EMERGENCY MOTION TO SHOW CAUSE
FOR THE MISSISSIPPI SUPREME COURT TO CAUSE/DEMAND JUDGE
KENT MCDANIEL, AND RANKIN COUNTY CLERK BECKY BOYD
OBEY THE RULES AND RELEASE THE SWORN COURT
TRANSCRIPTS THAT HAVE BEEN PAID FOR AND DESIGNATED FOR
APPEAL SINCE JULY, 2020
WHICH WILL END THE HEARSAY OF THE JUDICIAL COMPLAINT TO
THE MISSISSIPPI SUPREME COURT AS A MATTER OF LAW

COMES NOW, Plaintiff Daniel Shope, by and through his attorney of record and files
this EMERGENCY MOTION for the Mississippi Supreme Court to cause and demand
to cause/demand that the honorable judge Kent McDaniel and the Rankin County Clerk,
Becky Boyd TO OBEY THE RULES AND RELEASE THE SWORN COURT

APPEAL SINCE JULY 2020 BUT IS BEING HELD HOSTAGE BY BOTH
The point of resolution to this entire conflict and complaints filed against the honorable
judge Kent McDaniel’s, Rankin County’s Clerk office Becky Boyd versus and this
attorney can be easily resolved with the recorded court transcripts of the hearing held on
June 23, 2020 and September 1, 2020. Please see exhibit A. The docket sheet from the
county court evidencing that a sworn court hearing did take place. These said official
records are being refused for the appeal by the honorable judge Kent McDaniels and
Becky Boyd since Plaintiff paid for them as shown in exhibit B. The first cancelled proof
of check is for the summary judgment records check dated July 28, 2020, that check
shows that the Rankin County Clerk deposited and cleared the firm’s bank account on
August 4, 2020, but to this date, there has not been absolutely NO DOCUMENTS FILED
FOR APPEAL nor provided to the Plaintiff. Exhibit C, the filed Rankin County Court’s
ESTIMATED COST OF APPEAL dated September 15, 2020 clearly shows that the
$348. The next check that was written for the September 1, damages hearing was for
records that Defendant’s attorney tried to trick this attorney by designating records for the
appeal all while knowing that such designation of records was filed by Defendants some
45 days too late. But out of the desire to see legalism in our courts in Mississippi,
Plaintiff paid that additional cost anyway just to get the matter into appeals court
(although Plaintiff filed numerous of documents arguing that Defendant has dirty hands

and that the conspiracy of the honorable judge Kent McDaniel’s, Rankin County Clerk
Becky Boyd and Defendants attorneys Chris Walker and Hubert Williams to try to STOP
Plaintiff from appealing this case was unsuitable in the practice of law and adjudicating.
I cannot say anything to why Rankin County Clerk Becky Boyd choose this path, but
when asked and as I filed with the court emails stating she said that judge Kent
McDaniel’s said not to release the records. I swear the JUDICIAL SYSTEM in place in
Mississippi must work fairly, otherwise what could be the purpose of the Canon Rules if
the watchdog himself is the violator at will. Therefore, there is absolutely no existence
not even the [1] document nor court transcription as paid and designated. Therefore,
either there is a conspiracy, or Rankin County Clerk’s office has EMBEZZLED OVER
$4,000 dollars of Plaintiff’s money. I swear to this date I not received NOT ONE DIME
of that money back as a refund. Additionally, this case is still under the jurisdiction of
the Mississippi Supreme Court Appeal Case No. 2020-M-995. After reviewing the
Canon Rules, exhibit D, for the accountability of Mississippi Judges conduct to the
Mississippi Supreme, the Mississippi Supreme Court has acknowledged that it has
adopted the rules for judicial performance in Mississippi. On September 8, this attorney
relief for this attorney of the honorable Judge Kent McDaniel and although the word
EMERGENCY MOTION typically causes the court to respond within 14 days, at least
from what I have read in some case law and sometimes even 7 days, (law omitted since
the Court has the power to move on any motion when the court so desires). Plaintiff has

been told that the court, likely due to COVID-19, simply has not gotten around to the
motion since a lot of government employees are working remote. However, there now
exist questions, like does the Mississippi Supreme Court desire to have it’s elected
judges, regardless of their title, years on the bench or even friendships follow the
Canon Rules 1, 2 and 3 in the interest of justice? Plaintiff avers that county and
circuit judges are voted into their seats by Citizens whom believed they would follow
Canon Rules, even when they do not like the attorney before them. Plaintiff and this
attorney has attached to this pleading the motion exhibit E, that was filed with this
honorable Mississippi Supreme Court, and will request that the Court consider the
already exhibits that were filed with that motion so that Plaintiff does not appear to be
redundant in information and pleadings that are already before the court.
Now, on November 18, 2020, yesterday, Plaintiff Daniel Shope’s attorney received a
bar complaint from the Mississippi Bar Commission, hereto attached as exhibit F, where
the honorable judge Kent McDaniel’s filed against this attorney. The letter from the
judge is dated September 9, 2020 and the letter from the Mississippi Bar is dated
November 17, 2020. At this time it is not clear as to why there is such a huge gap in the
date filed and the date sent to Plaintiff’s attorney, nor is the recognizing of the same
relevant to Plaintiff at this time other to show the conduct of retaliation from the
honorable judge Kent McDaniel since the complaint is dated one day after Plaintiff and
his attorney filed a motion of recusal regarding Judge Kent McDaniel hereto attached as
exhibit E. Plaintiff believes that the honorable judge Kent McDaniel filed this his bar

complaint out of pure RETALIATION, MISUSE OF THE ROBE WHILE ON THE
McDaniel signed the document as Judge Kent McDaniel), and what appears to Plaintiff to
be driven by some form of darkness from the bench. The bar complaint as described and
answered to below, shows a era of conviction by a Mississippi Judge whom has clearly
went so far out of his duties to the bench, the court, lawyers and God knows citizens
whom voted him into that seat. Plaintiff reminds this Court that the honorable Judge
Kent McDaniels filed his bar complaint against me for the issues found in my [2] Judicial
Complaints against him, hereto attached as exhibit G, that shows my complaint against
the honorable judge Kent McDaniel’s was received on September 2, 2020 and again
Plaintiff filed his motion to recuse the honorable judge Kent McDaniel on September 8,
2020 which without any reasonable doubt, that judge Kent McDaniels knew of my
second complaint as well as Plaintiff’s motion for recusal and thereby simply filed the bar
complaint against me where he says that I am mentally ill, the law school where I
graduated from…, well, Plaintiff need not read it to this court, it’s attached. What is
puzzling to the honorable judge Kent McDaniel’s bar complaint is that he included
documents that were sent to the bar commission regarding an open case of violation of
M.R.P.C. for the opposing attorneys, namely Chris Walker and Hubert Williams. The
those lawyers bar complaint when the documents were sent to the Bar Commission and
of course to attorney Chris Walker and Hubert Williams. Plaintiff believes that some

form of communication might have occurred between the judge and opposing attorneys
and that this attorney simply tired of even trying to understand those things that continue
As a result of the foregoing, Plaintiff and his attorney has to file the following since
the honorable judge Kent McDaniel’s has acted so far out of the scope of his sworn oath
before the Mississippi Supreme Court calling Plaintiff’s attorney crazy, implying that the
HBCU Law School that I attended could not have educated me, at least that’s what it
sounds like , but instead of being dark minded back to him, I will not disrespect that seat
because of a few bad actors, besides, I can’t even to prove my innocence of the bar
complaint. However below are exact excerpts from the honorable judge Kent
Moreover, this attorney for Daniel Shope swear that I have Not performed any
unprofessional litigating before judge Kent McDaniel and certainly not committed any
inducing of perjury, and goes with reason why don’t judge Kent McDaniel cease from
obstructing justice in this matter and PRODUCE THE TRANSCRIPTS THAT SAYS
On September 8, 2020 Plaintiff filed for an emergency motion to recuse the honorable
judge Kent McDaniel of Rankin County Court for several violations of the Judicial

allowing the judicial system to work as it is written, has filed a Bar Complaint, after
Plaintiff’s attorney filed [2] judicial complaints against him as well as Plaintiff filing a
motion for his recusal from Plaintiff’s case. Please see exhibit ?
THE EVIDENCE:
A. Judge McDaniel: “I was told by another former ADA and AUSA that she had used
precisely these same tactics of making not just legal threats but personal and
professional threats against another doctor who CAVED in and paid settlement
money to HER and her client. My response: I have no idea why judge Kent
McDaniel would be speaking with a former ADA and AUSA about me when I should
not be that important for conversation, I represent a client in the matter and that client
has a right to appeal the judge’s final order. I am bewildered as to who the former
D.A. or even A.U.S.A could be and to my knowledge I have never had any litigation
with a former D.A. nor A.U.S.A. at least they have not told me such a title, and why
would it matter, I practice law on behalf of clients and since the law is in black and
B. Next, the honorable judge Kent McDaniel states in paragraph two of his complaint
that: “I used the same tactics of making not just legal threats but personal and
professional threats agasint another doctor who CAVE in and paid money to me.”

MY RESPONSE: I work for clients and I can only use the law and facts to resolve
sentence, if another lawyer settled the matter with that Plaintiff( again no ideal why a
closed conditional settlement would result in that lawyer possibly violating the very
agreement that he procured with my client) then I guess I did my job, otherwise, it
seems to me that the other lawyer would have written a bar complaint and certainly
not paid money to my CLIENT, not me. Also, this office practice that any
settlement monies are paid to the client whom pays the attorney, not to the attorney.
But the greater issue with the honorable judge Kent McDaniel’s statement is that he
spoke with whomever these former person[s] are about a confidential settlement and
he did so in order to bolster his argument that I did something wrong, when by mere
admission it says the other attorney CAVED in, whatever that means. Plaintiff
contend that that statement in it’s self is a violation of the very law, statutes and rules
that were are to abide by, confidentiality agreement, at least pursuant to the executed
agreement, but again I have no ideal whom the honorable Kent McDaniels is
referring to. I also know that each and every attorney that I have had to argue against
regarding major medical malpractice cases since I have become Barred have at least
15 to 30 years more experience than I, and that none of them has been a female so I
am not sure how I could have frighten anyone to settle when they work for their
client, and not me. I am confused with that assertion, because it appears that judge
McDaniel’s is saying that I did exactly what the court’s like and that is to settle the

matter to prevent litigation that could be settled outside of the court, and I and
another lawyer[s],(usually I argue against at least two lawyers on any given medical
malpractice case). That said, I am glad that I can see that the law works.
C. From that same paragraph the honorable judge Kent McDaniel states that: “ some

Plaintiff’s suit was frivolous, then WHY IN THE NAME OF LAW would they
MOTION TO DISMISS, but they did not, they actively participated and even filed
around 35 plus subpoena’s on behalf of their client. Which proves that they were
either falsely billing their clients or has come to the appeals process with dirty hands
calling Plaintiff and his attorney as extortionist. (Plaintiff filed a bar complaint

against these attorney fully citing proof that either defendants lawyers are the one
bring a frivolous pleading, or they have robbed their clients out of over $200,000
dollars. Please see the bar complaint filed against attorneys Chris Walker and Hubert
Williams on file with the Mississippi Bar Commission. In fact, judge McDaniel
made the record stating that the parties should pursue discovery, which is why the
case stayed alive until July 2020. Even in the honorable judge Kent McDaniel final
judgment not one time did the court state in it’s opinion that Plaintiff nor his attorney
brought a frivolous lawsuit. See exhibit H. I submit to this record that if I had filed
a frivolous lawsuit nearly [3] years ago, then why would Defendants continue to bill
their clients when they could have EASILY JUST FILE A MOTION TO
DISMISS. Even the Court itself could have dismissed the matter at the early stages
of litigation. Instead, I am now fighting to hold the client’s position and in the mist
of that fight being attached by some judges because I have sought an appeal of this
matter.
D. Then the honorable judge McDaniels states in the last sentence that I have done
something illegal and clearly unprofessional activity, at least he states in his opinion.
MY RESPONSE: Do you mean to tell me that it took a sitting judge [3] years to see
that an almost [5] years of practicing lawyer is doing something illegal in his
courtroom and that there are two [30] plus years of experienced attorneys for the
defendant that participated with the litigation of this now so-called illegal and
unprofessional activity before the court, of course not. Surely this honorable judge

would have immediately sanctioned or written a bar complaint regarding any
disrespectful behavior by this attorney, instead, it was not until after I filed [2]
the behavior of the honorable judge Kent McDaniel regarding the unfair, unethical,
and racially motivated conduct involving me with this client. As such, by mere
complaining to the Bar, judge Kent McDaniel cannot be saying that he allowed the
law to be broken for over [2] years and did nothing, nor can he say that he knew a
lawsuit to be frivolous and fail to act on that frivolous lawsuit against the attorney,
myself before the attorney filed judicial actions against him. Judge McDaniel is
simply angry that I have asked the Mississippi Supreme Court to please look into the
ill conduct of judge Kent McDaniel and to do so according to the Canon rules or
E. Then on page 2 of the honorable judge Kent McDaniel’s bar complaint, he states
Kent McDaniel states that:” I received a document that she has filed in U.S.
District Judge Jordan for his candid description of her lack of communication skills.”
[18]. There Plaintiff made the appropriate OBJECTION to the honorable judge

Jordan’s order where by the judge said “ NEARLY EVERY STATEMENT FROM
clients every document or an order from the court so that clients can participate in the
judicial system and understand why a court says what it says. In that case, I had
every right to explain to the honorable judge Jordan that my grammatical writings
might be because I attended public schools using used books and more, but
are like grammatical errors found in this very pleading also, but the law doesn’t
change nor has the rules been altered. I assured the court that the law to support
Plaintiff’s arguments comes straight from the WestLaw. I then told the court that I

errors. Then Judge McDaniel, said on page 2 the last sentence that I have the
“audacity to call myself a freedom fighter,” and MY RESPONSE: just like in 1850
and 1860, Harriet Tubman had those whom were against her efforts to free slaves so
do I accept the honorable judge Kent McDaniel comments about me trying to free
people from oppression of the Jim Crow laws of todays society, and in doing so I
have made some people literally hate me and my efforts. I understand that people
resist change and following the U.S. Constitution 14th amendment rights due process

agitate some, but it does not change the law, my clients have a right to bring their
grievances before the appeals court, at least I thought. Surely if you have never been
homeless, strongly dependent on drugs, hungry for food and clothing, black nor a
you likely has never had to fight. The truth is I bring black lives matter, as well as
women against sexual abuse cases and causes to the fore front daily, and that is
usually at no cost to my clients or the person upon commencement. So for the judge
to say what I am to my people is his opinion, and I can understand it since he likely
has not had to live the life that I and others did and do. I believe and have been called
a black woman whom helps the poor and black people alike indeed since the
make this state better than what it use to be. I further told the honorable judge
Jordan that such statement from the court could cause me to be in trouble with my
client whom could have taken that statement as an intentional statement that I should
not be their lawyer and that I did not do my job toward that client’s case. Therefore, I
did nothing wrong but to show to the court that although I am a black older woman, I
am human and attacking my education was not going to cause the writings from this
office to differ, instead, brings more questions especially since I often read the work
of other lawyers whom files with state and district courts and find several misspelled
words but I do not see where any court opinion on anything but the facts and law
before that court. Therefore, I did nothing wrong with the by filing a respectful and

proper objection that saves my firm from harmful complaints because the judge is
essentially telling the client that I cannot spell or the likes, at least that was the humor
found in the footnote to some. In fact, when I went over that order with my client
she was torn because she thought that judges are to be fair and not appear biased. In
fact, I told her that I would withdraw from her case because I don't think that she
would get a fair adjudication with me involving this judge. She begged me to stay, I
did. Moreover, Clearly as powerful as the chief judge in this district court could
with the stroke of his pen, exercise his authority and power to sanction me or have
me to respond to being unprofessional to him, he did not, and the document attached
F. It followed that judge Kent McDaniel by virtue of his page [1] bar complaint against
me, is simply EXTREMELY ANGRY with me for filling the [2] judicial complaints
against him and filing with the Mississippi Supreme Court a complaint of his
breaking several Canon Rules 20-M-0995. I did not simply make conclusions of the
honorable judge Kent McDaniel’s bad behavior I support each claim with evidence.
The same is attached here below as exhibits A-T, which is filed with the Mississippi
G. Continuing with the honorable judge Kent McDaniel’s bar complaint. The first
paragraph after he says I chastised the honorable judge Jordan, judge McDaniel’s
says: “MY FELLOW LAWYER also advised that Robinson has had confrontations

MY RESPONSE: The judicial system must be fair, WHO ARE HIS FELLOW
accusing me of violating my oath as an attorney, please tell me who are they? In fact,
pursuant to M.R.P.C., if another lawyers knows that a lawyer has violated any
M.R.C.P. they have a duty to report the violating lawyer. Does these rules only
apply to some and not all, of course not. There is no record where the honorable
judge Linda Anderson ever sanctioned me for being disrespectful to her, nor has the
same judge ever filed any bar matter that I was disrespectful to her, please check the
record, obviously someone did to make this assertion. Oh come on, that is the second
most powerful judge in this state, surely as long as she has been adjudicating she
knows how to file a complaint and/or sanction a lawyer. The truth is, as I wrote when
the honorable judge Gargiulo brought this same matter to a motion to recuse that I
filed in another case, “let me be clear, Judge Linda Anderson is an icon in the face of
this lawyer, she is a black female whom has acquired to be a magistrate judge. I like
may others in my black community honors her. So as then in that response and now,
shame on anyone that would say that I disrespected such an honorable magistrate
judge. The way I see it, the problem that voters as well as judges seeing that matter is
that why in the name of Jesus would the honorable judge Kent McDaniel make
reference to Magistrate Linda Anderson’s race. It certainly does not matter to her
authority and power over a simple lawyer as myself because when I am before her I
answer her as the Court, Judge, or Your Honor. Why does the color of her skin has to

be shown in judge Kent McDaniel’s argument to describe her, I mean does not the
judges in the Mississippi Supreme Court know her, again I am confused. I have
clearly not violated my oath as an attorney nor any M.R.P.C. To be clear, I know that
I am a nearly [5] year practicing attorney, and the vehement fight I try to do for those
whom typically have no voice could be seen as nervy, but that isn't that what I swore
competent, diligent, professional, and loyal to my clients and in bringing the court
the laws that substantiates the facts regarding the case before the court. Clearly I
must be doing that because it would seem reasonable that the honorable judge Kent
RECORDS FROM THE LOWER COURT. Please check the record in the
that’s why the clerk sent over the estimated cost, and I paid for it, and it cleared the
bank, meaning that Becky Boyd cashed the check, unless she is now saying that she
embezzled the money. Please see exhibit B and C. The Clerk’s words not mine.

Please lets be fair and see this for what it truly is, the honorable judge Kent McDaniel
is continuing to slight the integrity of the judges seat in Mississippi, and the
Mississippi Bar. No longer can the Supreme Court can sit idle and allow that seat to
H. Next, judge McDaniel goes on a rampage regarding the honorable judge Gargiulo as
being a conflict. MY RESPONSE: I am not sure what the honorable judge means
by a “conflict,” but the filed record shows that I filed a motion of recusal for judge
Gargiulo. First, I represent clients of whom believed that motion was in there best
interest, second, I stated the reasons why in the motion and to other investigatory
agencies. I clearly stated that I then as do know believe that judge Gargiulo is more
than capable of presiding over that case but because of some circumstances my
plaintiffs believe that the motion should be made especially since an appeal is always
Mississippi Bar and Courts, or do I pick and choose even if such picking and
choosing could harm the very plaintiffs that I was engaged to work for. Of course
not, a plaintiff has a right to seek the motion and of course the judge has the right to
deny or grant it. The honorable judge denied the motion and the case is still active
today. Now, if such statement against my character or fitness is made to harm me,
then the record shows that judge Gargiulo never and to this date has filed a bar
complaint against me nor did he sanction me for doing my job. Instead, he responded

to the motion to recuse and the case proceeded as any other case, at least to my
knowledge. I did not see where the magistrate nor the District Court in that case has
in anyway retaliated against me for writing the motion to recuse, nor for the reasons
why. Therefore, the mere mentioning of this matter and that judges performance in
this dark situation is troubling. He did not deserve to be a part of this judges
retaliation work against this attorney all while refusing to present the court
I. The last sentence in that page 2 first paragraph is again where judge McDaniel states
that: “SHE HAS THE AUDACITY I HER FILING BEFOR JUDGE JORDAN

because I live in a big house , which I have no ideal where he gets the knowledge that
I resides in a big house, More importantly, surely the Bar and the Supreme Court
Justices see this dark talking about a small attorney as I as shameful. What
what does where I live have to do with my disrespecting the honorable judge Kent

feels about me what is important is that I am following the rules and just talking
about me does not prove the honorable judge Kent McDaniel’s complaint, instead, it

Kent McDaniel has now become my doctor, he said: “I believe a result of at least
judge knows, or should now that only an expert in that field can render a person’s
mental capacity, but here again, PROOF FROM JUDGE KENT MCDANIEL’S
human being and I have a family and friends whom will see this dark sided talk about
someone I have only met maybe [3]times in my life and that was during brief
motions hearings. At no time did I EVER provide judge Kent McDaniel with my
medical records. And for him to deduce that I am not a black freedom fighter, I am
mentally disturbed, and a host of the issues to follow this paragraph SHOULD BE
Supreme Court. This cannot be the normal for a judge especially THE
say for our state, for our people are we now in 2020 at a stage where the very
person’s committee’s that are inducted by the Mississippi Supreme Court to SHOW

INTEGRITY OF THE COURT, now allowed to disrespect the robe. No way,
seriously no way. What judge Kent McDaniel does not know at least until now, is
that I intend to make this record open to all the public especially for those whom
believe in the judicial system success as well as citizens whom has to vote for judges
to protect them and the Mississippi Constitution as well as the lifting up of our people
not the tearing them down just because you have the power, this must stops today. I
will take what the judge says about me mentally, educatedly as well as lawyerly but I
believe the Mississippi Supreme Court WILL NOT REWARD this behavior from
their judges and certainly not from the CHAIRPERSON OF THE JUDICIAL
COMMITTEE. I am sure the honorable judge Kent McDaniel’s and person with his
thoughts are laughing about the sad statements made in this bar complaint, but for
those of us whom care about the image of the judicial system, lawyers and the
makeup of our community, will will continue the fight even if it is simply
K. Then after the honorable judge Kent McDaniel state: “Adam, I BEG THE BAR
the honorable judge Kent McDaniel to literally put in a written bar complaint that I
am mentally ill, specific naming his diagnosis of what he thinks I am ill with, and
that I am not a freedom fighter when he has never walked in a black female shoes and
then say to this Bar Committee, “I BEG YOU, “ is troubling. Does the judge’s
begging the committee to harm a person whom has not violated any M.R.P.C. Rules

and has stated over and over that THERE IS AN OFFICIAL COURT
lawyer on behalf of the appellant, as well as properly designated through the Rankin
COURT. That is not the truth as shown above. If the Mississippi Supreme Court or
this Bar would force by order of the court, the records of those hearing to be made a
part of this record, the record will show that the honorable judge Kent McDaniel is
not telling the truth of the matter. Remember these records were order as far back as
JULY 8, 2020. Please see the attached docket sheet. They have been paid for and the
money cleared my expense account, and still judge McDaniel and Becky Boyd have
conspired to do wrong. So, Mr. Kilgore, even with a sitting judge saying he is
begging you, you have a duty of oath to seek the truth of the matter and the facts
and the facts shows that I have done no wrong and that if the judge feels he is
correct in attempting to hang my license and name out in such an ill way, then
surely this Mississippi Bar requires that infallible proof, proof beyond a reasonable

these awful accusation by a sitting County judge whom is simply angry that I filed
[2] different judiciary complaints against him, although he is the chairman of that
very board, which is why I filed with the Mississippi Supreme Court, the same
evidence 20-M-0995.
L. Then the honorable judge Kent McDaniel makes a profound statement that is: “I
HAVE TOLD YOU BEFORE AND TELL YOU AGAIN, and then the honorable
received a law degree from an accredited law school or passed a Bar examination.
Kilgore and he have spoken regarding me all while he knew I had written a complaint
against him and that the Mississippi Supreme Court is hopefully investigating his
failure to adhere to the mandatory Canon Rules. Whether he and Adam Kilgore
spoke about me or not, is a question for the Mississippi Bar Commission to consider.
I certainly am not claiming any prejudice since I am certain that I have never met nor
know Mr. Adams, only that he is general counsel for the Mississippi Bar. I am sure
that since judge Kent McDaniel is begging Mr. Adam to toss me out of practice even
though the facts and evidence does not support his allegations, judge McDaniel must
be very desperate to try to use the words “I beg you,” which to some looks like an a
request to ask Adam to create some sort of way to dispose of this attorney. So there
education and the blessing I posses as a barred attorney in such a ridiculed way is

shameful to the robe and the oath that the honorable judge Kent McDaniel’s hold. So
again out of sure respect for the judges whom are performing their oath as sworn,
there is no need for me to say anything further, the document speaks for itself.
Surely, the honorable judge Kent McDaniel’s could not be threaten by my asking the
court to please follow the law, even if you don’t like the messenger. Isn't that what
most litigation is about, the law, the facts and the appealability of a court’s ruling. Is
not that what our democracy says, isn't that what this very nation is founded upon,
does not the United States Constitution guarantee certain right, does not even the
state of Mississippi guarantee these rights, did not the Mississippi Bar itself make me
swear to litigant for my client even when someone else might not like the cases and
facts, then please tell me what do you or judge Kent McDaniel want or expect me to
do differently. I have done my job, and sought an appeal but even the APPEAL TO
THE MISSISSIPPI SUPREME COURT is being held hostage by this same judge.
Please check the current record in the Mississippi Supreme Court case NO.
2020-TS-1265 which is the case number regarding this appeal whereby Becky
Boyd, Rankin County Clerk refuses to provide the transcript and records for
appeal. So you see listener of this response, it is not me that judge Kent McDaniel is
hurting with his words and conduct, its the very ROBE that each Justice wears and
treated different than others, thats what has made me as strong as I am today. The
system must work, there must be a full recognition of the U.S. CONSTITUTION

INCLUDING THE 5TH, AND 14TH AMENDMENT. It cannot be compromised
for the sake of a sitting judge whom clearly is in violation of the Canon Rules, not to
M. Next, the honorable judge Kent McDaniel’s in his last paragraph on page two, states:
here not only is the honorable judge Kent McDaniel’s asking you to violate my
client’s right to have his attorney present during any questioning, especially since the
next sentence says, “if he is truthful,” (there is no period after that statement so one
can only imagine that the judge was continuing onto the next page, but he did not”,
but judge McDaniels is providing a precursor statement that if my client does not say
what the judge wants him to say, then he is lying. Thats enough said in this
paragraph regarding what the judge is asking you to do. There is a reminder thou,
why don’t judge McDaniel’s simply release the court transcript then everyone will
have the unadulterated truth of who said what. Surely the brilliant minds of all
involved know that there must be some wrongful conduct in those transcripts for the
honorable judge to refuse to send them to the Mississippi Supreme Court, yet alone to

Now that same criminal case is a CRIMINAL DRIVE BY SHOOTING where now
it appears that my client could not get a fair hearing before the court that judge
30 years, which as I told the prosecutor, why would he not take his chances in court
for the same amount of years. But that is not the problem here. The problem is why
is Rankin County Circuit judge Steve Ratliff(the presiding judge in this case) talking
with judge Kent McDaniel’s whom has absolutely no involvement with this case, at
least pursuant to the court records, about motions that have not been argued and are
expected to be argued November 23, 2020 before the honorable Steve Ratliff.
JUDGES, isn't there some rule that a judge must not preside over a matter of which
he cannot be impartial? Doesn't this sound like the honorable judge Steve Ratliff has
already made his mind up to deny this innocent person, whom has not been found
guilty, guilty. Doesn't it sound like judge Kent McDaniel is attempting to persuade
judge Steve Ratliff to harm my client because judge Kent McDaniel feels as he as

vividly stated concerning me in this bar complaint. SHOULD A JUDGE DISCUSS
without partiality. Mississippi Supreme Court, you must enter in and stop this
atrocity by the honorable judge Kent McDaniel’s. Mississippi Bar Committee, you
are better than to be influenced by a dark shadow that is trying to harm the very
integrity of oath that each you have taken to uphold in your respective positions.

such corruption just to protect the integrity of honesty in statements. Last, judges
should not be talking in any ill manner about lawyers just because one doesn't like
the lawyer. Surely Canon rules suggest different, otherwise how can a person have a
fair non prejudicial trial if the judges are crucifying the clients of a lawyer for
criminal matter before him with another angry judge, he should have recused himself
from the impression of choosing to follow the law and not the co-worker/friend. But
all I can do is tell my client of this matter and hope that there exist someone on the
Mississippi Supreme Court whom has great issues with this judge’s statements.
O. Judge Kent McDaniels states on page [3] first paragraph: I BELIEVE HE (MY
years I have fought for this client agasint what he has sworn under deposition,
affidavits and of course other pleadings that Dr. Michael Winkelman did to him. It
WAS NOT UNTIL I FILED [2] JUDICIAL COMPLAINTS, that judge Kent
McDaniel’s decided to file a bar complaint against me and the two judicial
complaints I filed against him that he started saying I was this mentally ill
uneducated and the rest found in his complaint. Although I understand that he
had to say something in his own defense, but to call me crazy, uneducated, inter alia,
is more than a stretch it’s wrong and untruthful, and unbecoming of a sitting judge in

Mississippi. Again, the official court records from the [2] days of hearing is what
tells who said what, but JUDGE KENT MCDANIEL REFUSES TO RELEASE
the MS Supreme Court does not desire to seek these transcript even in the name of
P. I ask the question, has anyone with the Mississippi Bar or the Mississippi Supreme
Court willing to do the work that they swore to and cause this matter to be fairly
resolved in the interest of justice? Then the transcript has every word I said as well
as the other parties but at this time the Mississippi Supreme Court nor the Mississippi
Bar has ordered the honorable judge Kent McDaniel to provide the same.
Q. Only Jesus knows why the honorable judge Kent McDaniels would even suggest, “ if
shame that this judge would even suggest my representing my client for nearly[3]
years in front of him, that somehow because my client filed an appeal of his final
order and conduct, that all of a sudden now I, the lawyer has committed subornation
LAWYER BUT LOST IN THIS CASE, I THANKED HIM AND FILED THE
APPEAL. Get the transcript, its there unless someone erased it, which is why he

refuse to turn over the transcripts. Additionally, I say again, that I was what I called
educated lynched on September 1, 2020 during what was called a damages hearing,
although I vehemently said on record, that there has not been an order stating that
there was a granting of damages, by the two opposing attorneys who went so far as to
make the records that I was commenting extortion from their client before the lawsuit
litigation(that is what I am suppose to do). But even more egregious was the fact that
judge Kent McDaniel ratified such wrongful litigation and made me sit through at
least an hour of this hanging, even when I time and again said judge please stop
(Again get the transcript there you will see me saying “your honor, may I please
object”) over and over again to no end. So for judge McDaniel to stop these
transcripts from the hearing of the Mississippi Supreme Court must be illegal and
obstruction of justice.
R. Last, Judge McDaniels last paragraph shows his desperation to intentionally continue
to harm me and my plaintiff when he clearly says: “By the time this was presented to

and the Mississippi Supreme Case No. 20-M-0995. The affidavits presented to the
court through out this matter over nearly [3] years are not signed by me, the case is or

me prior to my filing the judicial complaints and certainly not prior to my filing with
the Mississippi Supreme Court about his violation of the Canon Rules.
S. Finally, judge Kent McDaniel’s last paragraph as found on page [3] clearly shows
that the honorable judge Kent McDaniel’s is flat out angry with me for filing the
appeal for summary judgement and he even implies that he knows that plaintiff
would pursue the appeal to the Circuit and higher COURT[S], he even said he knows
his damages award will be appealed. Then the question is WHY DOESN’T HE
T. Instead, the honorable judge Kent McDaniel states as a last hope of desperation, “ On
the other hand, I believe the Opinion contains conclusions on ALL the information I
had at the time I signed it, and the Exhibits speak for themselves.
U. The question to any reasonable mind is why would the sitting judge in that matter
feel need to tell the Bar Committee that his written final opinion were concluded
based on all the information he had at the time of his signing it. Would not one
especially a lawyer of the case believe that the court is making his decision based on
what was before the court? So why would an explanation be made of the contrary
unless their can be proven otherwise, like the exhibits I submitted to the Mississippi

V. Now, Found below is the pleading filed with the Mississippi Supreme Court
September 8, 2020. The language is clear, that the honorable judge Kent McDaniel
violated the oath of the judiciary system as well as Canon Rules. The exhibits speaks
to that truth and more importantly I should be shown the benefit that the sworn court
transcripts are available but being deposed of by judge Kent McDaniel and that is a
investigation of which he is withholding relevant official court records that does not

calling me crazy, and have no medical records to support the same, scandalizing my
name that I am not a freedom fighter for black people, the poor, women and children
without disproving the same, and flat out mocking my education and

according to the law that I find that supports my clients claims. I am not trying to be
favored by any judge, so where I offend because of my grammar or the case law that

to follow the M.R.P.C. I have done that. I have not been rude to any judge, but I must
question in writing with motions or other pleadings if the judge’s opinion does not
seem to follow the law. If you do not want me to do that then tell me so that I can
stop telling clients what the Mississippi Court of Appeals and the Mississippi

RULES, as such, the proof as attached hereto shows that the honorable judge Kent
McDaniel’s is extremely angry with me for filing [2] judiciary complaints agasint
him and filing with the Mississippi Supreme Court showing that his conduct as a
siting judge and especially the chair of the watchdog that the Mississippi Supreme
Court enacted to prevent or stop bad conduct by judges. Judge McDaniel’s made up
allegations about and against me are troubling to any reasonable person and he
should be stopped immediately and not allowed to use this made up statements so
that the Mississippi Supreme Court will somehow blame me for judge McDaniels
bad behavior.

In the interest of justice and for the integrity of this Mississippi Judicial Court system,
Plaintiff and his attorney prays that this court will immediately cause this matter to be
ended, resolved reversed and rendered to another judge and jury that will be fair to the
holdings of the Mississippi Supreme Court Rules as amplified in writing in the Canon
