SUMMARY
It is important to know the foreign laws before exporting so as not to affect the sale, the
information on the foreign law can be obtained from the client or distributor to whom it is
intended to sell the product, if the information provided to the exporter is not true, it can
pay a high price for having relied solely on customer advice.
You may be prohibited from importing the product or the client cannot resell the product
causing losses, the exporter can confirm the advice of its clients with third parties such as
Lawyers, Banks or Government Agencies to be sure of the understanding of foreign laws.
Standards can be identified even before manufacturing of the product to be sold for
export or modifying the product before shipment.
Products that do not comply with established directives are subject to seizure and
evaluation of fines. The manufacturer can perform its own conformity assessment and
declare compliance in most cases, on some products the manufacturer is required to
contract with a certified certification service company to conduct the conformity
assessment. The manufacturer must have a technical construction file to support this
statement.
Customs and foreign laws in export destination countries may have quotas on the amount
of products they can import, products that exceed the quota cannot be exported. Having
established the amount of customs duties that were evaluated on the product for a
correct tariff classification for the product, to determine if the tariff rate will be so high
and thus assess whether sales of the product are successful in the destination country,
confirming that no countervailing anti-dumping or other customs duties are imposed.
When there is doubt about the tariff classification, you can request an administrative
resolution from the foreign customs agency, this will take time, which is why the seller and
buyer must adjust production and delivery plans.
Government Procurement Sales to foreign governments, government agencies, or
partially government-owned private businesses often involve specialized procedures and
documentation. Public tenders and compliance with invitations to tender and acquisition
regulations, and the provision of tender bonds, performance bonds, guarantees, among
others.
The purpose of laws and foreign government agencies is often to enact regulations that
are designed to give preferential treatment to products supplied by manufacturers.
