MINUTES OF EXECUTIVE SESSION

CITY COUNCIL MEETING


Tuesday, January 3, 2017
7:00 P.M. TO 7:21 P.M.

Mayor Morley called the Executive Session to order at 7:00 p.m. for the purpose of discussing:
Pending/Probable Litigation pursuant to the Open Meetings Act 5 ILCS 120/2 (c)(11).

Present: Norman Leader, Bob Dunn (arrived at 7:04 p.m.), Noel Talluto, Chris Healy, Scott Levin, Jim
Kennedy, Patrick Wagner, Mark A. Mulliner, Mark Sabatino

Absent: Michael J. Bram, Dannee Polomsky, Kevin L. York, Michael Honquest, Marti Deuter

Also in attendance: City Treasurer Libovicz, City Attorney Storino, City Attorney Acker, City Manager
Grabowski, Assistant City Manager Kopp

Alderman Kennedy moved to convene into Executive Session for the purpose of discussing
Pending/Probable Litigation pursuant to the Open Meetings Act 5 ILCS 120/2 (c)(11) Alderman Healy
seconded.

Ayes: Leader, Talluto, Healy, Levin, Kennedy, Wagner, Mulliner, Sabatino

Nays: None
Results: 8 ayes, 0 nays, 6 absent
Motion duly carried

Pending/Probable Litigation pursuant to the Open Meetings Act 5 ILCS 120/2 (c)(11)

City Attorney Acker reviewed the slip and fall case that took place at the museum in 2013. He stated
the fall happened when the museum was closed and the injury was to head, neck and shoulder,
medical $70,000 and special damages medical $130,000. He stated the excess carrier was notified.
The injured person is asking for $650,000. City Attorney Acker recommended for the City to authorize
settlement discussion for an amount less than the demand and to contact the excess carrier to
surrender the remaining amount under the $250,000 stop loss with our excess carrier.

Discussion ensued.

Consensus was to follow the City Attorney recommendation and contact the excess carrier to settle the
case.

Purchase of Real Property

City Manager Grabowski announced the City closed on December 28, 2016 on the Messiah Lutheran
property. He stated it will go through the subdivision process, through Zoning & Planning Commission
and to the Council for approval.

City Manager Grabowski stated the acquisition of the Bryan site from School District 205 does not
seem very realistic.

Alderman Kennedy asked for an update on the church’s property next to Jackson School.

City Manager Grabowski stated an appraisal has been completed. Mr. Van Slyke reviewed the
appraisal of $1.2 - $1.3 million. City Manager Grabowski stated the church’s verbal offer was $2
million.

Alderman Healy asked if the church building would be acquired. City Manager Grabowski replied only
the green area and parsonage/residence to the north.

Alderman Healy moved to adjourn Executive Session. Alderman Levin seconded. Voice vote. Motion
carried. Executive Session adjourned at 7:21 p.m.
