EXECUTIVE SUMMARY
Utah does not have a statewide law that prohibits employment discrimination based on sexual orientation
and gender identity. This report collects a broad range of information to examine the experiences of
lesbian, gay, bisexual and transgender Utahns in employment and housing, and to assess the likely impact
of passing a statewide nondiscrimination law. The information provided in this report reveals a strong need
for statewide employment and housing protections for gay and transgender Utahns, and a general
readiness among Utah citizens and employers to support such protections.

This report has five sections. The first section, Employment Discrimination Against LGBT Utahns, is a
document produced by the Williams Institute at the UCLA School of Law, which is an academic think tank
dedicated to the field of sexual orientation and gender identity law and public policy. This document
analyzes the data collected through a 2010 survey conducted by Equality Utah, which is the state’s first
survey on employment discrimination based on sexual orientation and gender identity. This survey shows
that employment discrimination on the basis of sexual orientation and gender identity is a pervasive and
persistent problem in Utah, as it is in other states. As the Williams Institute explains, the survey’s results
are consistent with information gathered from other sources, such as national surveys and reports from
state agencies. By reviewing the available data on the passage of statewide nondiscrimination laws in
other jurisdictions, the document shows that passing such a law in Utah would have a beneficial impact on
Utah employees and employers, without imposing any significant burdens or costs on the state’s
enforcement agencies.

The 2010 discrimination survey allowed respondents to supplement their responses with more detailed
written accounts of their experiences. While some of these stories are briefly quoted in the first section of
this report, the second section, Real Life Stories of LGBT Utahns, provides several concrete examples of
these stories in each respondent’s own words. These responses support the quantitative data and paint a
more complete picture of the problem of employment discrimination in the state. Respondents described a
broad range of discrimination in the workplace, such as being fired, denied promotions, paid less for the
same work, being asked to work longer hours, or being assigned less desirable shifts, on the basis of
sexual orientation and gender identity. Some respondents described incidents in which they had been the
victims of harassment and discrimination when a supervisor or co-worker discovered that they were
lesbian, gay, bisexual, or transgender from others, even though they had not discussed their sexual
orientation or gender identity at work.

The third section of this report, Workplace Protections are Good for Business, summarizes data compiled
by Equality Utah regarding Utah employers that have proactively implemented non-discrimination policies.
In preparing this section of the report, Equality Utah examined employer websites, previous studies
completed by national organizations, and our own informal survey of approximately 250 Utah employers in
11 counties via telephone and email to learn whether the employer’s nondiscrimination policy prohibits
discrimination based on sexual orientation and gender identity. Our findings suggest that many Utah
employers have adopted inclusive nondiscrimination policies, a common corporate practice in the United
States. At the same time, many other Utah employers have not yet adopted such policies, which shows
that there is still a need for statewide employment protections.

The fourth section of this report, Utah Census Snapshot, is another document produced by the Williams
Institute. Using data from the U.S. Census Bureau, the Census Snapshot provides demographic and
economic information about same-sex couples in Utah. As the Census Snapshot demonstrates, the more
than 3,800 same-sex couples living in Utah are similar to married couples. They live throughout the state,
are racially and ethnically diverse, have partners who depend upon one another financially, and actively
participate in Utah’s economy. The Census Snapshot shows that 30% of the same-sex couples in Utah are
raising children, but in the absence of nondiscrimination laws, these couples have fewer economic
resources to provide for their families than married parents.

The final section of this report, Growing American Support for LGBT Protections, provides information
about which states, counties, and cities across the United States have adopted laws and policies that
prohibit employment discrimination based on sexual orientation and gender identity. This section includes
a map compiled by the Human Rights Campaign of the states that have adopted statewide laws and
policies, as well as a summary of data compiled by Equality Utah that lists the counties and cities within
each state that have adopted similar laws and policies. As the Human Rights Campaign map shows, 21
states have laws that prohibit employers from discriminating based on sexual orientation, and 12 of these
states prohibit discrimination based on gender identity. In addition, 9 states have an executive order,
administrative order, or personnel regulation that prohibits discrimination against public employees based
on sexual orientation, and 6 of these states prohibit discrimination based on gender identity in such
policies. As the Equality Utah spreadsheet shows, more than 100 municipalities have passed similar
policies across the United States, including 10 cities and counties in Utah.

We collected 374 personal stories of discrimination that took place between 1978 and 2010. These stories
reveal Utahns being fired, bullied, harassed and evicted because of their sexual orientation or gender identity.

Many Utah businesses already provide workplace protections for gay and transgender employees, for the
same reason that many of America‘s most successful employers do: Protecting all employees is good for

MANY EMPLOYEES ARE STILL UNPROTECTED


Although many Utah employers have enacted policies to protect their gay and transgender employees,
many others have not. In an informal survey conducted by Equality Utah in 2010, approximately 35% of
employers indicated that they currently have such protections in place. Additionally, one in four Utahns
lives in a city or county that enacted workplace and housing protections in 2010.

While the protections offered by these ordinances and individual employer policies are promising, many
Utahns remain unprotected. What‘s more, gay and transgender Utahns face constant uncertainty about
whether protections will be available each time they change jobs or move within the state. Utah employers
must contend with similar uncertainty regarding their obligations when moving locations or opening new
offices in Utah. A statewide statute providing employment and housing protections for gay and transgender
Utahns would offer clarity and certainty to citizens and businesses.

Equality Utah Survey of Employers

Equality Utah conducted an informal survey of approximately 250 Utah employers in 11 counties via telephone and email to learn
whether the employer’s nondiscrimination policy prohibits discrimination based on sexual orientation and gender identity. To
provide a representative sample, counties were chosen based on population density and geographic diversity, and employers were
randomly selected from a statewide directory of businesses. The following table displays the survey results.

As this table shows, many Utah employers have adopted inclusive nondiscrimination policies, which places them in the mainstream
of corporate practice in the United States. At the same time, many other Utah employers have not yet adopted such policies, which
shows that there is still a need for statewide employment protections.
