Answer any four questions. Question contains marks as shown against each.

1. It has been observed that one employer declared not to pay the bonus for ensuing EID-ul-Fitr
due to financial constraint during COVID-19 Pandemic. Hearing such a decision CBA leaders
declared a strike in the factory. Whether CBA Leaders can call such a strike and what should be
the procedure to maintain to go for strike as per BLA. 10.

a. One of the lady workers did not inform the management about her delivery of a child.
But just after passing 2 months 11 days she informed the management that she
delivered a child and submitted all related proof in this respect. She has been working
for last 4 yrs in the company but her nature of job was temporary in nature. On
receiving her application, management denied to pay her any maternity benefit and
leave stating that as per provision of BLA you are not entitled to any benefit. What
would be opinion in this case as per provision of BLA. Please give your reply showing
specific reference of BLA. Marks - 05.

b. Suppose the present leave balance of a worker has reached 35 days. Then the worker
applied for 15 days leave to avail from his credit balance but management could not
grant him leave due to service exigency. In that case how would you calculate his
maximum limit for accumulation of leave as per BLA. Please give your reply showing
specific section of BLA. Marks – 05

3. Ms. Monira Akter works in Modhumoti Fashion Ltd. She joined on November 01, 2019 as Swing
Operator. Her monthly gross salary is Tk.15,000/-. The rate of her bonus is equivalent to 50% of
her gross salary. She is entitled for one weekly holiday. Besides this she has availed Govt.
Holidays on account of Victory Day, Christmas Day and International Mother Language Day. She
got Over Time Allowance Tk.336/- in November, 2019, Tk.754/- in December, 2019, Tk.1,180/- in
January, 2020 and Tk.584/- in February, 2020. She was fined Tk.50/- for breaking a wheel in
January, 2020. On February 28, 2020, she applied that she wants to go on maternity leave from
March 01, 2020 and her expected date of delivery is May 01, 2020. Please calculate her
maternity benefit for the first eight weeks (56 days). Marks – 10.

a. Labour Law is playing vital role to safeguard the interest of the employers and workers. As a
HR professional do you believe this statement. Please justify your reply quoting some
examples from BLA in support of your reply. Marks – 06

b. What are the provisions for overtime in a factory? Whether a worker can refuse to do
overtime work? If refused can the employer take action against him? Please give your reply
as per provision BLA.- Marks – 04

5.
a. Razia is one of your workers. Her Gross Salary is Tk.17,000/- per month and her Basic salary
is Tk.8000/- per month. In the month of February she performed extra duty for 88 hrs.
Please calculate her O.T allowance as per BLA-2006 and BLR-2015. Marks -4

b. What is your understanding about the Trade Union. What is the objective of trade union in
the organization. Do you think that Trade Union is found playing vital role to maintain
harmonious relationship between employees and employers in our country. What is the
Minimum percentage of total workers would be required to form a Trade Union in the
organization. Whether management can terminate any worker when registration of the
Trade Union is pending in the Labour Directorate. Please explain showing the relevant
clause of the BLA-2006. – 06
6.
a. What are the contributions of the participation committee in the factory. Whether the
employer is bound to implement the recommendation of the participation committee as per
BLA. Is there is any difference between trade union and participation committee. Marks - 05

b. A worker took seven days leave and went home at Rangpur. By this time a
blockade declared by the opposition political party all over the country resulted in a
stoppage of transport vehicles. So, he could not resume work just after expiry of leave. After
twenty days he came to the office and desired to join his work. Whether the employer
should allow him to resume duties or what other action may be taken against him? Whether
the worker can claim wages for the period of his absence? Marks - 05
