Citizenship" is a part of the entry number 17 in list-I (Union List) under the Seventh Schedule of
the Constitution and under Article 246(1) read with Article 11 of the Constitution of India, the
Parliament has the authoritative ability to outline citizenship laws for the nation. Drafting Article
5 of our constitution, Dr. B.R. Ambedkar explicitly quoted:

“this Article refers to, citizenship not in any general sense but to citizenship on the date of
commencement of this Constitution. It is not the object of this particular Article to lay down a
permanent law of citizenship for the country. The business of laying down permanent law of
citizenship has been left to the Parliament, and as members will see from the wording of Article
6 (present day Article 11) as I have moved, the entire matter regarding citizenship has been left
to Parliament to determine by any law it may deem fit.”

During the course of history, every government tabled the issue of citizenship in the parliament
but never came to any conclusion. None of the government took any measure to acknowledge the
problem of the persecution of the minorities in the neighboring countries. The simple example of
this is the Assam Accord. The INC introduced NRC in Assam, after seeing a huge protest, but
when it came to implementation, they ignored the issue. BJP is the only party which took this
issue seriously and made amendments in the citizenship act for the benefit of the people.

CAA is a particular amendment which tries to handle a particular issue predominant in the
predefined nations for example persecution on the ground of religion considering the
undisputable religious protected situation in the predetermined nations, the orderly working of
such States and the view of dread that might be pervasive among minorities according to the de
facto circumstance in the said nations. The Parliament, subsequent to taking comprehension of
the said issues through the span of the previous seven decades and having thought about the
recognized class of minorities in three explicit nations, has ordered the current amendment. CAA
doesn't try to perceive or try to provide answers to all or any sort of indicated persecution that
might be occurring over the world or that may have occurred beforehand anyplace on the planet.
Indeed, it is a barely custom fitted enactment trying to address the particular issue which
anticipated India's consideration for an answer since a very long while as explained in our
history.
Coming straightforward to the issue, CAA attracted criticism ever since it tabled in the lower
house of the Parliament. The illiterate critics questioned the constitutionality of the act.
Moreover, they added that it is a discriminatory act, which is against the principle of federalism
and secularism. Soon the criticism turned out in a protest, which converted into a violent protest.
The cost of this protest touched the lives of many people. BJP tackled the protest lawfully but
this was too criticized.

The existing regime for obtaining citizenship of India by foreigners of any country is untouched
by the CAA and remains the same. Legal migration, on the basis of valid documents and visa,
continues to be permissible from all countries of the world including from the three specified
countries. All these laws are untouched by the parliament and the only amendment is that it
accelerated the process of granting citizenship to a certain group of people.

BJP and Republic of India are two different bodies, operating on the principle of democratic
socialism. It will work for the betterment of the people and the betterment of the nation. There is
no place of arbitrariness or unconstitutional laws in the world’s largest democratic places like
India. All these propagandas and criticism are intentionally provoked by some peoples to hurt the
sentiments of the country.
