Public Hearings

1. A RESOLUTION TO AMEND THE FY 2021 ADOPTED BUDGET BASED ON A SECOND ALLOCATION OF CARES ACT FUNDING - A public hearing to consider a resolution to amend the FY 2021 Adopted Budget
based on a second allocation from the Coronavirus Aid, Relief, and Economic Security (CARES) Act, as allocated by the Commonwealth of Virginia to respond to COVID-19. Staff presented an update on CARES Act
funding at a work session on September 10, 2020. The Code of Virginia, § 15.2-2507, requires a public hearing when amendments to the budget exceed 1% of total expenditures, which for FY 2021 totals $3,490,114, and
presented requests for appropriation will exceed this amount (Paul S. McCulla, County Administrator, Sponsor; Erin M. Kozanecki, Deputy County Administrator; Mallory K. Stribling, Interim Director, OMB, Staff)
2. A PUBLIC HEARING TO CONSIDER A LEASE OF OFFICE SPACE AT THE WARRENTON-FAUQUIER AIRPORT - The Airport Enterprise Director negotiated a five year lease with one option to renew for five years with
Aviation Adventures, LLC for office space in the new terminal building at the Warrenton-Fauquier Airport. The office space is approximately 950 square feet. The monthly rent is $1,268.75. A copy of the proposed lease
agreement is attached. Virginia Code § 15.2-1800 requires that the Board conduct a public hearing prior to executing a lease. The attached resolution, if adopted by the Board, authorizes the County Administrator or his
designee to execute the proposed lease with Aviation Adventures, LLC and any future tenants who agree to a lease for this office space that is substantially similar to the proposed lease.

3. AN ORDINANCE TO ABANDON A PORTION OF FAIRFAX STREET IN THE VILLAGE OF PARIS THAT BISECTS A PARCEL OF PROPERTY OWNED BY THE PHILLIP SWING THOMAS TRUST - An ordinance to
vacate an old unused street that bisects a parcel of property owned by the Phillip Swing Thomas Trust (PIN 6035-70-9266-000). The street appears to be a remnant of what is now known as Republican Street. Indications
of the old road bed exist on aerial photographs but the street is not set out in County tax maps. This was initiated by the BOS in July to allow for required advertisement and posting in accordance with state code. (Mary

4. A ZONING ORDINANCE TEXT AMENDMENT TO SECTION 2-705.(3) TO AUTHORIZE A BOUNDARY LINE ADJUSTMENT BETWEEN A NON-COMMON OPEN SPACE PARCEL SUBJECT TO A PERMANENT
CONSERVATION EASEMENT AND AN ADJOINING PARCEL ALSO SUBJECT TO A PERMANENT CONSERVATION EASEMENT - The proposed amendment, if adopted, would permit a boundary line adjustment
between a non-common open space parcel which has been placed in a permanent conservation easement with the County, and an adjoining parcel subject to a conservation easement either with the County or with the
Virginia Outdoors Foundation. Such adjustments would only be permitted where neither parcel is able to be subdivided further. The Virginia Outdoors Foundation authorizes similar adjustments on a case-by-case basis
between properties which are both subject to permanent conservation easements. The Planning Commission unanimously recommended approval of the text amendment following a public hearing on August 20, 2020. (R.

5. AN ORDINANCE TO APPROVE REZONING PROFFER AMENDMENT REZN-20-012526 - CARTER'S CROSSING - AN APPLICATION TO AMEND PREVIOUSLY APPROVED PROFFERS (REZN-14-001168) TO
ALLOW A COMMUNITY CENTER USE (PIN 6969-46-7985-000, 6969-57-3762-000, 6969-57-7244-000, 6969-66-2693-000 AND 6969-57-1607-000, MARSHALL DISTRICT) - On November 13, 2014, the Board of
Supervisors approved REZN-14-001168, which rezoned the property currently known as Carter's Crossing (formerly known as Cannon Ridge) subject to proffers, a Code of Development (COD) and a Concept
Development Plan (CDP). The Proffer Statement (Proffer 2.a) permits the existing stone house, located on future Lot 177, to be occupied as a single-family detached residence or commercial offices. The Applicant would
now like to use the stone house as a community center/club house which requires an amendment to the Proffer Statement. The requested change does not affect density, nor does it require any changes to the project’s
Code of Development (COD) or Concept Development Plan (CDP). The properties are located south of West Main Street between Lunceford Lane and Frost Street in Marshall. On August 20, 2020, the Planning

6. AN ORDINANCE TO APPROVE REZONING AMENDMENT REZN-19-012270 - VINT HILL LOFTS - AN APPLICATION TO AMEND PORTIONS OF THE PREVIOUSLY APPROVED CONCEPT DEVELOPMENT PLAN
TO ALLOW FOR REHABILITATION OF THE EXISTING BARRACKS BUILDINGS INTO RESIDENTIAL DWELLING UNITS (PIN 7915-63-8665-000 AND 7915-63-2639-000, SCOTT DISTRICT) - The Applicants are
seeking to amend Vint Hill’s Concept Development Plan (CDP) to allow for the development of the Vint Hill Lofts. The request is to specifically allow the two existing barracks buildings, located in Land Bay V, to be
redeveloped into a maximum of 200 market-rate residential units. It should be mentioned that Multi-Family Residential uses in an existing building require Special Exception approval in the Planned Commercial Industrial
Development (PCID) District. As such, should this Rezoning Amendment be approved, the Applicants will need to seek Special Exception approval prior to proceeding with the Site Plan. The properties are located within
Vint Hill on approximately 10.9 acres of Land Bay V at 4221 Sigler Road and 4285 Bludau Drive, Warrenton. On August 20, 2020, the Planning Commission voted unanimously to recommend approval of the application.

7. AN ORDINANCE TO APPROVE THE 5TH RENEWAL OF THE ORLEAN/HUME AGRICULTURAL AND FORESTAL DISTRICT (AGFO-20-012491) - Each year, under the procedures established by the Code of Virginia,
the Fauquier County Board of Supervisors considers whether or not to renew existing Agricultural and Forestal Districts due to expire within the next year. In addition, each year, landowners may file by February 1st to
create a new Agricultural and Forestal District or to add or withdraw parcels to any existing Agricultural and Forestal District. In both cases, the Board considers all such applications. The Fauquier County Agricultural and
Forestal District Advisory Committee, as well as the Fauquier County Planning Commission, are charged under the Code of Virginia with providing advice to the Board relative to these decisions. On March 10, 2020, the
Agricultural and Forestal District Advisory Committee unanimously recommended renewal of the Orlean/Hume Agricultural and Forestal District. On August 20, 2020, the Planning Commission unanimously recommended

1st to create a new Agricultural and Forestal District or to add or withdraw parcels to any existing Agricultural and Forestal District. In both cases, the Board considers all such applications. The Fauquier County Agricultural
and Forestal District Advisory Committee, as well as the Fauquier County Planning Commission, are charged under the Code of Virginia with providing advice to the Board relative to these decisions. On March 10, 2020,
the Agricultural and Forestal District Advisory Committee unanimously recommended renewal of the Marshall/Warrenton Agricultural and Forestal District. On August 20, 2020, the Planning Commission unanimously

DISTRICT); AGFO-20-012500 - MORGAN PROPERTY (PIN 7839-72-6651-000 AND 7839-82-5522-000, CEDAR RUN DISTRICT) - Each year, under the procedures established by the Code of Virginia, the Fauquier
County Board of Supervisors considers whether to add parcels to any existing Agricultural and Forestal District. Landowners have until February 1st to file applications to join a district. The Board of Supervisors considers
all such applications. The Fauquier County Agricultural and Forestal District Advisory Committee, as well as the Fauquier County Planning Commission, are charged under the Code of Virginia with providing advice to the

Fauquier County Board of Supervisors considers whether to add parcels to any existing Agricultural and Forestal District. Landowners have until February 1st to file applications to join a district. The Board of Supervisors
considers all such applications. The Fauquier County Agricultural and Forestal District Advisory Committee, as well as the Fauquier County Planning Commission, are charged under the Code of Virginia with providing
advice to the Board relative to these decisions. The Shonk property is located near the intersection of Leeds Manor Road and Bears Den Road, Marshall. The Reitz property is located on Keyser Road, Hume. On March 10,
2020, the Agricultural and Forestal District Advisory Committee unanimously recommended approval of these additions. On August 20, 2020, the Planning Commission unanimously recommended approval of these

12. AN ORDINANCE TO APPROVE THE 24TH ADDITION TO THE MIDDLEBURG/MARSHALL AGRICULTURAL AND FORESTAL DISTRICT - AGFO-20-013290 (PIN 6091-74-1411-000, 6091-74-9264-000, 6091-85-
1363-000 AND 6080-07-4780-000, SCOTT DISTRICT) - Each year, under the procedures established by the Code of Virginia, the Fauquier County Board of Supervisors considers whether to add parcels to any existing
Agricultural and Forestal District. Landowners have until February 1st to file applications to join a district. The Board of Supervisors considers all such applications. The Fauquier County Agricultural and Forestal District
Advisory Committee, as well as the Fauquier County Planning Commission, are charged under the Code of Virginia with providing advice to the Board relative to these decisions. These parcels are currently part of The
Plains Agricultural and Forestal District, located at 5618 Rock Hill Mill Road, 3128 Halfway Road, 3124 Halfway Road and 3656 Zulla Road, The Plains.

In evaluating The Plains Agricultural and Forestal District renewal and ensuring the district's compliance with the Code of Virginia requirements, staff has proposed to move these four parcels from The Plains to the
Middleburg/Marshall Agricultural and Forestal District. On March 10, 2020, the Agricultural and Forestal District Advisory Committee unanimously recommended renewal of The Plains Agricultural and Forestal District,
which included these four parcels being renewed in The Plains and then renewed again in 2022 with the Middleburg/Marshall District. On August 20, 2020, the Planning Commission unanimously recommended approval of

13. AN ORDINANCE TO APPROVE THE 13TH ADDITION TO THE PLAINS AGRICULTURAL AND FORESTAL DISTRICT - AGFO-20-013573 (PIN 7907-89-5203-000, SCOTT DISTRICT) - Each year, under the procedures
established by the Code of Virginia, the Fauquier County Board of Supervisors considers whether to add parcels to any existing Agricultural and Forestal District. Landowners have until February 1st to file applications to
join a district. The Board of Supervisors considers all such applications. The Fauquier County Agricultural and Forestal District Advisory Committee, as well as the Fauquier County Planning Commission, are charged under
the Code of Virginia with providing advice to the Board relative to these decisions. This property is located off Beverleys Mill Road, Broad Run.

This request for addition was received after the March 10, 2020 Agricultural and Forestal District Advisory Committee meeting and after the advertising deadline for the August 20, 2020 Planning Commission meeting.
Therefore, this request for addition has not been heard by either committee and no recommendation has been made. Staff believes that the property is appropriate for inclusion in the requested Agricultural and Forestal
