Simao, are pleased to report that the ongoing litigation concerning the land that abuts Fischer Road has been finally and fully settled. ‘The County and Onondaga Development were equally committed to pursuing their rights and remedies at the trial of the matter now schedule to take place in April 2021. But they were also persuaded that a settlement made by the parties that fully resolved all of the outstanding issues not only eliminated further legal costs associated with the trial, but also the risk of a verdict imposed by a jury and inevitably an appeal by either party resulting in additional legal fees associated with that appeal ‘Through the purchase of some additional land adjacent to Fischer Road in the amount of $126,000 and a complete release of claims, the County assures itself that all issues related to this ten year old transaction are finally concluded, and Onondaga Development will be able to pursue immediately whatever development of its property itis informed to pursue under existing rules and procedures, without having its property entangled in ongoing legal proceedings. ‘The parties have agreed to put this matter behind them and this settlement allows them to do so.
