ETHIOPIAN CIVIL SERVICE COLLEGE


CONTRACT OF EMPLOYMENT FOR EXPATRAIATE
ACADAMIC PERSONNEL

ADDIS ABABA, ETHIOPA

This contract of employment is made and entered into this _____________ day of __________
20 ___G.C. (___ day of ________, 19 __ E.C.) by and between the Ethiopia Civil Service
College (hereinafter called the "Employer") and ________________________________
(hereinafter called the "Employee").

The parties hereto agree as follows:

ARTICLE I - EMPLOYMENT

The Employer shall employ the Employee as (Rank) _____________________


In (Discipline) __________________________ and the Employee agrees, within the scope of
his/her academic discipline, to perform the duties prescribed hereunder: -

1. To give course lectures and other forms of instruction to students including


demonstration, laboratory supervision, tutorials, practical classes, and field classes,
and preparation of teaching materials as may be determined by the head of the
Institute/Department, and according to Article VII of hereunder.

2. To avail himself/herself to scholarly research and the advancement of knowledge as


well as the progressive strengthening and development of the institution.

3. To assist in the conduct of the Institute's business by accepting assignments to serve


on committees and commissions; particularly on committees or commissions
established to deal with the organization, direction and development of the activities
of the Institute or any duty thereof.

4. To serve the institution for the whole period of the contract according to Article IV
here in under.

ARTICLE II-INTERPRETATION

The interpretation of this contract shall rest with the Ethiopian Law.

ARTICLE III-EMPLOYEE'S WARRANTIES AND COVENANTS

1. The employee represents that he/she is professionally and technically competent and
qualified to discharge the duties for which he/she is employed.

2. The employee agrees to exert his/her maximum professional efforts in course preparation,
delivery, and student assessments so that the strengths in his/her case learn and achieve the
intended professional proficiencies.

3. The Employee agrees that he/she shall perform his/her duties in a professional manner and
in accordance with the academic standards, objectives, and general philosophy of the
Institute as set forth by the appropriate body.

4. The Employee shall regard his/her services to the Institute as full-time employment, and
shall not engage in any other activity (remunerative or unpaid) which encroaches upon the
time he is expected to devote to his/her contractual duties without prior written approval of
the Head of the Institute. This requirement does not extend to occasional lectures, writing
of scholarly articles, or conducting research.

5. The employee represents that he/she is not subject to any military or other commitments,
which would require return to his/her home country except in the case of a general
mobilization order in the event of national emergency.

6. The Employee agrees to submit to the Employer along with the signed contract and prior to
departure from his/her place of residence:

a) A medical Certificate of his/her physical fitness to work and reside in Ethiopia.

b) Medical certificate(s) for his/her spouse and for each legal dependent (who for the
purpose of this contract must be a person under 18 years of age (and maximum of 3 in
all including spouse) and of their physical fitness to reside in Ethiopia for the duration
of the Employees' period of service hereunder. All medical certificates shall be signed
by recognized medical institution.

7. The employee agrees to refrain from using his/her official position or the institute's
facilities for the dissemination of his/her personal, political or religious beliefs; he/she also
agrees to refrain from incitement or causing incitement, which will result in the disruption
of the orderly operations of the institution or any level section of the institution.

8. The Employee agrees to abide by the laws of Ethiopia.

ARTICLE IV- DURATION

1. This Contract shall come into effect as of ________ day of __________ 20 ___G.C.
(_________ day of ________, 19 __ E.C.) and shall remain in effect for a period of two
academic years.

2. The date of arrival at Addis Ababa (Ethiopia) shall be used for the purpose of payment of
salary and allowances.

3. Arrival for duty after the above date and upon acceptance by the Institution, shall result in
prorate deduction from salary and allowances here under.

4. The normal period of full-time employment each year shall be up to August 14 th , From the
effective date of the commencement of this contract.

ARTICLE V- SALARY

1. The Employee shall receive a monthly salary of Birr (National Currency) equivalent to
_________________________________________ which shall be payable at the end of each
month according to the Ethiopian Calendar beginning from the date set forth in Article IV-2
hereof.
2. Exchange rates shall be adjusted every three months, and the prevailing rates at the first week
of the Ethiopian months of October, January, April and July shall be used.

3. Said salary; together with allowances shall constitute full and complete remuneration for the
services performed by the Employee hereunder.

4. Except as provided in Article VIII hereof the Employee shall not receive any salary or
allowance during any period of illness of disability, nor shall the Employee receive any
salary, allowances or sick leave payments during any period of illness or disability which
he/she has willfully or negligently contracted.

5. Salary shall be paid only until the 14th of August in the second & final year of the contract.

ARTICLE VI - ALLOWANCES

1. Housing shall be provided by the employing Institution.


2. Hotel accommodation shall be provided to the Employee his/her spouse and legal dependents
after his/her arrival to Ethiopia until such time as permanent housing are secured.
3. Payment of all allowances shall be made at the end of each month according to the Ethiopian
calendar beginning from the date set forth in Article IV hereof.

ARTICLE VII - DUTY STATION

1. The duty station of the employee in Ethiopia shall be in ______________. However he/she
may be required to travel to various places within Ethiopia on official duty and/or through
staff exchange programs of higher education institution, and/or as circumstances demand to
another institution.

2. When the Employee is required to travel within Ethiopia for and in connection with official
duty he/she shall be entitled to a per diem allowance as per the scale adopted by the Institute,
or as agreed by the different institutions of staff exchange.

ARTICLE VIII-SICK LEAVE, HOLIDAYS, AND WORK WEEK

1. In the event of absence from duty on account of illness or disability not resulting from
Employee's negligence or misconduct, duly certified by a government hospital or health
center, the Employee shall be entitled to sick leave not exceeding twenty days in any one-
year. The unused portion of sick leave may not be carried over into a subsequent year or
used for any other purpose.

2. It is the responsibility of the Employee to arrange for coverage of scheduled classes and other
assignments according to VII-I- above.

3. The Employee's workweek shall be according to the established practice of the Institution.
He/she shall only be entitled to such holidays as are observed by the Institute.

ARTICLE IX-TRAVEL ALLOWANCES

1. The Employee shall be entitled at the beginning of this contract period to the cost of air travel
by the least expensive class and by the most direct route for himself/herself, his/her spouse,
and other legal dependents, (maximum of 3 including spouse) accompanying him/her or
joining him before one-half of the contract period has expired from
________________________ to Ethiopia, and at the end of the Contract period from
Ethiopia to _____________________. Such travel as far as possible shall be on the
Ethiopian Airlines.
2. At the end of the contract period only the employee and dependents who joined the employee
as in Article IX-I- shall have the benefit.

3. The Employee's spouse or any legal dependent who shall remain in Ethiopia less than one-
half of the Contract period shall not be entitled to any transportation costs or allowances
either to or from Ethiopia.

4. For purposes of helping to cover the cost of shipping of personal effects to and from Ethiopia
the employee shall be compensated a maximum of twenty Kgs of excess luggage charge at
the beginning and end of the contract period, upon presentation of legal receipts.

ARTICLE X - TERMINATION

1. This Contract may be terminated by the Employer or by the Employee in the case of breach
of the provisions of this Contract. In such an event the Employee shall only be entitled to
his/her salary and allowances due up to the date of termination.

2. This Contract may be terminated by the Employer in case of illness or disability satisfying
the conditions set forth in Article VIII (1) hereof and of a duration in excess of forty days in
any one year. In such an event the employee shall be entitled to his/her salary and
allowances due up to the date of termination.

3. This Contract may be terminated by the Employer in case of illness or disability not
satisfying the condition set forth in Article VIII (1) hereof for duration of twenty days in any
year. In such an event the Employee shall be entitled to his salary and allowances due up to
the date of commencement of said illness or disability.

4. This Contract may be terminated by either party at any time and for no cause by giving three
months notice to the other party. In such an event the Employee shall be entitled to his/her
salary and allowances up to the date of termination specified in said notice of termination.

5. In the event this Contract shall be terminated under any of the foregoing provisions of this
Article, departure travel costs and allowances to the Employee, his/her spouse and his/her
legal dependents shall be paid by the employer if the contract is terminated by the employer.

ARTICLE XI - LAW OF THE CONTRACT


It is agreed by the parties hereto that this contract is made and executed and is to be performed in
Ethiopia and that laws of Ethiopia with respect to both procedures and substance shall govern the
contract and any litigation hereunder shall be brought in Ethiopian Courts.

ARTICLE XII - AMENDMENTS


The provisions of this contract may not be altered or amended except in writing singed and dated
by the parties hereto.
