PETITION

PETITIONER, through counsel, unto this Honorable Court most

respectfully avers: THAT---

1. Petitioner is of legal age, Filipino, married and presently residing

in Lanao cor. Tawi-tawi Sts., Kassel City, Abucay, Tacloban City, where he
can be served with court processes.

2. Sometime in 27 June 2007, petitioner married Ingrid L. Villegas in

a civil ceremony in San Miguel, Leyte solemnized by Judge Teofilo
Avestruz, evidenced by a certified true copy of a Marriage Contract1.

3. After their marriage, the couple temporarily settled in Poblacion,

San Miguel, Leyte until December 2011. It was in San Miguel where their
two children were born, namely: MARIA JASMEN G. VILLEGAS2 in 27
June 2007, and RALPH JASON G. VILLEGAS3 in 12 December 2009.

4. On 24 December 2012, petitioner’s wife deserted their temporary

abode in Poblacion, San Miguel, Leyte, for an unknown destination without
the knowledge of the petitioner, leaving their children to his paternal care.

5. Since then up to the present or more than eight (8) years now,
petitioner has not heard any word or news from his wife.

6. The relatives and friends of his wife had not provided him
information about her whereabouts. His bosom friend, ROBERT CRUZ,

whom he tasked to search for his wife, likewise failed to find her or know
her whereabouts.

WHEREFORE, premises considered and pursuant to the applicable

Civil Law, it is most respectfully prayed of this Honorable Court to issue an
order declaring petitioner’s spouse, INGRID L. VILLEGAS, presumptively
dead for being absent for more than 8 years, her whereabouts remain
unknown.

resident of Tacloban City, after having been sworn according to law, hereby
depose and state: THAT—

I am the Petitioner in the above captioned case; that I have read this
Petition and that the allegations herein are true and correct of my own
personal knowledge and based on authentic records; and

I have not theretofore commenced any action or filed any claim

involving the same issues in any other court, tribunal or quasi-judicial
agency and, to the best of my knowledge, no such other action or claim is
pending therein; and if I should thereafter learn that the same or similar
action or claim has been filed or pending in any court, tribunal or quasi-
judicial agency, I shall report that fact within five (5) days therefrom to this
Honorable Court.
