Work-plan to provide Specific Services

Project Title:
Legal Empowerment on:
1. Clinical legal aid to clients affected by violation of their fundamental rights
by executive, especially on matters concerned with criminal justice
2. Public awareness and legal literacy campaigns

Background:

Women empowerment is one of the key aspects of development. It is essential for

sustainable development of Pakistan that women should be on-board and they must enjoy
the same opportunities, outcomes and rights in all spheres of life; as men Therefore,
investment in the legal empowerment of women is the fundamental element in improving
the economic, political and social conditions of the Pakistani women, particularly the ones
in Southern Punjab; which has been highlighted by various researches as one of the most
vulnerable areas with regards to women rights due to the prevalent feudal system. In our
targeted areas women are quite often denied their right to education which has
5
consequently led to a lack of awareness about their legal rights and has relegated them to
the status of a subjugated class. Taking this under consideration, it is vital that women
should be organized and strengthened at the grass root level to end their subordination
through legal remedies. Furthermore, as several past researches have also indicated that
lack of awareness about laws specifically against unfair cultural practices, has played a
pivotal role in the vulnerability of women. Hence, legal empowerment of women in this
regards is quite necessary which will only occur if women are made aware about their rights
and the legal procedures pertaining to them in cases of denial, because laws on paper are of
no use until the suppressed group learns how to exercise them. This aspect of female
empowerment will be profoundly addressed by this project as it not only aims at creating
awareness but also at training of common women to provide legal expertise to others. Legal
literacy promotes women's capacities to understand and criticize the law and the scope of
rights, to assert rights as a political resource, and to take action to change limiting
definitions of gender roles, status and rights in the law and daily practice. According to a
recent research survey, Afghanistan, Congo and Pakistan are the world’s most dangerous
countries for women due to a barrage of threats ranging from violence and rape to dismal
health care and “honour Killings”. More than 1,000 women and girls are victims of “honour
killings” every year, according to Pakistan’s Human Rights Commission. Women in South
Punjab are confronted with numerous complex issues with very limited access to justice at
apex. Women remain deprived of their rights including the right to immediate justice. In
tribal society of our targeted area, with dominant tribal and religious influences, women’s
protection and access to justice as per women specific laws and international commitments
seems to be dream as there is less buying of these mechanisms in the panchayat ruling. The
traditional mechanisms of conflict resolution i.e. panchayat ruling, is thought and adapted
as more appropriate and accessible for seeking justice. However, the sensitivity towards
women’s rights/specific needs and women’s participation as mediator and/or decision
maker in these traditional mechanisms remains a key lacking that makes the sanctity of
justice through these mechanisms visibly questionable with regards to the gender sensitive
and women-centered judgments.

Factors contributing to the aforementioned problems of women in these areas include

delayed justice through judicial setup and lack of women as lawyers (the facilitator for
justice) in the judicial system. In these areas, women do not practice law as profession;
women quite often don’t exist as lawyers in the judicial system due to cultural limitations.
Therefore, their absence prevents justice-seeking women to contact judicial system as they
are not allowed to interact with males due to rigid social and tribal cultural norms. Thus the
only option for justice remains is the conventional traditional alternate mechanisms. On the
other hand, women’s mobility to courts is also not thought appropriate esp. in the rural
setup, which makes it more difficult for a common woman to approach judiciary to seek
justice.
6
Women who join the Law as profession leave it due to various hardships including financial
constraints and no support for profession development. Due to the same reason, number of
women as lawyers in comparison with men remains very low, despite the fact that every
year a reasonable number of females pass out from Law Colleges. But due to a non-
conducive environment in the courts and chambers, they refrain from joining the
profession.

On the other hand, the women protection mechanisms are not sufficient in the area. There
is no proper setup for women legal aid, it has only a few Dar-ul-Aman(s) and 0 Reporting
Centers. Moreover, these mechanisms also lack capacities to meet the needs of women
protection in their local contexts.

Aforementioned mentioned facts reveal that there is a dire need to improve the
participation of female in the law facilitating institutes. The primary reasons for this dismal
picture can be attributed to the following factors;

• vulnerable and non-conducive environment for females to work in law facilitation

institutes,
• Insufficient knowledge about job opportunities,
• Rigid cultural norms which are against the ideas of women acquiring jobs especially
in the legal institutions,
• Lack of skills which can equip students into a better candidate for a job
• Lack of entry opportunities into the job market

Investment in women empowerment is the key element for improving the economic,
political and social conditions of Pakistan. Working environment for females can be
improved by adopting a strategy which can shift the situation in favor of females.

In addition, the presence of feudalism also depicts the indication of human trafficking in
these targeted areas, and awareness of new laws related to Human Trafficking is necessary
to be spread.

With the stated background, CHRS has designed a project to facilitate the young women
lawyers to participate in judicial system through capacity building and internship
opportunities at Law Firms.
