NOTICE OF PROPOSED AMENDMENT
OF CABLE TELEVISION FINAL LICENSE
OF
VERIZON NEW ENGLAND, INC.
(December 16, 2010)
The Town of Franklin, by and through its Town Council, as cable television
licensing “Issuing Authority” and Verizon New England, Inc. (“Verizon” or “Licensee”)
proposes an amendment to the Cable Television Final License (“License”) granted to
Verizon on December 20, 2006. The proposed amendment, jointly sought by the Town
and the Licensee, is summarized below. (The specific License amendment and a written
report regarding the proposed amendment is available in the office of the Town
Administrator at the Franklin Municipal Building, 355 East Central Street, Franklin,
Massachusetts 02038.)
The proposed amendment to Section 5.4 PEG Access Support, decreases the
annual funding percentage the Licensee (Verizon New England, Inc. or its
successor, if any) must provide to the Town Council (“Issuing Authority”) or its
designee for Public Educational and Government Access [television etc.], from
five percent (5%) of annual “Gross Revenue” to four and eight-tenth percent (4.8)
of said annual Gross Revenues. Said reduction in percentage support is proposed
in order that the annual percentage PEG access support of the Licensee, Verizon
New England, be equivalent to the annual funding percentage required of
Comcast of Massachusetts II, Inc. in Section 6.4 of Comcast’s ten (10) year Cable
Television Renewal License, agreed to and issued by the Town in October 2010,
specifically - four and eight-tenth percent (4.8) of “Gross Annual Revenues”. The
Town Council has agreed to propose the subject amendment, requested by the
Licensee, and subject to public comment pursuant to this legal notice, based on
the totality of circumstances, including the narrow scope of the subject financial
issue and the Licensee’ good faith and equitable approach in the negotiations for
the initial License. The Town has declined to consider any amendments not
related to this narrow financial issue.
