10 On 20 November 2019 the Registrar of the Supreme Court of Victoria authorised me as the
11 Administrator of the Estate of the Late Mr Gerard Viggo Mulders (of 3 Swinbourne Avenue,
12 Rainbow) to place a LEGAL NOTICE at the Supreme Court of Victoria website regarding the
13 Estate. As I previously indicated the Coroner on 25 October 2019 made a judicial decision that
14 the late Mr Gerard Viggo Mulders was deceased on 5 July 2019. No notice within 14 days was
15 received by VicRoads to “SUSPEND” registration.

17 I understand that within legal provisions the owner of a motor vehicle requires to provide details
18 as to any offence claimed against the motor vehicle registered by this owner. As the Late Mr
19 Gerard Viggo Mulders became deceased as on 5 July 2019 then in my view VicRoads had a
20 legal responsibility as to update its driver licence and motor registration records
21 “IMMEDIATELY” the Registrar of Births, Deaths and Marriages recorded the death certificate
22 on 5 July 2019. After all the very purpose to record a death with the Registrar of Birth, Marriage
23 and Deaths is to have a public record of this. Hence, public offices such as VicRoads must not
24 ignore this. In my view VicRoads therefore had the onus as to “SUSPEND” as on 5 July 2019
25 both any driver license as well as any registered motor vehicle in the name of the Late Mr Gerard
26 Viggo Mulders, pending any decision by any court otherwise. Hence, in my view the Motor
27 vehicle registration of Toyota UIW117 must be considered “SUSPENDED” PENDING THE
28 Supreme Court of Victoria Probate Office to issue Orders of Probate as to determine in it who
29 shall be the new owner of the motor vehicle.

31 It is my understanding that Widow Ingrid Weise (formally Mrs Ingrid Schorel nee Mulders)
32 desires that our son Richard Schorel becomes the new owner of the motor vehicle. Obviously as
33 the Administrator I can do no more but provide this information to the supreme Court of Victoria
34 for it to determine if it for this purpose will direct ownership of Toyota UIW117 to Richard
35 Schorel. If the Supreme Court of Victoria in its wisdom and informed decision decides to follow
36 this direction as being the most sensible manner then I view VicRoad must reinstate the motor
37 vehicle with the balance of registration from 5 July 2019 till 28-3-2020 reapplied.
38 In my view, never should VicRoads profit from the death of a person by keeping the balance of
39 the paid registration after 5 July 2019 nor deny the person who benefit from the court’s decision
40 to have the vehicle as to what it was at the time of death.

42 PRECEDENT: When my wife’s late husband Mr Jaroslav Hlavka had died I became at the time the
43 Executor of the Estate and through (then) Premier Steve Bracks the motor vehicle was transferred into my
44 name without charge. In my view where a motor vehicle is not “sold” but is transferred to a new owner as

1 part of an Estate then I view VicRoads should not apply any charges, as occurred at the time via Premier
2 Steve Bracks.

4 It in my view is essential that VicRoads conduct itself in an exemplary manner and while
5 understanding that those grieving of the death of a family member cannot be avoided, at least it
6 will not seek to add additional grievances.
7 For road safety issues it is obviously also important that any motor vehicle that was registered in
8 the name of a deceased person is automatically “SUSPENDED” the moment a “death
9 certificate” has been recorded by the Registrar of Births, Deaths and marriages. This also to
10 avoid someone to purchase or borrow such vehicle and rack up numerous infringements.
11 While there is an issue that the Government claims to de-register motor vehicles that have not
12 replaced dangerous airbags. I view it would in fact be more appropriate to “SUSPEND” such
13 registrations. After all an airbag may have been already replaced without being placed on record.

34 I have ongoing made known that due to a hearing disability I ordinary do not orally
35 communicate via mobile/telephone and as such expect that instead of providing me some phone
36 number common decency prevails and you respond in writing! Where you fail to respond to my
37 satisfaction then I be left no alternative but to file a formal complaint with the Minister, this as it
38 appears to me that VicRoads fails to act within the public’s interest. I consider it utterly and
39 totally scandalous VicRoads doesn’t provide an VicRoads email address to respond. I view a
40 violation of disability discrimination legislation provisions.
41 For our information (on my request as an Administrator) due to criminal Victorian Police
42 investigation probate is still to be finalised. I do not know if the IDENTITY theft the police is
43 investigation was with usage of the driver’s license of the Late Mr Gerard Viggo Mulders to
44 defraud Financial Service Providers. Obviously, this is of concern VicRoads failed to
45 “SUSPEND” the drivers licence on 5 July 2019.
