UNDERTAKING

1. I warrant that the Customer is a duly registered corporation / partnership / sole proprietorship / individual, as the
case may be and as represented under this registration form and undertaking. I further warrant that the Authorized
Officers endorsing above is duly authorized to bind the Customer and to endorse requests for access to Asian
Terminals, Inc. (ATI) computer systems.
2. I acknowledge that ATI computer systems including but not limited to computer terminals, servers, Webtrack
system, and all data contained therein are solely owned by ATI. I agree to use ATI computer systems subject of
this form on behalf of the Customer only and not to abuse or use the same for any illegal, commercial, unethical or
personal use.
3. As the user of ATI computer systems, I agree to abide by the rules and regulations governing the proper use
thereof as advised by ATI from time to time. I understand the importance of maintaining the integrity and
confidentiality of ATI computer systems and therefore, I agree to undertake the necessary precautions in protecting
the integrity and confidentiality of data from unauthorized access, release to competitors, or any unauthorized
person, whether or not they would lead to loss, alteration and deletion.
4. I assume full responsibility for the activation of my ATI user account via any of the modes of contact stated above.
5. I assume full responsibility for all transactions using my account(s) through the use of my User ID and Password.
Any instruction through the use of my log-in shall be presumed done or authorized by me, and shall be deemed
correct, complete, irrevocable, and binding upon me, without need to verify the authenticity of such transactions.

6. I agree to keep my User ID and Password confidential and secure at all times. In the event of Customer’s request
for revocation of Authorized User’s access or if an Authorized User is separated from the Customer, or if I suspect
that my password and/or account is/are compromised, or if there is any incidence or suspicion of breach of
security, I will immediately report it by e-mail to ATI through any of its Marketing representatives.
7. The Customer agrees that ATI at all times has the right to review, suspend, and terminate my account on its
discretion, and the Customer shall indemnify and save ATI free and harmless from any and all liability arising from
ATI’s act pursuant to such right to suspend and terminate the Customer’s account.
8. The Customer and undersigned shall indemnify and save ATI free and harmless from any and all liability arising
from breach of any of the terms of this Undertaking, and from any loss / damage / liability in the course of
Customer’s or an Authorized User’s access or undersigned’s access to the ATI computer systems.
9. Violation of the Undertaking may cause permanent denial of the Customer’s access to the ATI computer system
and may serve as a ground for ATI to take appropriate legal action against the Customer and/or undersigned.
