Safety Commitment and Experience

The business is responsible for the development, implementation, and performance of its safety
and compliance program. All persons employed by the business shall be qualified according to
applicable federal, state and municipal safety standards, and FedEx Ground Safe Driving
Standards found in the Agreement, and shall be fully trained, at the business’s expense, to operate
its vehicle equipment.

safety and compliance program, its training program, its investment in safety technologies, and
its plan to invest in any additional safety technologies.

Customer Service Approach

The business will need to meet the expectations and demands of customers, which include both
shippers and recipients (“customers”), by providing superior customer service and maintaining
favorable brand identity. The business retains exclusive authority to determine the best means to
meet such customer expectations and demands, including complete discretion over and
responsibility for delivery work area configuration, route design, delivery sequence, type and
number of equipment, and staffing and personnel decisions.
The contracted services will be provided on the Service Days established for the FedEx Ground
operations, which have been set in response to the demands of Customers. The service days are
defined in the respective agreements and support a seven day a week operation, excluding select
holidays, and FedEx Ground may modify the Service Days, and the Excluded Days, in response to
Customer or competitive demands.
1. Explain how the business plans to ensure service for this specific geographic opportunity year-
round, specifically addressing the business’s plan to maintain service continuity and meet the
expectations and demands of customers, including peak service demands and increased
package and stop volumes.      
2. What contingency plans would the business have in place to ensure that it will continue to
provide the contracted-for service in the event of vehicle breakdowns, driver shortage,
increased package volume, weather, or other extenuating or changing circumstances?      

Resources and Capacity

The business has sole and complete discretion in the staffing, selection, hiring, training,
supervision, assignment, hours and days worked, discipline, termination, compensation, benefits,
and all other terms and conditions of employment of its personnel assigned to provide Services
under an Agreement. The business will need to agree to assign only personnel to provide services
that meet the requirements of federal law, including those maintained by the Department of
Transportation and that meet the driving standards in the Agreement.
The business will identify an authorized officer to communicate with FedEx Ground on the
business’s behalf to make binding decisions to the terms of an Agreement. The business will also
identify from its personnel a business contact for purposes of administering day-to-day operations
under an Agreement, including business results and decisions related to personnel.
