COMPLAINT

Plaintiffs, STI Holdings, Inc. (“STI”), Stoughton Trailer, LLC (“STL”) and Stoughton Parts

Sales, LLC (“SPS”) (collectively “Stoughton Trailers”) for their complaint against Defendant,

Hyundai Translead, Inc. (“Hyundai”), states as follows:

NATURE OF ACTION

1. This is an action for infringement of U.S. Patent Nos. D790,407 (“the ‘407 Patent”),

D864,038 (“the ‘038 Patent”), and D889,320 (“the ‘320 Patent”) (collectively “the Stoughton Trailers

Patents”), all entitled “Trailer Rear Impact Guard,” pursuant to the U.S. Patent Act, 35 USC § 101,

et. seq., arising out of Hyundai’s using, selling, having sold, offering to sell, making, having made,

and/or importing or having imported into the United States, certain infringing trailer rear impact

guards.

PARTIES

2. Plaintiff, STI Holdings, Inc., is a corporation organized and existing under the laws

of the State of Wisconsin, and has a principal place of business at 416 S. Academy St. Stoughton,

Wisconsin 53589.

3. Plaintiff, Stoughton Trailers, LLC, is a limited liability company organized and

existing under the laws of the State of Wisconsin, and has a principal place of business at 416 S.

Academy St. Stoughton, Wisconsin 53589.

4. Stoughton Parts Sales, LLC, is a limited liability company organized and existing

under the laws of the State of Wisconsin, and has a principal place of business at 416 S. Academy St.

Stoughton, Wisconsin 53589.

5. Defendant, Hyundai, is a corporation organized and existing under the laws of the State

of California, and has a principal place of business at 8880 Rio San Diego Drive Suite 600

San Diego, California 92108.

JURISDICTION AND VENUE

6. This Court has jurisdiction over this matter pursuant 28 U.S.C. §§1331 and 1338(a),

in that this matter arises under an Act of Congress relating to patents.

7. This Court has personal jurisdiction over Hyundai because Hyundai has a place of

business located within this District at 545 E South Frontage Road Bolingbrook, Illinois 60440, has

committed the acts infringement complained of herein in this District, including infringement of the

Stoughton Trailers Patents, and transacts business within this District.

8. Venue is proper in this district pursuant to 28 U.S.C. §§1391 and 1400, in that

Hyundai (a) has regular and established places of business within this district, and (b) engaged in one

or more acts complained of herein within this district, including, inter alia, infringement within this

district by selling and/or offering to sell products that directly, or contributorily infringe or induce

others to infringe, the Stoughton Trailers Patents.

THE STOUGHTON TRAILERS PATENTS

9. Stoughton Trailers is one of the largest trailer manufacturers of high-quality trailers,

including dry van trailers, and other equipment in North America.

10. Stoughton Trailers sells and offers for sale trailer rear impact guards, including the

FMVSS 223 and FMVSS 224 trailer rear impact guards shown below.

11. Stoughton Trailers’ rear impact guards became standard equipment on all of

Stoughton Trailers dry vans beginning in November of 2016.

12. Stoughton Trailers’ rear impact guard design impressed the industry and received

substantial praise, including earning Heavy Duty Trucking Magazine’s Top 20 Award for 2017.

13. The ‘407 Patent entitled “Trailer Rear Impact Guard,” was duly and legally issued on

June 27, 2017 and names Daniel Patrick Miller and Francis Steven Smidler as the inventors. Attached

as Exhibit A is a true and correct copy of the ‘407 patent. The ‘407 claims the ornamental design for

a trailer rear impact guard. STI is the sole and exclusive owner of ‘407 patent.

14. The following trailer rear impact guard designs are claimed in the ‘407 Patent:

15. The ‘038 Patent, entitled “Trailer Rear Impact Guard,” was duly and legally issued

on October 22, 2019 and names Daniel Patrick Miller and Francis Steven Smidler as the inventors.

Attached as Exhibit B is a true and correct copy of the ‘038 Patent. The ‘038 claims the ornamental

design for a trailer rear impact guard. STI is the sole and exclusive owner of the ‘038 Patent.

16. The following trailer rear impact guard designs are claimed in the ‘038 Patent:

17. The ‘320 Patent, entitled “Trailer Rear Impact Guard,” was duly and legally issued

on July 7, 2020 and names Daniel Patrick Miller and Francis Steven Smidler as the inventors.

Attached as Exhibit C is a true and correct copy of the ‘320 Patent. The ‘320 claims the ornamental

design for a trailer rear impact guard. STI is the sole and exclusive owner of ‘320 Patent.

18. The following trailer rear impact guard design is claimed in the ‘320 Patent:

19. STL is the exclusive licensee of the Stoughton Trailers Patents.

20. Through STL, SPS is the exclusive sublicensee of Stoughton Trailers Patents for the

aftermarket part sales field of use, including aftermarket sales of trailer rear impact guards.

HYUNDAI’S ACCUSED PRODUCTS

21. Hyundai manufacturers, has manufactured, sells, offers for sale, and/or imports or

has imported into the United States, trailers, including, but not limited to its “Hyundai Original”,

“Hy-Cube”, “Composite”, and “Composite XT” with rear impact guards (collectively “Accused

Products”).

22. The Accused Products incorporate the rear impact guard shown below:

23. Hyundai advertises the Accused Products and other products on its website, which is

available to and targets purchasers, customers, and end-users, within this District and elsewhere, sells

the Accused Products through dealers, including dealers located in this District.

24. An ordinary observer or purchaser would find the overall design of ‘407 patent and

Accused Products substantially similar and would be deceived into purchasing the Accused Product

believing it to be the claimed design.

25. Below is a side-by-side comparison of Figure 2 of the ‘407 patent and an Accused

Product.

Accused Products substantially similar and would be deceived into purchasing the Accused Product

believing it to be the claimed design.

Accused Products substantially similar and would be deceived into purchasing the Accused Product

believing it to be the claimed design.

30. Stoughton Trailers notified Hyundai of its infringement of the ‘407 and ‘038 Patent

by letter dated October 25, 2019.

31. Upon information and belief, Hyundai was aware of the ’407 patent before Stoughton

Trailers notified Hyundai of infringement on October 25, 2019.

32. Upon information and belief, Hyundai was aware of the ‘038 patent before Stoughton

Trailers notified Hyundai of infringement on October 25, 2019.

33. Hyundai is aware that its manufacture, use, offer for sale, sale, and/or importing the

Accused Products, and inducement of others to use, sell, offer for sale, sell and/or import the

Accused Products, infringe the ‘407 Patent, the ‘038 Patent and ‘320 Patent, at least through the

notice of infringement provided by Stoughton Trailers to Hyundai on October 25, 2019 and the filing

of this Complaint.

COUNT I
(Infringement of ‘407 Patent)

34. Stoughton Trailers restates and realleges the allegations in the above paragraphs, as if

fully set forth herein.

35. Without permission or license from Stoughton Trailers, Hyundai uses, manufactures,

has manufactured, sells, offers for sale, and/or imports or has imported into the United States, within

this judicial district and elsewhere, Accused Products that directly infringe, contributorily infringe,

and/or induce others to infringe, the claim of the ‘407 patent, in violation of 35 U.S.C. § 271.

36. Hyundai’s infringement has been, and continues to be, willful.

37. Hyundai’s infringement of the ‘407 patent has caused, and continues to cause,

irreparable injury to Stoughton Trailers, and unless and until Hyundai’s infringement of the ‘407

patent is enjoined by this Court, Stoughton Trailers will continue to suffer irreparable injury because

of Hyundai’s infringement. Stoughton Trailers has no adequate remedy at law.

COUNT II
(Infringement of ‘038 Patent)

38. Stoughton Trailers restates and realleges the allegations in the above paragraphs, as if

fully set forth herein.

39. Without permission or license from Stoughton Trailers, Hyundai uses, manufactures,

has manufactured, sells, offers for sale, and/or imports or has imported into the United States, within

this judicial district and elsewhere, Accused Products that directly infringe, contributorily infringe,

and/or induce others to infringe, the claim of the ‘038 patent, in violation of 35 U.S.C. § 271.

40. Hyundai’s infringement has been, and continues to be, willful.

41. Hyundai’s infringement of the ‘038 patent has caused, and continues to cause,

irreparable injury to Stoughton Trailers, and unless and until Hyundai’s infringement of the ‘038

patent is enjoined by this Court, Stoughton Trailers will continue to suffer irreparable injury because

of Hyundai’s infringement. Stoughton Trailers has no adequate remedy at law.

COUNT III
(Infringement of the ‘320 Patent)

42. Stoughton Trailers restates and realleges the allegations in the above paragraphs, as if

fully set forth herein.

43. Without permission or license from Stoughton Trailers, Hyundai uses, manufactures,

has manufactured, sells, offers for sale, and/or imports or has imported into the United States, within

this judicial district and elsewhere, Accused Products that directly infringe, contributorily infringe,

and/or induce others to infringe, the claim of the ‘320 Patent, in violation of 35 U.S.C. § 271.

44. Hyundai’s infringement of the ’320 patent has caused, and continues to cause,

irreparable injury to Stoughton Trailers, and unless and until Hyundai’s infringement of the ‘038

patent is enjoined by this Court, Stoughton Trailers will continue to suffer irreparable injury because

of Hyundai’s infringement. Stoughton Trailers has no adequate remedy at law.

PRAYER FOR RELIEF

WHEREFORE, Stoughton Trailers prays for an order and judgment in its favor and against

Hyundai as follows:

a. preliminarily and permanently enjoining Hyundai, and its parents, subsidiaries,

affiliates, officers, directors, agents, employees, successors, assigns, and attorneys, and

any and all persons in active concert or participation with any of them, from using,

making, causing to be made, selling, offering to sell, causing to be sold, and/or

importing or causing to be imported into the United States, any products that directly

infringe, contributorily infringe, or induce others to infringe, the claims of the

Stoughton Trailers Patents;

b. ordering Hyundai to pay to Stoughton Trailers the damages that Stoughton Trailers

has incurred as a result of the acts complained of herein, including, but not limited to,

an award to Stoughton Trailers of Stoughton Trailers’ lost profits and/or Hyundai’s

total profits, pursuant to 35 U.S.C. §§ 284 and 289;

c. a finding that Hyundai’s actions and infringement has been willful, and that any

damages award be trebled, pursuant to 35 U.S.C. § 284;

d. ordering Hyundai to pay to Stoughton Trailers its costs and expenses of this action,

and its attorneys' fees, pursuant to 35 U.S.C. § 285, as a result of the acts complained

of herein; and

e. awarding Stoughton Trailers any other relief that this Court deems just and fair.
