DECLARATION BY PURCHASER

1. I, MATHIAS NCUBE do hereby declare that on the 9 th January, 2008 and not before
I bought from the sellers
PATRICK NYATHI
by private treaty the following property;

Certain piece of land situate in the district of Bulawayo being Stand 188 Kensington
Township of Kensington measuring 1,5717 hectares.

2. The extent of the improvements upon the said property is as follows :


Single storey dwelling of brick under asbestos roof comprising of two living
rooms.

I further declare that the full and true consideration payable by the Purchaser for such
Sale of $10 000 000 000.00 made u p as follows:

(a) In cash: $10 000 000 000.00


(b) Otherwise than in cash: Nil

4. I further declare that to my knowledge neither party to the transaction has, nor has
any other person on such party’s account undertaken, agreed or in any manner
become liable to the Seller aforesaid or to any other person whereby there has
been paid or is to be paid to the Seller or to any person whomsoever for or in
respect of or in connection with the sale or acquisition or registration of the
acquisition of the property any sum of money or valuable consideration over and
above the paid sum or to be paid as aforesaid, save and except certain charges
which fall under or come within one or more of the heads or items of charges on
payments following :
a) Any duty, imposts, costs or fees payable in connection with the
registration of the acquisition of the property, including :
(i) The costs of survey of the property;
(II) The charges and commission payable to any auctioneer, broker or
Agent by whom the sale of the property may have been effected
not exceeding five per centum of the purchase price; and
(III) the charges of conveyancers and agents incurred in the transfer of
the property and the costs of all deeds, including any mortgage
bond necessary for such transfer.
(b) Any sum paid in respect of endowment moneys in terms of the Town and
and Country Planning Act (Chapter 29:12).

6. I further declare that the Seller has not received , and I am not to receive nor has
any person to receive for the Seller’s use or benefit, or at his instance or request
any valuable consideration beside the aforesaid sum passing to the Seller for such
sale, save and except 1 in so far as any of the charges specified, and to be paid
by the Purchaser aforesaid, might be held or taken to be payable to the Seller or
on his behalf.

THUS done and signed by the Declarant at BULAWAYO on this the day of
2007 in the presence of the undersigned witnesses

NOTES:

i. Declarant to strike out whatever is inapplicable.

iii. The property and extent thereof to be described as in the Title Deeds
iv. (a) If there are no improvements state: Unimproved stand (or farm land or ranch land,
or etc.)
(b) The description of improvements is required to be given only in simple form, for
Example-
(A) dwelling house, double(or single) storey, 5 living rooms, brick under tile(or iron ,etc)
together with domestic staff quarters, swimming bath; or
(B) five storey ferro-concrete block of offices (or flats, or shops and offices, etc); or
C) farm land with two dwelling houses, 10 tobacco barns and usual farm outbuildings;
all brick under iron, 200 acres under plough and 50 acres under timber; or
(D) ranch land fenced into sections for running cattle, with dwelling house of brick
under iron, only; etc.
(v) The lease rental means the total rental payable during the period of the lease, including
any period or periods for which the lessee has the option or right of renewal.
(vi) If the declarant has become liable for the payment of additional amounts, particulars must be
given in paragraph 5 (c).
(vii) Section 31 of the Stamp Duties Act (Chapter 23:09) as amended, provides for penalties not
exceeding $1000.00 or to imprisonment for a period not exceeding seven years or to both such
fine and imprisonment where, in making a declaration required in terms of the Act , the declarant
knowingly fails to disclose any material fact relevant to the nature of the transaction by which
property has been acquired or to consideration payable in respect of any property or to the value
on which duty is payable or makes a false statement knowing it to be false or not reasonably
believing it to be true.
