra fee is payable.
1.11 The consultant should be well versed with the green building features to be provided in various
buildings.
1.12 The consultant should submit the tender document, complete in all respects as explained above.
Incomplete tender documents shall be summarily rejected and price bids of those consultants shall
not be opened.
1.13 Services tax: Services tax, if applicable, shall be reimbursed on submission of valid proof of having
deposited the same to the tax authorities.
1.14 At present, the total estimated cost of Building is approximate Rs.390 Lakhs. However, if any of the
work is withdrawn by ECIL, the same shall be withdrawn from the scope of consultant and
proportionate consultant fee shall be reduced and paid only up to the stage for which the consultant
rendered the services. Consultant shall have no further claim whatsoever on this account.
1.15 If any clarifications are required by the consultant on the tender conditions or scope of work, the
same shall be enquired from this office at least five days prior to last date of submission of tender,
thereafter no query shall be replied.
1.16 In case the whole project does not get sanctioned/ approved by ECIL and the consultant has done
work upto conceptual approval and preliminary estimate, a lump-sum amount limited to Rs.50000/-
(Rupees fifty Thousand Only) for the project value shall be paid to the consultant.

Rendering Architectural, Structural & Engineering Design Consultancy Services for the
construction of ECIL IT - Hub RCC framed structure building proposed at Udyog Vihar,
Gurgaon, Haryana:
AREA
1 ECIL IT Hub building proposed at Udyog 2500 Sq. Meter excluding basement
Vihar, Gurgaon, Haryana area.
1.2 The planning, designing & detailing components shall be done based on local building Bye-
Laws, latest National Building Code & relevant BIS Codes.
ii) The above scope is indicative and ECIL reserves the right to add or delete the building (s) as a
whole or in part without assigning any reason thereof. The Consultant shall have no claim
whatsoever on this account.
In consideration of the fees hereby agreed to be paid to the Consultant , the Consultant shall
faithfully, expeditiously, economically and honestly perform the following services for complete
work as per time schedule enclosed at Annexure – I :
2.1.1 Undertaking site visits to collect details / data / information required for planning Purpose,
holding necessary discussions with the officials of ECIL and obtaining requirements of project
and attending meetings at site of work or ECIL Office as and when required by ECIL.
2.1.2 Arrange and get the detailed survey & soil investigation for the site of the project. The cost is to
be borne by architect.
2.1.3 Preparation and submission of preliminary concept drawings including layout plan of concerned
area, a brief report on preliminary cost estimates based on latest Gurgaon Market construction
rates and obtaining necessary approvals from ECIL including preparation & submission of
models, photographs, perspectives and other documents, giving presentations etc., if required , in
connection with approval from ECIL and Statutory Bodies.
2.1.4 Preparation & submission of Municipal Drawings based on approved concept plans and taking
necessary approvals from Local Statutory authorities.
2.1.5 Preparation and submission of adequate number of Tender drawings, designs and Specifications
for each and every building / structure including all Internal & External services complete based
on approved concept plans and including getting necessary approvals from ECIL and Statutory
Bodies.

2.1.7 Preparation and submission of detailed Architectural drawings, designs and specifications for
building / structures suitable for construction and releasing to site “Good for Construction”
drawings including getting approvals from ECIL wherever required.
2.1.8 Preparation and submission of detailed structural designs drawings, fabrication and erection
drawings based on approved Architectural drawings, for various buildings / structures,
suitable for construction and release to site “ Good for Construction” drawings including
getting approvals from ECIL wherever required.
2.1.8 (a) The Consultant shall submit the checklists enclosed with this tender document vide Format
No.1&2 for Architectural and structural consultancy respectively. The check lists shall be
duly filled in, signed and stamped by the authorized Architect and structural engineers
respectively and shall be submitted along with the Architectural & Structural drawings for
each work.
2.1.9 Preparation and submission of detailed designs, drawings and documents for all internal utility
services like plumbing fire – fighting , electrification, fire detection, HVAC, lifts , telephones,
EPABX, public address system, communication, networking acoustics, Green Building
Features and other specialized services as per the requirements of the project suitable for
construction and release to site – “Good for construction” drawings including getting
necessary approval from ECIL wherever required.
2.1.10 Preparation of designs, drawings and documents pertaining to external utility services water
supply , sewerage, storm water drainage, fire hydrants schemes , treatment plants for water and
sewerage , water supply in – take arrangements , Solar Water Heating System , Rain Water
Harvesting, Green Building Features , roads, street lighting, telephone system. Substations,
switch yards and other related schemes, landscaping, horticulture, arboriculture , street
furniture , paths , boundary walls and any other specialized extra services as per project
requirement suitable for construction and release to site “Good for construction” drawings
including getting necessary approvals from ECIL wherever required.
2.1.11 Preparation & submission of drawings / details of any other item(s) not mentioned above but
required for completion / execution of project as per requirement of client.
2.1.12 Obtaining approval from any Statutory Body / Local Govt. Body like Pollution Control Board
etc. as applicable to this project for execution of work or for approval of designs / drawings of
the schemes.
2.1.13 carrying out all modifications / deletions / additions / alternation in design / drawings /
documents as required by ECIL for proper execution of works at site till completion and
handing over of the project to the client.

2.1.15 Preparation and submission of completion reports, completion drawings and documents for the
project as required and acceptable to ECIL / clients including getting necessary completion
certificates, from statutory bodies, if required . The completion documents shall be submitted in
soft copy also in an acceptable format. Obtaining of completion certificate from HSIIDC will be
on architect part.
2.1.16 Defects Liability Period for the project from the architect point of view is 6 months, which shall
be reckoned from the date of taking over by ECIL or issue of completion certificate by HSIIDC.
The consultant shall visit the site and provide all the drawings/ details / specifications for
rectification of defects, if any at no extra costs/fee.
NOTES:
1. Total. Consultancy fee shall be calculated as per clause no. 3.0
2. ECIL shall release running payments on pro-rate basis for various stages depending upon extent
of their completion and statutory deductions, Decision of ECIL in this regard shall be final.

SECTION-IV
5.1.1 The Consultancy fee shall be payable on the tendered amount after adjusting any rebate given by
the tenderer during negotiations if any.
The cost estimate put to tender shall not include the following for the purpose of calculation of
consultancy fee:
5.1.2 If after preparation and submission of concept plans and preliminary estimate by the consultant,
ECIL decides to withdraw the work of planning and designing of a particular work the same shall
also to be withdrawn for the scope of consultant and consultancy fee of 5% up to conceptual stage
shall be payable to the consultant and no further claim whatsoever of the consultant shall be
entertained by ECIL in this regard.
5.1.3 Service tax: Service tax, if applicable, shall be reimbursed on submission of valid proof of having
deposited the same to the tax authorities.
5.1.4 The fee payable to the consultant is tendered amount minus rebate offered if any.
5.1.5 The consultant undertakes to design, redesign, modify, and make changes in the design, drawing,
details Etc., till they are finally approved by ECIL and as required for completion, trial run, defect
liability period and handing over of the project to clients, within the fees agreed to by the
Consultant and Nothing extra shall be payable to the Consultant in this regard.
5.1.7 The Consultant shall prepare necessary model including walkthrough, in connection with
approvals of scheme prepared by them from Clients/Statutory bodies etc., No additional payment
will be made on this account.
5.1.8 If at any time after award/start of work, the ECIL decides to abandon or reduce the scope of work
for any reason whatsoever and hence not require the whole or any part of the work to be carried
out, the tenderer shall have no claim for any payment of compensation, or otherwise whatsoever,
on account of any profit or advance which he might have derived from the execution of the
works in full but which he did not derive in consequence of the foreclosure of the whole or part of
the work.

5.1.9 DELIVERABLES :
The Consultant shall supply free of charge to the ECIL, the following documents:
i) Six numbers of copies of project report referred in clause 2.1.3
ii) Six sets of the preliminary drawing and estimates.
iii) Six sets of complete detailed design calculations (structural and other services) including supply of
drawings incorporating subsequent modifications/revision, if any.
(iv) Ten sets each of all working drawings for Architecture for Architectural, Structural, Public Health,
and Electrical, Mechanical, fabrication, Erection and all services and works (good for
construction drawing), based on the approved drawings including supply of drawings
incorporating modifications / revision, if any.
(v) Six sets of detailed estimates, specifications, for non-schedule items and rate analysis of all the
works.
(vi) Adequate number of tender documents and drawing, as required by ECIL.
(vii) Adequate number of additional design, drawing and other documents needed for proper
execution of works, as required by ECIL.
(viii) Six sets of completion drawing and detailed documents duly approved by ECIL / Local Body as
required and soft copies of the drawing/documents/design calculations shall also be submitted to
ECIL.
5.1.10.1 The consultant shall provide the documents, drawings, design, details required for timely
completion of works within the time period mentioned in Annexure-I. The consultant shall
complete the said works within agreed time schedule. No extension of time for completion of
the same shall be made owing to any variations made in the works by the orders of the ECIL.
5.1.10.2 If at any stage, Project has been delayed by the acts of ECIL or by the deployed contractor for
the work, nothing extra shall be payable to the consultant. However suitable extension of time
for completion of work shall be granted accordingly.
5.1.11 All designs and drawing shall be the property of ECIL and name of the ECIL shall be
predominantly displayed on all the drawing and documents as “OWNER” the originals of
approved completion drawing shall be on good quality re-producible tracing paper
5.1.12 The consultant shall be fully responsible for evolving safe, economic, technically sound and
correct design and shall ensure that the planning and designing of the work is carried out based
on the tender documents and specifications, latest National Building code, latest BIS codes of
practices, legislation, other relevant bye-laws and good engineering practices and consultant
guarantees all other the performance all the structures, conveyances systems and all other
Services after completion. The bill of quantities and specifications shall be as per CPWD,
MOST, BIS, ECIL norms as desired by ECIL.

5.1.14 The Consultant shall ensure at detailed design stage that the project is completed within approved
project cost and the actual quantities of works executed at site based on details/drawings given by
the Consultant, should not exceed by 10% (ten percent) of the quantities given by him at detailed
estimate stage on the basis of which the project cost is approved by the clients or tender is invited. In
case ECIL has to incur extra expenses due to execution of extra quantities/additional work to
complete the project, the same shall be recovered from the Consultant upto the extent of maximum
15% (fifteen percent) of total consultancy fees.
5.1.15 while providing consultancy services, the Consultant shall ensure that there is no infringement of
any patent or design rights and he shall be fully responsible for consequences/ any actions due to any
such infringement. The Consultant shall keep ECIL indemnified all the times and shall bear the
losses suffered by ECIL in this regard.
5.1.16.1 The rate quoted by Consultant shall be deemed to be inclusive of Sales Tax, Turnover Tax, Work
Tax or any other similar tax application under the existing laws or levy by the statuary
authorised/state/central govt. except services tax which will reimbursed to the Consultant on
production of valid proof of depositing the same with the tax authorities.
5.1.16.2 The statutory deduction of income tax or other taxes/dues if applicable shall be made from the
payment released to the Consultant from time to time and the same are deemed to be included in the
Consultant fees.
5.1.17 The consultant shall be required to sign an agreement with ECIL within 15 days of receipt of letter
of award based on these terms & conditions.
5.1.18 This consultancy works may be terminated at any time by ECIL upon one month’s notice in writing
being given to the Consultant, if the Consultant’s work is not found to be satisfactory according to
the terms of the agreement. In case the agreement is terminated on account of Consultant’s work not
being satisfactory, ECIL will get the work done at the risk & cost of the Consultant.

In case the Consultant fails to complete the work within the contract period or extended period
mentioned in clause 5.1.13 above owing to reasons attributable to the Consultant, liquidated
damages @ 1% per week of the total fees subject to a maximum of 10% of the total fees payable
shall be levied on the Consultant. If the work is held up at site due to non-availability of
Drawings/specification/other details as per mutually agreed schedule, penalty, proportionate to the
value of work which is held up, shall be imposed on the consultant from the stage payments due.
ECIL will not be responsible for any delay / stoppage of work due to force majeure conditions like
natural calamities, civil disturbance; strikes war etc. and loses suffered, if any by the Consultant on
this account. ECIL shall not be liable in any way to bear such losses and no compensation of any
kind whatsoever will be payable by the ECIL to the Consultant.
The Consultant shall be responsible for the accuracy of the data collected and the designs, drawings,
quantities and estimates prepared by him as part of the project. He shall indemnify ECIL against any
inaccuracy in the work, which might surface at the time of ground implementation of the project. In
such an eventuality, the consultant will be responsible to correct the drawings including
reinvestigations etc. as required without any extra cost implication on ECIL.
5.1.22 The Consultant shall appoint and notify a team of well qualified Technical personnel’s from his
organization to represent the consultant in all the meetings/ presentations with ECIL, Local Bodies
or any other agency.
5.1.25 ECIL reserves the right to award the work of full or partial to the Consultant. Nothing extra shall be
paid on this account. Further the payment of consultancy fees shall be regulated as mentioned under
the caption “Note” in Bill of Quantity of section-V.
5.1.26 JURISIDICTION:
The agreement for this work will be executed at Hyderabad and be governed by the Indian Law for
the time being in force and the court in Hyderabad alone will have jurisdiction to deal with matter
arising there from.

UNDERTAKING
Further we have noted that after unconditionally accepting the tender conditions in their entirety, it is not
permissible to put any remarks/conditions in the Price Bid enclosed in Envelope-II and the same has been
followed in the present case. In case this provision of the tender is found violated at any time after
opening of Packet-II, I/We agree that the tender shall be summarily rejected and ECIL shall, without
prejudice to any other right or remedy, be at liberty to forfeit the full said earnest money, absolutely.
