TERMS AND CONDITIONS FOR OFFICE STAFF RECRUITMENT


“SERVICE AGREEMENT”

These Terms and Conditions of  Business are  between Occupoint Placements having its  office at D-
67, Ground Floor, Sector - 2, Noida 201301 and 
(“The Client”) having its office at ,
requesting  Occupoint Placements to supply Office Staff to The Client.  These conditions apply to all
business conducted between the parties relating to supplying of Staff, unless otherwise agreed in writing.

“Occupoint Placements” Consultants handles search & selection assignments under following terms &
conditions.
         Occupoint Placements will, as per the Clients request, would source, screen, shortlist and introduce
candidates, to the Client, for their manpower requirements in India.

         Occupoint Placements will present the individual’s CV through e-mail or hard copy, to the client for
their consideration .The client would in turn confirm within 7 working days if they have already received
the same individuals CV from sources other than Occupoint Placements i.e. directly or indirectly. In the
absence of any such response it will be assumed that the client accepts the individual case deemed to be
of Occupoint Placements and agrees to provide the related credits/benefits on successful joining of
individuals.

         The Client would intimate Occupoint Placements about the employment offer made to the


candidates, presented by Occupoint Placements, and their successful joining.

         Occupoint Placements considers all information received from the Client to be confidential and
would only use it on our Clients instructions to help in the selection process. At the same time, Occupoint
Placements also respects and honours confidential information provided to us by candidates.

         Payment of Professional Charges- The Client has to pay to Occupoint Placements following


professional service charges for various levels of recruitment.

All Level Positions Rs.3000 candidate
 

 
All payments will be done by crossed cheque or cash in  favour of “THE PLANNERS”
Service Tax will be extra and as applicable at the time of raising the invoice, and shall be over and above
on the aforesaid fees.
 
         Occupoint Placements will raise invoice after successful joining of the candidate.
         Invoice shall be released to Occupoint Placements within 5 (five) working days from the
date of joining of the candidate.
         There is no refund policy.
         Ninety (90) Calendar Days Replacement Clause.
 
 
 
 
         Replacement

         In case a candidate, placed by Occupoint Placements leaves the client of his/her own
within ninty (90) calendar days of his /her joining the client then Occupoint Placements would
provide the suitable 3 time replacement of such candidate for free of cost. No refund of the
payment will be made. The replacement will be carried out only if the full and final payment
for the relevant search has been cleared as per aforesaid schedule.
 
         In case a candidate placed by Occupoint Placements, is terminated by the client within
the set duration, for any reason then Occupoint Placements would not be liable for any free of
cost replacement of such candidates. Opening for such position will be treated as fresh
position and will be entitled for revenue on the same.

 
         If the candidate applies at The Client though any source and reapplies again within six months
through a different source, his application could be taken as per the first source of origin. However after
six months, the second source would be given due credit.

         The client or its subsidiaries/associates will not approach directly or indirectly any candidate
forwarded by Occupoint Placements, for current or future assignments, without written approval of
Occupoint Placements for a minimum period of one year, otherwise professional fees would be payable
as per aforesaid schedule.

         In case of Disputes, if any, all matter shall be referred to the jurisdiction of Delhi High Court by
Arbitration only.
         Term and Termination
This Agreement shall be valid for a year from the date of this agreement and will stand
automatically renewed thereafter on a year to year basis unless terminated earlier in accordance
with the provisions contained hereinafter.
The Agreement can be terminated by either Party, with or without reason by giving to the other
Party at least one month’s notice in writing in that behalf. 
No compensation or damages shall be payable by either Party in the event of such termination
but such termination shall be subject to the rights and obligations already accrued in favor or
against the Parties. Furthermore, this Agreement can be terminated without any notice period
with the mutual consent of the Parties.
