AGREEMENT

This agreement is made at 19/05/2020 this Tuesday of 2020 BETWEEN M/S The New India
Assurance Co Ltd, Branch/Divisional/Regional Office having its office at Raipur hereinafter
referred to as "NIACL" (which expression shall, unless it be repugnant to the context or
meaning thereof, be deemed to mean and include its successors and permitted assigns) of the
One Part. AND 4 Wheelz automotive, hereinafter called as "Preferred Service Provider", and
referred to as WORKSHOP"(which expression shall, unless it be repugnant to the context or
meaning thereof, be deemed to mean and include its successors and permitted assigns) of the
Other Part.

WHEREAS:

A. NIACL is a Public Sector General Insurance Company and is engaged in

providing general insurance services to the policyholders.
B. NIACL wishes to avail the services of the Workshop to render better services by
providing cashless facility to their customers, who have insured their Private
Cars/Two
Wheeler/Commercial Vehicles in the event of any accidental damage to the vehicle
towards repair work in respect of claims for repairable Own Damage losses only
that are admissible in terms of the Policy.
WHEREAS:

is a workshop engaged in inter alia repair of

B. The WORKSHOP has represented to NIACL that it is duly authorized /
approved to operate as workshop under the name and style of

NOW THEREFORE THIS AGREEMENT WITNESSETH AS UNDER:

1 .Repair work to be commenced only after getting Authorisation letter from

NIACL. If the insured approaches directly, the WORKSHOP will take necessary
steps to intimate the claim to NIACL with all details.
2.WORKSHOP shall prepare the detailed estimate for actual damage for actual
damages and keep ready at the time of survey.
3. The WORKSHOP shall assist the surveyor in assessment of loss and put his
consent on the assessment sheet given by the surveyor.
4.Cashless facility is not to be given wherever Third party Injury/Property damage
is involved unless specifically agreed by NIACL.
5.Repair should be carried out strictly according to Authorisation letter and consent
given by the surveyor.
6.NIACL pays to WORKSHOP as per Authorisation Letter/Consent Letter and the
Workshop shall recover all such expenses from the insured which are not payable
as per policy conditions.
7.Vehicle to be released to the insured / claimant after due re-inspection by the
surveyor or Company In-house surveyor and after the consent of NIACL and obtain
Satisfaction cum discharge voucher duly signed by the insured/claimant.
8.Bill shall be raised in the name of NIACL and to be forwarded along with
other documents. 9.NIACL agrees to pay all completed and approved claim
bills within 7 working days subject to deduction of tax(TDS) if applicable.
10.The agreement shall be valid for a period of One year. Amendments, if any to be
done by mutual
consent.
I I .The agreement may be terminated by either party by giving one month notice in
writing.
12.This agreement and agreement related matters shall be governed by and
construed in accordance with the laws of India. The parties submit and agree to the
exclusive jurisdiction in the courts in
