PRESCRIBING IMPLEMENTING RULES AND REGULATIONS (IRR) OF MUNICIPAL


ORDINANCE NUMBER 241 SERIES OF 2020

WHEREAS, pursuant to Section 11 of Municipal Ordinance No. 241-2020


otherwise known as “An Ordinance Providing for the Policies and Regulations for
the Prevention, Response, and Mitigation of Emerging Infectious Disease and for
Other Purposes” duly ordained by the Sangguniang Bayan on May 11, 2020, the
Office of the Municipal Mayor needs to formulate the implementing rules and
regulations as a consolidating and coordinating office to ensure effective
implementation;

NOW THEREFORE, I, LEONIDA P. MANPATILAN, Municipal Mayor of


Esperanza, Agusan del Sur, by virtue of the powers vested in me by law, do hereby
promulgate and issue the implementing rules and regulations of Ordinance No.
241-2020, and do hereby order:

RULE I
GENERAL PROVISIONS

SECTION 1. TITLE. These Rules shall be known and called as the


“Implementing Rules and Regulations of Ordinance No. 241-2020”.

SECTION 2. PURPOSE. These Rules and Regulations are promulgated to


prescribe the procedures and guidelines for the implementation of Municipal
Ordinace No. 241-2020, in order to facilitate compliance therewith and achieve the
objectives thereof.
SECTION 3. SCOPE OF THE IMPLEMENTING RULES AND REGULATIONS.
These implementing Rules and Regulations (IRR) shall apply to any person, the
person-in-charge, manager or owner/proprietor of every business establishment,
or drivers of private vehicles, public utility vehicles/buses and other public
transportation vehicles.

SECSTION 4. INTERPRETATION. These rules and regulations shall be


construed in a manner that can achieve the primary objective of the Municipal
Ordinance No. 241-2020 which is to protect the public health and safety

RULE III
SECTION ___. MANDATORY POLICY GUIDELINES FOR GCQ. The following
shall be observed:

a. Only those aged 21 to 59 years old, who wear face masks or similar
improvised covers and who bring any government-issued or valid ID or
cedula issued by his/her respective barangay where he/she resides will be
allowed entry at any checkpoints (with mandatory checking of temperature
and other health protocols) or inside the establishments that are allowed to
open. The barangay government shall assist any family or household where
no member is qualified or capable to go out.

b. Curfew starts from 9:00 PM to 4:00 AM, except:

a. All AFP, BFP and PNP Personnel on duty;


b. National/Municipal/Barangay Officials and Employees on duty;
c. Members and Frontliners of the Municipal IATF;
d. Emergency Responders on duty;
e. Individuals seeking emergency interventions.
f. Drivers and helpers of delivery trucks passing through the
municipality;
g. Media personnel accredited by the Municipal and Provincial
Information Office.

c. Any person below twenty-one (21) years old, those who are sixty (60) years
and above, those with immunodeficiency, comorbidities, or other health
risk, and pregnant women or lactating women shall be required to remain in
their residences at all times and shall be subjected to twenty four hours (24
hrs) curfew except when:

i. Senior citizens, pregnant women, and persons with disabilities


(PWD) may be allowed to go outside their homes with one (1)
companion once a week, only for purpose of obtaining
essential goods.

ii. Seeking regular medical attention and treatment or urgent


medical check-ups. This includes going to hospitals for regular
medical treatments or urgent medical check-ups such as
dialysis, chemotheraphy, and all other urgent medical
procedures or treatments. They shall secure
Emergency/Medical Pass which may be issued by the Barangay
where they reside. Provided that persons seeking Medical Pass
shall present Original Medical Referral duly signed by his/her
attending Physician; except in urgent or emergency cases.

iii. Those 18 and above but below 21 years old, 60 years old and
above and pregnant women who have satisfactorily proven
that their presence in their workplace is unavoidable necessary
and the adoption of an Alternative Working Arrangement is
inapplicable. Work Pass may be issued to said persons,
provided they present the following to the barangay:

1. Company I.D. or any government-issued I.D., provided


that such company I.D. or government-issued I.D., has
the name, picture, and signature of the employee and/or
employer;
2. Business Permit, Professional Regulatory Commission
(PRC) I.D., Integrated Bar of the Philippines (IBP) I.D.,
Bureau of Internal Revenue Regulation, or other
appropriate documents for employees or professionals;
3. Certificate of Employment.
4. Medical Certificate issued by a Physician stating, among
others, that the Senior Citizen or Pregnant employer or
employee is fit to work;
iv. Senior Citizens who are informal workers (i.e. farmers,
fishermen, and ambulant vendors). Work Pass may be issued
by the barangay concerned if the following are presented:
1. A Certification issued by their respective Purok President
stating the personal circumstances of the person and
that the latter is a farmer, fisherman, or ambulant
vendor, and such Certification must be approved by the
Punong Barangay; and
2. Medical Certificate issued by a Physician stating, among
others, that the Senior Citizen is fit to work.

d. It is unlawful for any parent or guardian of a minor to knowingly permit or


by insufficient control allow the child to go outside of their homes during
curfew hours.

e. Mass transportation resumes but only at a reduced seating capacity to


maintain social distancing, meaning:
i. A local tricycle or “tri-sikad” can only have a maximum of two
(2) passengers to be seated one at the front and the other one
at the back.
ii. Auto rickshaw or “bajaj” can only have one (1) passenger at
each back seat.
iii. Motorcycle taxis or “habal-habal” can have two (2) passengers
to be seated each at both wngs or “katig”
iv. Public Utility Vans (PUVs) can only have a maximum of eight
(8) persons including the driver and conductor.
v. Single motorcyles can only have one (1) person (the driver)
with driver’s license and wearing a helmet.
vi. Private vehicles, Public Utility Buses (PUBs) and other public
transportation vehicles can only have a fifty percent (50%)
capacity of passengers; and drivers of PUVs/PUBs should only
utilize the main city terminal as the only drop-offs/pick-up
point. The four (4) designated bus stops shall not be used.

f. The business establishments allowed to open are the following:


i. Hospitals and laboratories;
ii. Medical and dental clinics;
iii. Birthing homes and lying-in facilities;
iv. Pharmacies and drug stores;
v. Gasoline stations, dealers and suppliers of LPG and other
petroleum products;
vi. E-loading stations/cellular shops;
vii. Funeral homes;
viii. Eatery, bakeshops and food product stores but only take-out
or delivery services;
ix. Agri-business stores;
x. ATMs and other financial institutios;
xi. Lending institutions, multi-purpose cooperatives and credit
cooperatives;
xii. Money transfer/ remittance services;
xiii. Public market
xiv. Sari-sari stores and convenience stores;
xv. Rice and corn millers;
xvi. Water refilling stations;
xvii. Vehicle/automotive services/vulcanizing shops;
xviii. All repair services and/or maintenance;
xix. Hardware and constructions supply stores;
xx. Sand and gravel suppliers;
xxi. Home improvement stores;
xxii. Glass supplies;
xxiii. Radio and other media services;
xxiv. Beauty parlor/barber shops/spa/salon (wih stricter health
protocols)
xxv. Dry goods stores or dry goods section; and
xxvi. Tailoring shops.

g. Gaming areas such as Internet Cafes/Pisonet, billiard/pool establishment,


and other leisure stores such as karaoke shops and alike are closed.

h. Mandatory application of daily infection prevention and control practices


of all public vehicles and business establishments.

i. All those business establishments allowed to open are required to put the
signage “NO FACE MASK, NO ID/CEDULA, NO ENTRY” at the entrance door
or gate or any conspicuous places in their establishments, and they shall
observe minimum health standards while beauty parlors, barber shops, spa,
salons and other personal care industries should adhere to “strict health
standards”.

j. Essential Public and Private Construction projects are allowed such as but
not limited to:

i. Sewerage projects;
ii. Water services facilities projects;
iii. Digital works;
iv. Health Facilities;
v. Priority projects;
vi. Other similar construction projects related to basic human
needs such as but not limited to food production, agriculture,
shelter necessary to address housing backlog, energy, and
communication.

construction projects conform to the provisions …
k. Vehicles carrying food and non-food items and essential goods and services
shall be allowed to pass the instituted checkpoints for the emerging
infectious disease provided that they will be subjected to disinfection
protocols and proper documentation requirements such as a
health/medical certificate, especially if the place of employment is in an area
with positive cases of the emerging infectious disease. Failure to comply the
said document will result in refusal of entry to the municipality.

m. Mass gatherings such as work assemblies, religious gatherings and alike are
prohibited.
