What is Law? It has been a herculean task to define law and the definition itself changes from time to
time and locality to locality. For our purposes, definition given by eminent jurist Austin holds good.
According to Austin,͟ Law is nothing but the command of the sovereign, which if not obeyed, is backed
by sanctions͟.

Sovereign above means state, which has power to administer the territory according to the rules and
regulations established by legislature. In present context, concept of sovereign is not limited only to a
police state but has evolved as of a welfare state. With policing, administrating and welfare activities in
control state has become supremely powerful and in crude language it has become modern age ͚Mai
Baap͛.

If we think about evolution of the concept of rule of law we come to the conclusion that men of
previous ages realized that arbitrariness in the justice delivery was the main cause of dissatisfaction
among people. Some of thinkers also defined this arbitrariness in a humorous way saying ͞All men are
equal, some are more equal͟. A present age law, which discriminates between its subjects, cannot exist.
When all men are created equal, they why they should be treated unequal in the eyes of law.

In present day India, we live in an environment where government has surpassed the role of welfare
state and politicians and administration are in a business to run almost a parallel economy. India is
among the countries with highest number of legislation. It can be validly said the even though our
politicians do not agree on anything, one thing they agree upon is passing a new legislation, every now
and then. Passing a new legislation or strictening an older one doesn͛t cost politicians a penny but it
opens new route earn more illegal money, basically supporting the parallel economy run by them.

If we compare present day administrations with one in older day͛s , it is apparent that in older days the
administration needed more of troops and manpower to govern its subjects. One prominent reason
behind that was that people were freer at that time. They realized that rules and regulations are made
by them for better system and they are not made for rules and regulations. Present day subjects are
trained to follow laws made by the administration since their earliest days. This takes away the basic
freedom of thought from modern day subjects. The only method in earlier days was to use more power
to govern people. In present era, one doesn͛t need more of troops, and that deficiency has been
overcome by more of legislation.

Strict rules and regulations are put in place by the administration, so that people obeying those rules
make a foul and this gives a corrupt administration a chance to earn through illegal means. Stricter the
regulations, more people making fouls or its becoming impossible for them to obey the rules, more
illegal money for corrupt administration. No wonder India is among the countries with highest number
of legislations.
÷nited States, being the leading democracy in the world, gave its citizens power to revolt against a
corrupt government through 2nd amendment to the constitution. The second amendment to the ÷S
constitution protects the right to bear arms. One of the primary purposes of the right to bear arms is for
deterring undemocratic government. People there have a right to revolt against the undemocratic
policies of the government.

Here in India, all the protest fall on deaf years. One cannot complaint against a corrupt official because
person who will act on such complaint is himself corrupt and will use the legislation to make illegal
money from the person complained. The domino effect of such illegal actions is very much visible on all
aspects of life in India. This effect has even ventured out of realms of administration and is not very
visible in private establishments as well.

In conclusion, the constitution established by the people of India is now a day͛s being used against those
same people who created it. The creation is being used by the wrong people to destroy the rights of the
creator.
