PURPOSE: The purpose of this standard operating procedure is to provide guidelines for the use of force by swam personnel of the Sheriffs Office. I. SCOPE: This procedure shall apply to all sworn personnel. * i piscussiot IV. RESISTANCE AND RESPONSE LEVELS: A. Levels of Subject Resistance cf Passive Resistance - A subject verbally or physically refuses to respond or comply with a deputy’s verbal commands. The subject does not make ‘any attempt to physically defeat the deputy’ verbal commands or actions, but the subject's actions require the deputy to use physical force to establish control ‘Active Physical Resistance - A subject makes physically evasive movements to defeat a deputy’s attempt to control the subject. This may be in the form of bracing or tensing, attempting to push or pul away, or by not allowing the deputy to get close to them ‘Aggressive Physical Resistance - A subject makes over, hostile, threatening, and attacking movements, which may cause injury to themselves, the deputy, or others but are nat likely to cause death or great bodily harm to themselves, the deputy, oF athors Deadly Force Resistance -A subject's actions that create a reasonable belie by the deputy that the subject's capable of causing death or great bodiy harm to the deputy or others. B. Levels of Deputy Response Dialogue - Talking a subject into compliance, ie., verbal commands with ‘an emphasis on decreasing the intensity of a conflict. The goal of the ‘deputy is to achieve compliance through the use of verbal commands. De-escalation - The process of defusing a tense situation using a ‘combination of dialogue, empathy, and experience in order to gain ‘compliance from a subject. When safe and under the totality of the circumstances, deputies shall use de-escalation tactics in order to reduce the need for physical force. Physical Force - Force in excess of mere touching or grabbing of ‘subject. Physical force is achieving control or custody through the use of GEN 500.00 Page 2 of 4 v. 1219/19 ‘empty-hand or leverage-enhanced techniques, such as pain compliance, takedowns, and striking techniques. This term does not include escorting ‘or handcuffing a subject when there is minimal orno resistance by the subject. Less Lethal Force - Force that is not likely or intended to cause death or ‘great bodily harm to a subject. Less lethal force may include, but is not limited to, the use ofthe folowing: 4 Oleoresin Capsicum (OC) Agent - The deployment of OC may be an appropriate response to any type of “active physical resistance’ on the part of a subject who is about to be taken into custody, and it appears the ullization of other control techniques: will most likely result in a physical altercation that may cause injury to either deputies or the subject being taken into custody. b. Electronic Control Device (ECD) - The deployment of the ECD ‘may be an appropriate response to any type of "active physical resistance” on the part ofa subject who is about to be taken into custody, and it appears the utlization of other contro techniques. will most likely result in a physical altercation that may cause injury to either deputies or the subject being taken into custody. c. _ Expandable Baton - The deployment of an expandable baton ‘may be an appropriate response to “aggressive physical resistance” by a subject who is about to be taken into custody, and it appears the ulization of other control techniques will most likely esult in a physica alteration that may cause injury to either deputies or the subject being taken into custody. d. 40mm Less Lethal Launcher and OC Impact Munition (LIM) - ‘The deployment of a LLIM may be an appropriate response to “aggressive physical resistance” by a subject who is about to be taken into custody, and it appears the utiization of other control techniques will most likely result in a physical altercation that may ‘cause injury to either deputies or the subject being taken into custody. @. Use of Less Lethal Force Weapons - Refer to SOP 500.02 for ‘complete details on the proper protocol and use of these weapons. Deadly Force - is force that is likely to cause death or great bodily harm: ‘toa person. Proportional Force - The degree of force which is reasonably necessary to effectively bring a subject andior situation under control. Proportional force does not require deputies to use the same type or degree of force as the subject presents. PROCEDURE: Dialogue/De-escalation A sangre GEN 500.00 Page 3 of 4 ‘When safe and feasible, deputies should consider whether a subject's lack of compliance is a deliberate attempt to resist, or the inabilty to ‘comply is based on factors such as, but not limited to, medical conditions, ‘mental impairment, developmental disabily, language barre, influence ‘of drugs oF alcohol, perceived age, andlor a behavioral crisis. ‘Consideration should be given when the individual is only a threat to themselves. B. Physical Force andlor Less Lethal Force 1 “The use of physical force andlor less lethal force shall be used in sot. defense, defense of another, in preventing escape, orto overcome a ‘subject's passive, active, or aggressive physical resistance to lawful ‘orders or to being taken into custody. ©. Use of Deadly Force _On and off-duty law enforcement deputies and on-duty detention deputies 1 ‘Prevent imminent death or great bodily harm to the deputy. ‘Prevent imminent death or great bodily harm to another individual. ‘Apprehend a fleeing subject whom the deputy reasonably believes ‘committed a felony involving the infliction or threatened infliction of, serious physical injury to another person; and the deputy reasonably believes that an escapeeifleeing felon poses a threat (of death or serious physical injury to the deputy or others. When safe and feasible, deputies wil identify themselves as law tenforcement and order the subject to stop the activity (warn of intent to use deadly force). Restrictions on the Use of Deadly Force: Deputies shall not draw their weapons except in high-hazard situations. GEN 500.00 raise Page 4 of 4 ‘protection for a deputy. Deputies will not fire any weapon from or _at'a moving vehicle except to counter an imminent threat of death ‘anger. ‘When encountering a vehicle, deputies shall use appropriate tactics to avoid unnecessarily placing themselves in harm's way. Deputies should avoid standing or moving in front of or behind a vehicle or reaching inside a moving vehicle. Deputies shall not use deadly force to apprehend perpetrators of ‘non-violent crimes against property Deputies shall not use deadly force against individuals who pose a
