EXECUTIVE ORDER NW-I0 OF COUNTY JUDGE NELSON W. WOLFF
ISSUED June 17,2020
WHEREAS, pursuant to Texas Govenment Code Section 418.108, Bexar County Jade
[Nelson W. Wolff declared a state of loal disaster on March 13, 2020 due to imminent threat
arising from COVID-19;
WHEREAS, in accordance with Texas Goverment Code Sesion 418.108(0), on March
18, 2020, the Bexar County Commissioners Court approved an Order Continuing Declaration of
State of Local Disaster for Bexar County and on June 16,2020, the Bexar County Commissioners
Cour again approved a Second Order Continuing Desartion of Stat of Local Disaster for Bexar
County (hereafter, the “Second Order of Continuation of Declaration”);
(WHEREAS, in accordance with Texas Goverament Code Section 418.108(0), the consent
by Commissioners Court authorizes the Bexar County Judge to continue to exercise the powers
granted by the Texas Disaster Act of 1975 forthe period specified in the order,
WHEREAS, there curently stl exists «declaration of public health disaster in and forthe
State of Texas as declared by Texas Governor Greg Abbot and the Texas Deparment of State
Health Services (DSHS) and by approval ofthe Second Order of Continuation of Declaration, the
‘Bexar County Commissioners Court authorized the Bexar County Judge 0 take such actions a
are necessary in order to protect the health, safety and welfare ofthe citizens of Bexar County by
the issuance of executive orders as necessay (each, an “Executive Order”),
WHEREAS, the transmission of COVID-19 has not dissipated but remains & significant
threat othe health and safety ofthe Bexar County Community and rates of infection are increasing
st an slaming exponential rate andthe numberof people ending up in the hospital, ICU, or on
‘ventilators is also dramatically rising despite efforts by local autorities to contr the spread;
WHEREAS, the County Judge has determined that extraordinary emergency measures
rust be taken to try and mitigate the effects of this public health emergency and t faciliate &
response tothe pubic health threat;
WHEREAS, « County Judge is authorized to contra ingress to and egress from a disaster
rea and contol the mavement of perso and occupancy of premises onan appropriate local scalefn accordance with Section 48,108(g) of the Texas Government Code and his authority as

WHEREAS, it is the intent ofthis Executive Order to remain as consistent with and to
‘harmonize, othe extent possible, the executive orders af Governor Greg Abbett andthe current
‘declaration of the Mayor ofthe City of San Antonio (as extended or modified); and
WHEREAS, by the authority vested in me as Bexar County Judge and as the Emergency
Management Director forthe County of Best to continue to protect the health and safety of the
community and address developing and rapidly changing circumstances when presented by the
turent public health emergeney, { hereby rescind my previous Execative Onlers and any
Supplemental Exeetive Order and issue this revised Executive Order in their lace.
PURSUANT TO THE TEXAS DISASTER ACT OF 1975, BEXAR COUNTY JUDGE
NELSON W. WOLFF HEREBY ISSUES THIS EXECUTIVE ORDER AS FOLLOWS:

|. Public Heatth Emergency. ‘That ths Executive Order shall continue the local disaster
‘declaration and publichealth emergency fr Bexar County for the period specified inthis
Exective Order and shall incorporate and adopt the most recent executive order GA-26
issued by Governor Greg Abbott on June 3, 2020, and any subsequent orders by the
Governor relting to the expanded opening of Texas in response to the COVID=19
disaster.
11, Health and Safety Flisy — Commercial Entities, From the date of this Executive
(der, all commercial entities in Bexar County providing goods ar services directly to

Policy"), The Health and Safety Policy must equie, at minimum, that all employees

IL, Base Coverings — General Publi, That all people 10 years or older shall wear a face
covering over their asse and mouth when ina public place where itis diffutto keepsix fet away from ater peopl or working in reas thet involve close proximity with
‘other coworkers. The CDC advises face coverings for people 2 years or older. Face
‘coverings may include homemade mass, scars, bandanas, ot handkerchief, Bexar
County residents should continue to maintain socal distancing of atleast sx fect while
outside their home. Bexar County enployees are also required to wea face coverings
under the same circumstances as the general publi
IT IS STRONGLY RECOMMENDED THAT YOU NOT OBTAIN OR WEAR
MEDICAL MASKS or N-9S RESPIRATORS AS THEY ARE A NEEDED
RESOURCE FOR HEALTH CARE PROVIDERS AND FIRST RESPONDERS.
(Ourheatheare workers and first responders on the front-line combating COVID-19 must
have priority access to medical masks of other personal protective equipment. Face
coverings donot need tebe worn inthe following cumstances:
‘+ When exercising outside or engaging in physical activity ouside
‘+ While deving alone oe with passengers who ate part ofthe sarc household as
the diver
‘+ When doing so poses a greater mental o physical health, safety, or security risk
‘+ While pumping gas or operating outdoor equipment
‘+ While in a building o acvity tha requies security surveillance or ssreening,

Please note that face coverings are a secondary strategy to other mitigation efforts, Face
coverings are nora replacement for social distancing froquent handwashing, and

Consistent with Executive Order GA-26 isued by Governor Greg Abtot, no civil or
criminal penalty will be imposed on individual for failure to wear a face covering
‘Bexar County Justice Center Complex and Fasilities. That the Bexar County Justice
Center Complex shall have limited points of access, subject to madifiction as deemed
necessary by the County Judge: i the Paul Elizondo Tower Nuova Stet entrance; i)
‘one atthe Cadena-Reeves Justice Center Dolorosa Street entra, i) the Bexar County
Courthouse Bexar Heritage Center entrance; and iv) the County Courthouse South
‘entrance at the Nueva Street entrance, and that ll other county-ownedor leased buildings
have a single contolled point of entrance. Further, all citizens and employees shal be
appropriately screened before entering any Bexar County owned or leesd building. At
the control points, citizens and employees shall be asked certain rskrdated questions

facilities unless absolutely necessary
‘Sevarablis. The sections, paragraphs, sentences, clauses and phases of this Executive
Order are severable and if any phrase clause, sentence, paragraph or section ofthis
Executive Order shouldbe declared invalid bythe final judgment or desre of any court
competent jurisdiction, such invalidity shall no affect any ofthe remaining phrases,
clauses, sentences, paragraphs and section that canbe given effect without te invalid
provision, and to this end, the provisions of this Executive Oder ae severable.
{Interpretation and Additional Terms. To the grestst extent possible, this Executive
‘Onde shall be interpreted as consistent with and supplemental to any executive order
issued by the Texas Governor. All provisions of the executive orders ofthe Texas
Govemor citer existing or as, if and when issued, which are made applicable to all
jisictions by law shal be automatically incorporated ino and constitute ters ofthis
Executive Order, enforceable as if set fr herein without necessity fo the issuance of|
any further orders.
‘Enforcement. Excepting Section Il of this Executive Order and in accordance with
the limitations contained in the executive orders of Governor Greg Abbot, that any
peace officer or ther person with lawful authority is hereby authorized t enforce the
provisions ofthis Executive Onder in secordance with the authority granted under the
‘Texas Disaster Ac of 1975,
