MEMORANDUM CIRCULAR FOR ALL STORE/ESTABLISHMENT OWNERS & MANAGERS

1. The Barangay is loaded with cases in which majority is related to drunkenness, gambling and involves minors

2. In this regard, please be reminded of the city ordinances and resolutions with respect to stores and business
establishments

Ordinance 15-2000, - This ordinance bans the entry of students aged 12 years and below within the amusement
centers’ (specifically internet or computer shops) premises during school hours except when accompanied by
guardians. The ordinance also prohibits minors below 18 years of age and enrolled in school from entering the
center during school hours even if accompanied by his parent or guardian.

The amusement center (specifically internet or computer shops)shall be open for business only from 9:00am to
9:00pm everyday.

No amusement center (specifically internet or computer shops) shall be issued a license to operate unless proper
ventilation, cleanliness and sanitation are provided for; and

Gambling or other forms of betting shall strictly be prohibited

Any violation of the provisions of the immediately preceding section shall be considered an offense and upon
conviction thereof, shall be penalized with a fine of p1,000.00 for the first offense; P2,000.00 for the second
offense; and P5,000.00 and revocation of business permit for the third and succeeding offenses.

Administrative Order 114-2005 - Nightclubs, cocktail lounges, beer gardens, bars, duly accredited tourism-
oriented firms, bars, discopads and cabarets will be allowed only to operate only from 5 p.m. to 2 a.m. The same
order also set the business time for folk houses, restaurants, coffee shops and cocktail lounges from 3 p.m. to 12
a.m. and ordinary retail stores which serve liquor, whether it be for consumption within or outside the
establishment, from 9 a.m. to 9 p.m.

For establishments not mentioned in the order like videoke, billiards and computer centers, the mandated closing
time will be until 9 p.m. as provided in the Amusement Ordinance 15-2000.

Administrative Order No. 269, series of 2005 - This ordinance requires business establishments to secure
clearances from the city engineer’s office that their location is "beyond a distance of 50 or 100 linear meters as the
case may be from" government edifices, schools and churches.

Under this ordinance, restaurants dispensing liquors are not allowed to operate within 50 meters from such
places.

Article 4 of this ordinance also provided the distance restrictions for the location of the establishments such as 100
linear meters for nightclubs, day clubs, cabarets, dance halls, disco pads, beer gardens and cocktail lounges that
allow dancing and employ hostesses; and 50 meters for retail dealers of fermented liquor, retail liquor dealers,
liquor stores, ordinary beer gardens, bars and cocktail lounges without dancing and GROs.

Administrative Order No. 40 Series of 2007 - this Ordinance bans the issuance of new business permits to liquor
dispensing or amusement establishments within the identified prohibited zones within the city of Baguio. Thus the
following are identified as prohibited zones:

Retail Liquor/Ordinary bar (no music & no entertainment within 50 Linear


meters*
Bars, Disco, sing alongs, night clubs with music or video or band or entertainers within 200 Linear
meters*
Biliards within 50 linear
meters*
Computer and Video Centers with games within 1000 Linear meters*
* From schools or
churches

3. Any one caught in violation of these rules will force the Barangay Council to impose necessary fines and
penalties and recommend your business for closure.
