Factorires No. FAC-122003/100/Lab-4, dt. 1/9/2010 - In exercise of the powers


Act, 1948 conferred by section 112 read with section 41 of the Factories Act, 1948 (63 of
1948) and of all other powers enabling it in that behalf; the Government of
Maharashtra hereby makes the following rules further to amend the Maharashtra
Factories Rules, 1963, after the same having being previously published as required
by section 115 of the said Act, namely :-

1. These rules may be called the Maharashtra Factories Rules, 2010.

2. In rule 5 of the Maharashtra Factories Rules, 1963 (hereinafter referred to as “the


principal Rules”), in sub-rule (1), for the words “accompanied by application in Form
3” the word “and” shall be substituted.

3. In rule 8 of the principal Rules, in sub-rule (1), for the words and figure “in Form 3”
the words and figure “in Form 2” shall be substituted.
4. After rule 18 of the principal Rules, in Chapter III, after the heading “Health”, the
following shall be inserted , namely:-
“18-A. Medical examination of workers - All the workers in a factory shall be
medically examined once in a year by a Certifying Surgeon appointed or recognised by
the Government under section 10 of the Act.
5. In rule 17 of the principal Rules, in clause (a), for the words “to photograph any
worker” the words “to photograph any worker, occupier, manager, any person in
managerial or supervisory capacity and” shall be substituted.
6. In rule 18 of the principal Rules, sub-rule (10) shall be deleted.
7. In rule 35 of the principal Rules, sub-rules (iii) and (iv) shall be deleted.
8. For rule 43 of the principal Rules, the following shall be substituted, namely:-
“ 43. Testing of drinking water.- The occupier of a factory shall provide drinking
water of the quality prescribed by the Bureau of Indian Standard. The occupier shall get
the quality of drinking water provided in factory tested from a Government approved
laboratory at least once in every six months.”.
9. In rule 44 of the principal Rules,-
(i) in clause (a), for the words “or other effective method” the words “or other
effective hygienic method” shall be substituted;
(ii) clause (d) shall be deleted.
10. In rule 45 of the principal Rules, in clause (a), for the words and figures “for every 25
females” the words and figures “for every 10 females” shall be substituted.
11. In rule 52 of the principal Rules, in the proviso, the words “to the satisfaction of the
Health Officer” shall be deleted.
12. In rule 53 of the principal Rules, for the words “for every ten latrines or part thereof”
the words “for every latrine” shall be substituted.
13. In rule 53-A of the principal Rules, in the Schedule,-
(i) in serial no. 1, in column 2, for the word and figures “upto 100” the word and
figures “upto 50” shall be substituted;
(ii) in serial no. 2, in column 2, for the word and figures “Above 100 but not above
250” the word and figures “Above 50 but not above 250” shall be substituted.
14. Rules 54, 55 and 56 of the principal Rules shall be deleted.
15. Rule 61A of the principal Rules shall be deleted.
16. In rule 64 of the principal Rules,-
(i) in sub-rule (2), for the words and figures “Form No.12” the words and figures
“Form No.11” shall be substituted;
(ii) in sub-rule (5), in the proviso, for the words and figures “Form No.12” the words
and figures “Form No.11” shall be substituted;
(iii) in sub-rule (6), for the words and figures “Form No.12” the words and figures
“Form No.11” shall be substituted.

17. In rule 65 of the principal Rules, in sub-rule (1), after clause (d), the Following shall be
added, namely:-
“ (e) “Hydraulic test” means the pressure test carried out as per design pressure for
assuring integrity of pressure vessel and shall be carried out with water and/or a
compatible liquid as prescribed by the manufacturer.”.
18. For rule 67 of the principal Rules, the following shall be substituted, namely:-
“67. Protection of eyes.- Effective screens or suitable goggles shall be provided for the
protection of persons employed in or in the immediate vicinity of the following
processes:-
(a) The processes which involve risk of injury to the eyes from particles or fragments
thrown off in the course of the process such as ,-
(1) turing, grinding, fettling, breaking, drilling, welding, cutting of metal, metal
casting and any other material, etc.,
(2) work at a furnace where there is risk to the eyes from molten metal,
(3) pouring or skimming of molten metal,
(4) handing in open vessels or manipulation of strong acid of dangerous
corrosive liquids or materials, and the operation, maintenance or dismantling
of plant or any part of plant being plant or part of plant which contains or has
contained such acids, liquids or materials, unless the plants or part of the
plant has been so prepared by isolation, reduction, of pressure, or otherwise,
treated or designed and constructed as to prevent risk of injury,
(5) any other process wherein there is a risk to eyes from particles or fragments
thrown off during the course of the process.
(b) The processes which involve risk of injury to the eyes by reason of exposure to
excessive light or infrared or ultra-violet radiation or any other harmful radiation
or rays or excessive heat.”.
19. Rule 71 of the principal Rules shall be deleted.
20. In rule 71-B of the principal Rules, in sub-rule (8), in clause (a), in sub-clause (ii), the
words “approved by the Inspector” shall be deleted.
21. In rule 73 of the principal Rules, in sub-rule (1), the words “whose name has been
recorded in the register maintained in Form 10” shall be deleted.
22. In rule 73-A of the principal Rules,-
(a) in sub-rule (3),-
(i) clause (a) shall be deleted;
(ii) in clause (b) for the word and figures “Form 13B” the word and figures “Form
13” shall be substituted;
(b) for sub-rule (6), the following shall be substituted, namely:-
“(6) Every gas holder shall be thoroughly examined by the competent person once
in a period of every 12 months.”;
(c) sub-rules (7) and (9) shall be deleted;
(d) for sub-rule (10), the following shall be substituted, namely:-
“(10) A copy of report of examination of the gas holder by the competent person
shall be maintained in Form No. 13.”.
23. After rule 73-H of the principal rules, the following rule shall be inserted, namely:-
“73-HA.- General measures.-(a) In all machinery driven by power and installed in
any factory after commencement of this rule, all couplings with projecting bolt heads
nip points and sharp projections and similar projections shall be completely encased or
otherwise, effectively guarded as to prevent danger.
(b) Further precautions specified by the manufacturer of machinery shall be observed in
all specific cases.
(c) The space surrounding every machine in motion shall be kept free from obstruction.
(d) The place surrounding every machine shall be maintained in good condition and
shall not be allowed to become slippery and as far as practicable shall be kept free from
chips or other loose materials.
(e) Adjustment and Maintenance of Guards and Safety Devices – The guards, fencing
and other appliances required shall be –
(i) maintained in an efficient state.
(ii) constantly kept in position while the machinery is in motion.
(iii) so adjusted as to enable the work to be done without risk.
24. For rule 73-I of the principal Rules, the following shall be substituted, namely:-
“73-I. Planting of trees.- Every factory shall plant and maintain trees within the
premises of the factory.”.
25. In rule 73-L of the principal Rules,-
(i) in sub-rule (2), in clause (a) for the figures and word “50 workers” the figures
and word “100 workers” shall be substituted;
(ii) in sub-rule (5), clause (d) shall be deleted.
26. In rule 73-N of the principal Rules, in sub-rule (1), for clause (b) the following shall be
substituted, namely:-
“(b) information of hazardous processes carried on in the factory; ”
27. In rule 73-S of the principal Rules, sub-rule (3) shall be deleted.
28. In rule 73-W of the principal Rules, in sub-rule (1), in clause (c), in sub-clause (iii) the
words “ one nurse” shall be deleted.
29. In rule 74 of the principal Rules,-
(i) in sub-rule (1), the portion beginning with the words “Such facilities shall be
conveniently located” and ending with the words “so enclosed or screened as to ensure
privacy:” shall be deleted;
(ii) sub-rules (2) and (3) shall be deleted.
30. In rule 79 of the principal Rules, for sub-rule (1), the following shall be substituted,
namely:-
“ (1) The occupier of every factory wherein more than 250 workers are ordinarily
employed shall provide, in or near the factory, an adequate canteen according to
the standards prescribed in the rules.”.
31. In rule 81of the principal Rules, in sub-rule (2), the portion beginning with the words
“A service counter” and ending with the words “of utensils and equipment” shall be
deleted.
32. In rule 85 of the principal Rules, sub-rule (1) shall be deleted.
33. In rule 93 of the principal Rules, sub-rule (5) shall be deleted.
34. In rule 103 of the principal Rules, for the words and figures “in Form 18”, the words
and figures “in Form 16” shall be substituted.
35. In rule 104 of the principal Rules, for the words and figures “in Form 19”, the words
and figures “in Form 17” shall be substituted.
36. In rule 110 of the principal Rules, the words “A copy shall also be delivered at the
office of the Inspector” shall be deleted.
37. In rule 122 of the principal Rules, in sub-rule (2), the proviso shall be deleted.
38. For Form 2 appended to the principal Rules, the following shall be substituted, namely:-

Explanations :
1 * Occupier means, Director, Partner or Proprietor; as per Section 2 (n) of the
Factories Act, 1948.
2 Licence renewal application shall be submitted for renewal at least two
months in advance along with licence fees before the date which the licence
is due to expire.
3 Any change in above information e.g. Change in factory name, change in
Occupier / Manager, change in worker or Horse Power or both exceeding
the upper limit by existing slab, should be reported immediately by
submitting the same form to this office.

Note : Latest copy of partner ship deed/copy of article of memorandum with list
of Directors / proof of occupiership shall be enclosed.
39. Form 3 appended to the principal Rules shall be deleted.
40. For Form 11 appended to the principal Rules, the following shall be substituted,
namely:-

41. Form 12 appended to the principal Rules shall be deleted.
42. For Form 13 appended to the principal Rules, the following shall be substituted,
