Subject: Clarifying the fence cannot get demand as standard at project –
Longxan

- With reference to the proposal in the meeting to clarify the 4 guilty in the warning
letter as:
1. Do not respect the signature of chairman of shareholder
2. Do not report to chairman of shareholder for acknowledgement
3. Do not follow up the progress of activities
4. Make decision over the power authority

I undersigned Mr. Xaylan Xaiyaxangly on behalf of the project committee responsible

for project – jobsite to clarify the 4 guilty for chairman of shareholder and ask for
guidelines with the appropriate manner as following:

1. Do not respect the signature of chairman of shareholder: Documents relate to model of

construction or MoU which has the signature of chairman of shareholder sent to any staff in
the project or sent to me? And sent by whom? I heard from Mr. Bounmy who is appointed to
follow up construction activities to inform that the contractor come to build up the fence, but
the bottom of the fence will use the blocks for 3 – 4 unit, there is no agreed document and I
am hurriedly to contact and report with chairman of shareholder and get the direction to
change to from block to cement to make the bottom and none to show model or document
which chairman of shareholder signed with APC and I would like to reconsider again for this
guilty.
2. Do not report to chairman of shareholder for acknowledgement: the activities at project –
Longxan have a lot which I am one of committees divide to each staff to be responsible by
referring to their skills. The construction activities is responsible by Mr. Bounmy and I have
specify him for daily report on construction activities to me or in Whatapp Group to every
member for acknowledgement, but Mr. Bounmy replied that Mr. Aekpasith, the assistant of
Chairman of shareholder let him directly report as written letter that can tell around 100 –
1000 items. I understand that if the document is delivered to the assistant of chairman of
shareholder. It should be reached to chairman, isn’t it? I would like to reconsider this guilty
again.
3. Do not follow up the progress of activities: owing to the fact that the assistant directly
contact to Mr. Bounmy and be the one to follow up the progress daily to the assistant of
chairman of shareholder without reporting to me (I do not understand why not contact with
the horizontal section of project for let me acknowledge and read the detail of report for daily
report). I have a lot of work and pay attention to other and one more thing when the
contractor come, none inform me, but inform the assistant of chairman of shareholder until it
has the problem at 4:15 in 17th September 2020. I work in Longxan about electricity by the
guideline of chairman of shareholder to contact with Electricity of District and Lao National
Development District to connect electricity and do not rely to Mr. Simphavong only. I do not
ignore and contact with many sections such as Mr. Somboun and Ms. May and Bounkhee to
stop, but they cannot because the report of Mr. Bounmy that workers say that Mr. Somboun
order to do which he has the model in hand and it should listen to him. For this guilty, I wouls
like to reconsider again.
4. Make decision over the power authority: when the construction complete around 80 –
90%, it cannot change and if we can to change we have to destroy all which Mr. Somboun
says it has the deadline and he explains as international standard which refer to the one who
design by the engineer and I also agree and if we change then I will get new guilty as change
the model. For this guilty I would like to reconsider again.

It would be proposed to group for any orders or report from group to project, if it is not the
top secret, let the ordered one must report to the project committees of the job site for
acknowledgment? When it has the problem then report again.

Therefore, it has been reported to chairman of shareholder of Phongsavanh Group Ltd and the
board members of Project for acknowledgment.
