AN ORDINANCE PENALIZING EMPLOYERS IN THE CITY OF MANILA WHO
FAILS TO PROVIDE PERSONAL PROTECTIVE EQUIPMENT (PPE) AND
RELEVANT INFECTIOUS DISEASE PREVENTION MEASURES TO ITS
EMPLOYEES.

WHEREAS, on May 18, 2020, the Department of Labor and Employment (DOLE)
issued Labor Advisory No. 18, which ordered employers to shoulder the cost of
COVID-19 prevention and control measures in their respective workplaces, which
includes testing, and personal protective equipment (PPE);
SECTION 1. It shall be unlawful for any employer who fails to provide its employees
COVID-19 prevention and control measures such as but not limited to testing,
disinfection facilities, hand sanitizers, personal protective equipment (PPE), such as
face masks, at his own expense, and in no way shall such expense be charged
against its employees in a direct or indirect manner.
SECTION 2. The employer caught in violation of section 1 hereof shall be fined with
FIVE THOUSAND PESOS (P5000.00) and cancellation of its respective business
permit.
SECTION 3. If, for any reason or reasons, any part or provision of this Ordinance
shall be held unconstitutional or invalid, other parts or provisions hereof, which are
not affected thereby, shall continue to be in full force and effect.
SECTION 4. All ordinances, rules or regulations in conflict with the provisions of this
Ordinance are hereby repealed; PROVIDED, That the rights that are vested upon the
effectivity of this Ordinance shall not be impaired.
SECTION 4. This Ordinance shall take effect immediately upon its approval and
publication.
