Counter Affidavit

I, BERNABE JAN A. BAS, Filipino, of legal age, married to the

complainant JOZEL LACASTESANTOS-BAS, and a resident of
Governor Alvarez St., Zamboanga City, after having been duly sworn to in
accordance with the law do hereby depose and says:

1. That I am accused of the crime of Rape, now pending before the City
Prosecution Office of Zamboanga;

2. That all the accusations stated in paragraph six (6) of the complaint-
affidavit of Jozel Lacastesantos-Bas dated April 19, 2020 are strongly
denied. The truth of the matter are as follows:
a) That on the evening of January 15, 2020, my wife, Jozel, and I had
a candlelight dinner which my wife prepared for me in celebration of
my promotion at work. We only had a glass of wine after dinner. Part
of our conversation is to have another child to which she agreed. She
even said that we can do it after our dinner, so I took a shower. After I
came out from the bathroom, my wife approached me and held my
hand me apologizing for the miscarriage. I said, “Hinde kel dikaw
culpa. Pwede pa kita ase unu.” We both hugged each other, then
started kissing each other intimately. My wife removed her nightgown
 gently and we started having sexual intercourse without the use of
force, threat or intimidation.
b) That my wife, Jozel, expressly consented of having carnal
knowledge with me.
2. That I treated Jozel, as my wife, with outmost respect and dignity.

IN WITNESS WHEREOF, I hereby affix my signature this 27th of April

2020 in the City of Zamboanga, Philippines.
