1 PURPOSE AND SCOPE

The objective of the present Technical Specification is to define the Mill Mechanical
Equipment.

Erection Works for the Bar Mill Plant that Nepal is going to construct, so that bidders may
draw up their technical and economic proposals for its erection on a FIXED LUMP SUM
PRICE.

The works described in this document, erection and commissioning activities, shall be
carried out in accordance with the stipulations described on drawings, particular
specification and technical specifications.

2 PRELIMINARY INFORMATION

Shree Steels Pvt. Ltd. is constructing a Bar Mill Plant with a nominal capacity of 2 MTPA
located in Nepal.

 For layout of the plant – Refer drawing no. 1628-101sh01r2.


 The main mill shall be installed
 Total weight of the equipment is = 1000 ton (Approx.)

Note : Maximum single piece equipment weight to be handled by erector


Stand : 20 t
Gear box : 18.5 t

3 SCOPE

3.1 Overview

The subject matter of the contract will be the erection of following according to this tender
document.

1. Mill mechanical equipment


2. Utility equipment - Pumps, Cooling Towers, pressure filters, compressors, dryers, oil
skimmer-scraper assembly, thickener, belt press filter, Booster Pumps, decaling
pumps.

Note: - The cooling towers shall be installed at (+) 7.2m lvl.

The supply of cooling tower will be in parts such as prefabricated structures, fans,
staircase, ladders, fills and walls etc. The contractor will do the erection and assembly at
cooling towers location.

1. Hydraulic, lubrication & Decaling piping with valve stands.


2. All Cranes (Refer Specification No: 1628 - U - 001)
3. Sand filling in pressure filters. ( Sand will be provided by Shree Steels Pvt. Ltd.).
4. Supervision of grouting work. ( All grouting will be done by civil.)

 Erection

Including the reception and unloading, transportation within the plot, safe transfer to
the erection place/storage area, measuring, collecting material from the Storage
area, lay out on site, pre-assemble, construction, welding wherever is necessary,
erection, quality control, adjust, fine tune, on-site testing and commissioning,
documentation and guarantees (of erection) of all equipment and materials that are
supplied by the Employer and within the scope of these documents.
The Contractor shall foresee to attend during the erection and commissioning to
modify, replace pieces, parts and equipment.
The Contractor will have sole responsibility for erection.
The Contractor shall have sole responsibility for ensuring compliance with safety
standards with regard to erection and shall bear special responsibility for complying
with all aspects of the NEPAL regulations. All aspects of these regulations and
requirements will be strictly enforced. As such, if the Contractor is not fully aware of
the requirements of these regulations, he is strongly advised to research them and
ensure he is fully conversant with and willing to comply with them.
The erection of the equipment and materials described in this document shall be
carried out in accordance with the stipulations mentioned in this document, drawings,
particular specifications and erection documents.
The Contractor shall include all the requirements set out in these Tender Documents
and any other items not specifically mentioned but which are necessary for the
construction, operation and maintenance to the satisfaction of the Employer.
No additional costs will be considered for any items which have been overlooked but
which are reasonably required for the proper and timely completion of the project in
every respect.
This section shall also include the provision of all labour, material, Contractor’s
equipment (cranes, lifting equipment, scaffolding, etc), temporary works, transport to

and from and in or about the site, and anything of a temporary or permanent nature
required in and for the construction and completion of works. This will include but not
be limited to all consumable materials, (welding rods, grinding discs, bottled gasses,
etc.) which may be required to undertake the work.
The Contractor shall be responsible for obtaining; including costs, all necessary
permits and licenses for the construction of the works within the scope of this
Specification, and to this end shall draft and sign any documents necessary for
purposes of obtaining said permits.
Notwithstanding any other clause amounts due under the documents, Contractor is to
note that his erection activities on site will be taking place at the same time as
erection activities by other contractors. Therefore, it will be Contractor’s responsibility
to advise the client in writing of his schedule of activities sufficiently in advance, so as
to enable the Client to prevent any conflict.

3.2 Main Description of Works

The scope of works shall comprise the complete erection of the equipment that are the
subject matter of these tender documents as well as the reception of materials,
unloading, safe transfer to the erection place/storage area, collecting material from the
storage area, erection, quality control, on-site testing and commissioning, documentation
and guarantees of erection.
A complete list of items within the scope of this Specification is included in the Annex x
‘Equipment Erection Scope List’.

3.3 Lump Sum Prices

The bidder shall submit a proposal based on ‘turnkey’ model, therefore the Bidder shall
foresee within the sum lump price of each system all necessary sources,
services, equipment, cranes etc to complete the work.
The Bidder shall note that the Overhead Cranes may not be available from the beginning
of the erection and therefore mobile cranes shall be foreseen within the Lump Sum Price
to comply with the master programme.
The Bidder confirms, with the sole fact of submit the proposal, that he is aware that the
subject matter of the contract is the mechanical erection of a whole Bar Mill Plant and
therefore he has included all necessary sources of whatever kind to complete the works
as customary practice.

The lump sum price for each system includes at least the following:

 Health, Safety and Environmental Documentation as required in NEPAL


regulations

- Construction H&S plan


- Risk assessment
- Method Statement
- All documentation and procedures required to complete the Project H&S File in
relation with the health, safety and environment.

 Technical Documentation necessary to carry out the erection works

- As built drawings
- Quality control according to the erection documents and NEPAL regulations

 Progress Documentation

- Weekly progress reports during erection (It shall indicates the bill of materials
erected with its sizes and weights), commissioning and starting up.

 All temporary works necessary to carry out the works in time and safely,
including, but not limited to the following:

- Temporary site water supply.


- Welfare facilities (including sewage system and toilets) for workforce in WDA.
- PPE’s
- Supervisor facilities and mess room.
- Safety and medical facilities.
- All waste disposal up to take-over of the works according to the NEPAL
regulations.
- Laydown and contractors areas, including all fencing and hard standing.
- Repair and re-instatement of all damage or deterioration to public roads or other
infrastructures.
- Any other temporary works deemed necessary by the Contractor to comply with
the site Regulations as well as NEPAL Regulations.
- Disposal of all waste material of whatever kind (including the waste material and
chemicals from any special cleaning) to an authorised and official agent as
required by NEPAL Regulations.
- Site survey and setting out, including civil works.

 Erection Works:

- Pre-assembling, loading, handling and transportation from the storing area


to the erection areas and final position of equipment and materials, including all
lifting, transport and auxiliary equipment (cranes, scaffolding, lorries, cherry-
pickers, etc.) for all equipment and material provided either by the Employer or by
the Contractor itself.
- Complete mechanical erection, assemblies and tests of all the systems to allow
the commissioning and starting up in a good working order as specification and
Employer requirements.

 Tests and adjustments:

- On site test for all equipment supplied by Contractor as well as for those provided
by
- client that are necessary to test according to erection documents.
- Tests according to erection documents. Test protocols.
- Fine tune and adjustment, calibration tests for instruments. Test protocols.
- Provision of qualified personnel to attend to the cold commissioning and hot tests.
- Providing equipment, materials and labor necessaries to correct deficiencies
found during the commissioning process.

 Painting works:

- Painting after erection of the equipment, structures or materials if required


(damaged surfaces).

 Legalisations of installations.

 Progress reports (weekly): status of the supplies and works, list of workers, daily
worked hours, updated schedule, etc.
 Documentation. As-built drawings and calculations.
 Guarantees for the erection works for 12 months after Provisional Acceptance.

All costs for these works shall be included in the price.


All works shall be carried out in such a manner so as to comply with the
regulations, standards and specifications included in this document.
All the documents to be submitted by the contractor will be developed using the
following software (Microsoft Office and AutoCAD).

3.4 Scope List

Scope List is included in Annex X.


The weights indicated in the division list are only estimated values. The Bidders shall
assume that the values may vary and this will not entitled the Contractor to claim any
extra cost.

3.5 Information to be submitted with tender

 Reference list of similar work executed along with value of order.


 List of manpower available.
 List of tools and tackles.
 List of measuring instruments.

3.6 Facilities available at site

3.6.1 Main Cranes will be available for erection

4 TENDER

The Tender shall include Technical and Commercial proposals:

Technical Proposal:

 Main description of the works per system.


 Planning: Detail Planning to comply with the dates shown in the “Basic
Erection
 Programme”, including the main tasks of the works.

Commercial Proposal:

 Lump Sum Price for following systems:


- Receipt, loading from customer store & transport to the site.
- Erection
- Grouting of equipment
- Testing
- Painting
- Commissioning of equipment

 Exclusions. If no exceptions are taken, the Contractor confirms by the fact of submit
the proposal that there are no exceptions.

Tender shall be submitted to Shree Steels Pvt. Ltd..

5 LEGISLATION, STANDARDS AND SPECIFICATIONS

5.1 Legislation

All requirements of all relevant NEPAL legislation must be met.

5.2 Standards

All the erection works shall comply with the latest revisions of first class standards
and NEPAL Regulations, as well as the Equipment Supplier Erection Manuals.

6 MAIN EQUIPMENT ERECTION BASIC PROGRAM

7 ASSEMBLY SEQUENCE AND FIRST START- UP INSTRUCTIONS

ANNEXURE I : GENERAL CONDITIONS OF CONTRACT

1. DEFINITIONS

The following terms or expressions, as used in these “General Conditions of Contract” and
in the appertaining invitation to tender specifications, shall have the meaning defined here
under:

 "CUSTOMER" shall mean and include SHREE STEELS, having their office and site
at Nepal (hereinafter referred to as the “Purchaser”) and shall include their
successors and assigns.

 “Project” shall mean the project or scheme in respect of the Purchaser’s plant at
Nepal.

 “Tenderer” shall mean the person, firm or corporation submitting a tender against the
invitation to tender and shall include his / its / their heirs, executors, administrators,
legal representatives, successors and assigns.

 “Contractor” shall mean the tenderer whose tender has been accepted and shall
include his / its / their heirs, executors, administrators, legal representatives,
successors and assigns approved by the Customer.

 “Approval of the Customer” shall mean the written approval by the Customer of a
document, a drawing or other particulars or matters in relation to the contract.

 “The Contract” shall mean and include the invitation to tender, tender specification, the
instructions to tenderers, the tender, letter of intent, acceptance of tender.
“Particulars” hereinafter defined in respect of erection, testing & commissioning of
materials and for performance of services within the scope of the construction of the
entire project and these general conditions and such special conditions that may be
added, and shall also include any agreement signed by and between the Customer
and the contractor.

 “Invitation of Tender” shall mean and / or include for the erection and starting up of
the plant or plants, or performance of service or services in connection with the
project.

 “Tender Specification” shall mean the design data, drawings, schedules, broad
equipment characteristics and other technical details furnished with the invitation to
tender for the purpose of submitting offer by the tenderer.

 “Contract Specifications” shall mean the schedules, detailed designs statements of


technical data, performance characteristics and all such particulars mentioned as
such in the contract.

 The term “Particulars” shall mean the following:

 Contract specifications.

 Drawings.

 Sealed pattern denoting a pattern sealed and signed by the Inspector.

 Proprietary make denoting the product of an individual firm.

 Any other details governing the construction, as existing for the contract.

 “Erection” shall mean the putting up under the particular contract of structures and /
or installation of equipment with all accessories supplied and will include any service
which the contractor is required to perform for the due fulfillment of his contract at the
building site with his own and / or other staff, or labor made available to him and with
the aid of his own and or other staff, labor and equipment and auxiliary materials
placed at his disposal.

 “Site” shall mean the place or places envisaged by the Customer at which the plant
and equipment supplied under the contract are to be erected and / or services are to
be performed under the contract.

 “Dimensions” shall mean the extent of a line, area and volume. They are to be based
on the metric system, i.e.,

 “Weight” shall mean the calculation of a load. It is to be stated in metric tons (1 ton
= 1000 Kgs.) and / or in Kgs. (1 Kg = 1000 grams)

 “Time” shall be reckoned by months, days and hours, the period of a month being
equivalent to the calendar month according to the Gregorian Calendar.

 “Tender Drawings” shall mean such drawings, plans, sketches and details as are
issued together with the purchaser’s tender specification for the purpose of preparing
tenders.

 “Contract Drawings” shall means the designs, plans, drawings, sketches and details
which have been supplied for the contractor for the execution of the contract and
approved by the Customer.

 “Supervision” shall mean the successive control and directions given by the customer
or his representative in relation to contract work, during the manufacture in the
contractor’s and / or his sub-contractor’s work at the site.

 “Tests” shall include all test or test made, without releasing the contractor of his
liability, as may be considered necessary by the customer or his representative, in
order to ascertain the quality and efficiency of the contract work or parts thereof and
performance of the plant equipment.

 “The Inspector” shall mean any person or agency nominated by or on behalf of the
customer to inspect the work under the contract, or his duly authorised agent.

 “work, Plant, Machinery, Equipment, Facility, Material or Stores” shall mean all or any
part of the materials, equipment. Drawings, supervision of erection and other services
required for the execution of the work which is either specifically required by the
contract or is required in connection with such services which is within the scope of
the contract and not specifically excluded by the contract from services which the
contractor is obligated to furnish under the contractor for implied from tender
specification, drawings and schedules hereto annexed or incidental thereto.

 “Schedule, Work Schedule” shall mean the accepted schedules between the
contractor and the customer forming a part of the contract.

 “Bolts” shall include nuts and washers.

2. SECURITY DEPOSIT

 The successful tenderer shall be required to deposit within two (2) weeks of the
acceptance of his tender, security deposit of 5% of the contract value in favor of the
customer in one of the following forms:

 Government securities at their market value.

 Demand draft or deposit-at-call receipt of the Bank.

 Bank guarantee from any Bank or any other established Bank acceptable to the
customer.

 The security deposit shall be for the due and faithful performance of the contract and
shall remain binding notwithstanding such variations, alterations or extensions of time as
may be made, given conceded or agreed to between the contractor and the customer
under these General Conditions or otherwise.

 The security deposit furnished by the tenderer will be subject to the terms and conditions
of the contract will not be liable for payment of the contract finally concluded between
the parties and the customer security deposit or any depreciation thereof, or in case of
Bank deposit receipt, any loss resulting on account of failure of the bank.

 The security deposit shall be refunded / Bank guarantee released on application by the
contractor after the expiry of the guarantee period and after he had discharged all his
obligations under the contract and produced a certificate from the Inspector certifying
due completion of the work and submitted a “No Demand Certificate.”

3. RESPONSIBILITY FOR PERFORMANCE OF CONTRACT

3.1 General

 The contractor is to be entirely responsible for the due performance of the contract in all
respects according to the intent and meaning of the drawings, specifications and all
other documents. Any approval which the customer / inspector may have given in
respect of the stores, materials or other particulars and the work or the workmanship
involved in the contract (whether with or without test carried out by the contractor or the
customer) shall not bind the customer and notwithstanding any approval or acceptance
given by the customer, it shall be lawful for the customer to reject the erection work
carried out by the contractor which are not in conformity with the terms & Conditions of
contract in all respects.

3.2 Sub-letting of Contract

 The contractor shall not sub-let, transfer or assign the contract or any part thereof
without the written permission of the customer. In the event of the contract contravening
this conditions, the customer shall be entitled to place the contract elsewhere on the
contractor’s account and at his risk and the contractor shall be liable for any loss or
damage which the customer may sustain in consequence or arising out of such
replacing of the contract.

 Co-operation with other contractors:

 The contractor shall co-operate with the customer’s other contractors, so that his own
work as well as the work of other contractors progress smoothly.

4. OWNERSHIP OF DRAWINGS, DOCUMENTS AND SPECIFICATIONS

All drawings, specifications, materials and designs furnished by the customer or his
authorized representatives shall be treated as strictly confidential property of the customer.
All such drawings, specifications, manuals & other materials shall be returned to the
customer upon completion of the work under this contract. No copies, duplications or
Photostats shall be retained by the contractor without the consent of the customer. All
drawings, specifications and all specific designs furnished by or through the contractor shall
be owned by the customer. An agreement w.r.t. secrecy shall be signed between the
customer & contractor.

5. CONTRACT PRICE

Price for erection, testing & commissioning shall include cost of work executed with own
tools & tackles, instruments, labor & supervisory staff etc. and incidental thereto.

6. ASSIGNING OF CLAIMS & INTEREST IN THE CONTRACT

The Contractor shall not assign his claim or interest in the contract without the written

permission of the customer.

7. PROGRESS REPORTS AND PHOTOGRAPHS

 The contractor shall submit monthly progress reports on or about the 20th day of every
month, giving the status of the contract work along with adequate number of
photographs wherever required indicating the various stages of erection at site.

 The progressive report shall include the following:

 An erection status report indicating the progress of erection giving equipment, tools and
tackle deployed by them for purpose of erection and number of personnel employed on
the work. The list of personnel shall be given under supervisory, skilled and unskilled
categories.

 The proforma for the above progress reports will be approved by the customer. The
contract shall submit five (5) copies of such reports to the customer and his authorised
representatives.

 The submission, receipt and acceptance of such progress reports shall not prejudice the
rights of the customer under the contract, nor shall operate as an estoppel against the
customers merely by reason of the fact that he has not taken notice of or subjected to
test any information contained in such reports.

8. EXECUTION OF CONTRACTS FOR ERECTION

 The erection of plant and equipment supplied by others under the contract shall be
carried out by the contractor. The contractor shall be solely responsible for the
satisfactory erection, start-up, testing and commissioning of the plant and equipment.

 The contractor shall so arrange his work that the contract work affected by him shall be in
satisfactory working order and ready for commissioning at the stipulated time and shall
be coordinated in every respect with the work of other contractors in consultation with the
customer so that a continuous progress of the general contract work is ensured.

9. WORKS AND SERVICES TO BE PROVIDED BY THE CUSTOMER

 For the due performance and completion of the contract, unless otherwise agreed upon,
the following and services will be provided free of cost to the contractor by the customer
to the extent available for carrying out the complete erection of the plant equipment
covered under the contract. The contractor shall not, however take a plea under any

circumstances that the absence of facilities have hampered the progress of work
entrusted to the contractor.

 A sufficiency large open storage area on the site within a reasonable distance from the
respective erection site.

 Sufficient area at site for construction of site office and stores as per requirement.

 The customer will hand over the site in proper condition.

 Electric Power will be provided at 400V +/-10%, 60 Hz +/-2%, 3 Ph at one point at


respective erection site free of cost. Within a month of signing of the contract, the
contractor shall intimate to the customer his demand for power indicating the phased
requirements.

 The contractor shall be responsible to provide and maintain the complete installation on
the load side of the supply with due regard to safety requirements at site. All cabling
equipment, installations etc. shall comply in all respects with the appropriate statutory
requirements and safety provisions given in the State Electricity Board Rules, as
amended from time to time and shall be subjected to the approval of the customer. The
contractor shall ensure that his equipment and electrical wiring etc. are installed, modified
and maintained by a licensed electrical supervisor. Before power is supplied by the
customer, the contractor shall furnish a test certificate for these installations to the
purchaser for his approval.

 The customer reserves the right to disconnect the power supply installation at any stage
if the same do not conform to the rules and regulations outlined above. No claim shall be
entertained by the Purchaser for such disconnection. Supply will be reconnected only
after removal of the fault to the satisfaction of the customer.

 Though efforts will be made by the customer to maintain regular power supply, the
customer will not be liable for any loss or damage to the Contractor’s equipment with the
result of variation in voltage or frequency or interruption of power supply or any other loss
to the contractor from the Contractor’s bill.

 In case of damage to any of the customer’s equipment on account of fault, intentional or


unintentional on the part of the contractor, the customer reserves the right to recover the
cost of such damages determined by the customer from the Contractor’s bill.

 After completion of work, the contractor shall promptly dismantle at his own cost the
distribution and other facilities he may have erected and shall also remove the same

within a reasonable time fixed by the customer, and on his failure to do so, the customer
will be entitled to remove them at the cost of the contractor and to realise from his
reasonable compensation fixed by the customer. In the absence of suitable meters for
measurement of power, the customer will determine the power consumption taking the
period of consumption as decided by the customer shall be final and binding on the
contractor.

10. OBLIGATIONS OF THE CONTRACTOR

 The erection of the plant and equipment under the contract shall be carried out by the
contractor. The contractor shall be responsible for the satisfactory erection, testing and
commissioning of the plant and equipment.

 Unloading the equipment from rail or road transport and move those to the storage area
and / or erection site in so far as such transportation wherever specially mentioned in
scope of work within the responsibility of the contractor.

 Advising the purchaser as to the correct process of loading, unloading and reloading and
transport of plant and equipment, erection and tools and tackle in so far as the same are
within the responsibility of the customer.

 Opening of packing cases, inspecting and checking of materials and repair and
replacement of contract materials damaged or lost in transit or at site.

 Final adjustment of foundation levels by chipping and dressing, checking locations,


elevations etc. of anchor bolts, certifying for grouting of anchor bolts and base plates and
carrying out minor civil works as may be required in connection with the erection work.

 Applying approved final painting to all equipment, piping, hangers, structures etc.
supplied and erected under the contract and any touching up of painting wherever
required.

 Providing all consumable materials and stores required for the work, unless otherwise
provided in the contract.

 Providing all ladders, platforms, supports and other necessary facilities required of
handling, erection and inspection of the equipment supplied under the contract.

 Unless otherwise provided in the contract, providing all construction equipment, welding
equipment, erection tools, lifting tackle, instruments and appliances required for the work.
The contractor shall submit to the purchaser a list of such equipment including tools,

tackle and instruments he will use for the work. The tools, tackle and other items
provided by the contractor shall be solely used for purpose of the contract work and shall
not be taken away while they are required at the site for the erection work.

 Erecting and maintaining necessary site offices and covered storages as required, and
arranging for maintaining in a neat manner including drainage of the area placed at the
contractor’s disposal as well as for proper supervision of the erection site and living
quarters. The contractor shall at all times provide sufficient fencing, notice boards and
lights to protect and warn others as may be considered necessary by the purchaser. All
irremovable property included fixtures erected or acquired by the contractor for carrying
out the erection of the plant or in connection thereof shall become the property of the
purchaser without any further payment as soon as the contractor has completed his
work.

 Providing watch and ward to ensure security and safety.

11. MAINTENANCE AFTER PRELIMINARY ACCEPTANCE

 The contractor shall be responsible within the framework of the erection contract for the
maintenance of all units of the plant upped a period of one month after preliminary
acceptance. The number of personnel to be retained during this period and the time for
which they may have to stay on and this period will be settled by mutual consultation
between the customer and the contractor and the cost of such personnel shall be paid
according to the tariff rates and allowances to be mutually agreed upon.

12. CONTRACTOR’S REPRESENTATIVE

 The order to carry out his responsibilities the contractor shall employ competent
representative / s whose names shall previously have been communicated in writing by
the contractor to the customer to superintend the erection work. The said representative
/ s shall be present at site during working hours and any written instructions that the
customer or his authorized representatives may give the said representative / s of the
contractor shall be deemed to have been given to the contractor.

 The contractor shall ensure that each individual of the contractor’s personnel at site shall
co-operate with the customer and any and all other agencies engaged in the failure to
extend such co-operation for misconduct or incompetence or negligence shall be
sufficient cause for removal of such individual by the contractor forthwith upon request by

the customer. In such cases, the contractor shall provide immediately competent
personnel to replace such individuals at the contractor’s own cost. In case of
disagreement as to the cause of such removal the decision of the customer shall be final.

 The contractor’s representatives shall be made available for such period as the customer
may require and they shall work at all reasonable times as may be necessary to
complete the work within the period specified in the contract.

 During the execution of the work, no personnel other than the contractor or his duly
appointed representatives, sub-contractors and workmen, shall be allowed to do work at
site except by the special permission in writing of the purchase or his authorized
representatives. The contractor shall not object to the execution of the work by other
agencies and shall afford them every difficulty for the execution of their several works
simultaneously with his own. The work so far as it is carried out in the customer’s
premises, shall be carried out at such times as the customer may approve and so as not
to interface unnecessarily with the conduct of the customer’s business. The purchase
shall give the contractor all reasonable facilities for carrying out his work. The contractor
shall be liable for such accidents as may be due to the negligence on his part in
accordance with Nepal Laws and Regulations.

13. PROGRAMME OF WORK AND PROGRESS REPORTS

 The contractor shall submit at such times as may be required by the customer or his
authorized representatives the programmes and order in which the contractor proposes
to carry out the work with the dates and estimated completion times for various parts of
the work. In this connection, the contractor shall submit critical path network diagrams
for the working. Such schedules and networks shall be within the overall schedule of
completion of erection of plant and are to be approved by the customer may not allow the
contractor to start work for non-submission of the above charts.

 During the progress of the work, the contractor shall furnish the customer with regular
progress reports and such other reports on the erection work and organization including
feedback information for updating / revising the critical path networks as may be required
by the customer or his authorized representatives.

14. GENERAL SUPERVISION BY THE CUSTOMER AND CO-ORDINATION

 All the work shall be carried out under the general supervision and to the satisfaction of
the customer or his authorized representatives. The contractor shall be responsible for
the correctness of the positions, levels and dimensions of the work according to the
drawings etc. notwithstanding that he may have been assisted by the customer or his
authorized representatives in setting out the same.

 The contractor shall at all times work in co-ordination with the customer and his
authorized representatives. In respect of observance of local rules, administrative
matters, co-ordination with other contractor and his personnel shall work under the
ordination of the customer.

15. PAYMENT OF TAXES

 The contractor shall pay all taxes due for the personnel employed by the contractor for
work arising out of their services in connection with the contract.

16. PENALTY AND WITHHOLDING PAYMENT

 The time allowed for completion of erection as stated in the contract shall be reckoned
from the day on which the contractor is given possession of the site for erection, which
will be intimated to him in writing by the purchaser. The works shall not be considered
finished until the purchaser has issued a certificate to that effect. In the event of the
contractor failing to complete the work within the contract period, he shall be liable for
liquidated damages as per General Condition of Contract.

 The purchaser may withhold the whole or part payment for erection claimed by the
contractor, which in the opinion of the purchaser, is necessary to protect himself from
loss on account of defective work not remedied or guarantees not met, claimed filed
against the contractor, failure by the contractor to make due payment for materials for
labour employed by him, damage to another contractor and so on. When grounds for
withholding payments are removed to the satisfaction of the purchaser, payments of the
amount due to the contractor will be made by the customer without delay.

 Final payment to the contractor shall not be made until the contractor delivers to the
customer a complete release of all liens arising on the contract or receipts in full lien
thereof, and in either case, an affidavit that so far as he has knowledge or information,
the release and receipts include all materials and labour for which a lien could be filed. If

any lien remains after all payments are made, the contractor shall refund to the customer
all money that the latter may be compelled to pay in discharging such lien, including all
costs and a reasonable attorney’s fee.

17. RIGHT TO TAKE OVER

 The customer shall have the right to take possession or use any completed or partially
completed part of the work. Such possessions or use shall not be deemed to an
acceptance of any work in accordance with the contract.

18. STATUTORY AND OTHER REGULATIONS

 Explosives shall not be used on the work by the contractor without the permission in
writing of the customer and then only in the manner and to the extent to which he has
prescribed. Where explosives are used the same shall be stored in a special magazine
to be provided by and at the cost of the contractor who shall be liable for all damages,
loss or injury to any person or property and shall be responsible for complying with all
statutory obligations in these respects.

 The contractor shall be liable for or in respect of any damages or compensation payable
at law in respect of in consequence of any accident or injury to any workman or other
person in the employment of the contractor or any sub-contractor save and except an
accident or injury resulting from any act or default of the customer and the contractor
shall indemnify and keep indemnified the purchaser against all such damages and
compensation (save and except as aforesaid) and against all claims, demands,
proceedings, costs, charges and expenses, whatsoever, in respect thereof or in relation
thereto. The contractor in all times indemnify the customer against all claims for
compensation under the provision of the workmen’s compensation Act or any other law
for the time being in force by or in respect of, any workman employed by the contractor in
carrying out the contract and against all costs and expenses incurred by the customer in
connection therewith and (without prejudice to any other means of recovery) the
customer shall be entitled to deduct from any money due or to become due to the
contractor (whether under this contract or any other contract) all moneys paid or payable
by the customer by way of compensation aforesaid and / or for cost or expenses in
connection with any claim thereto, and the contractor shall abide by the decision of the
customer as to the sum payable by the contractor under the provision of this clause.

 The contractor shall give all notices and pay all fees required to be given or paid under
central or state statute, ordinance or other law or any regulation or by-law of any local or
other duly constituted authority in relation to the execution of the works or of any
temporary works and by the rules and regulations of all public bodies whose property or
right are affected or may be affected in any way by the works or may temporary works.

 The contractor shall confirm in all respects with the provisions of any statute, ordinance
or laws as aforesaid and the rules, regulations or by-laws of any local or other duly
constituted authority which may be applicable to the works or to any temporary works
with such rules and regulations of public bodies as aforesaid and shall keep the
purchaser indemnified against all penalties and liabilities of every kind for breach for any
such statute, ordinance, law, rule, regulation or by-law.

 All fossils, coins, articles of value of antiquity and structures and other remains or things
of geological interest discovered on the site of the works shall be between the customer
and the contractor be deemed to be absolute property of the customer and the contractor
shall take reasonable precautions to prevent his workman or any other persons from
removing or damaging any such article or thing and shall immediately upon discovery
thereof and before removal acquaint the customer’s representative of such discovery and
carryout at the expense of the customer as to the disposal, removal or otherwise of the
same.

 Except where otherwise specified, the contractor shall pay all tollage and other royalties,
rent and other payments or compensation (if any) for getting stone, sand gravel, clay, or
other materials required for the works or temporary works or any of them.

 In respect of all labor directly or indirectly employed on the works, the contractor shall
comply with all rules framed from time to time by Government or other local authority
and legislation governing labor for the protection of health, sanitary arrangements,
wages, welfare and safety of workers in building and construction works. The rules and
other statutory obligations in regard to fair wages, the welfare measure and safety of
labor etc. will be deemed to be party of the contract.

 The contractor shall if required by the customer deliver to the customer a return in detail
in such form and at such intervals as the customer may prescribe showing the number of
the several classes of labor from time to time employed by the contractor.

 All operations necessary for the execution of the works and for the construction of any
temporary work shall, so far as compliance with the requirements of the contract permits,

be carried on so as not to interfere unnecessarily or improperly with the public


convenience or the access to use and occupation of public or private roads and foot
paths or of properties whether in the possession of the purchaser or of any other person
and the contractor shall save harmless and indemnify the customer in respect of all
claims, demand, proceedings, damages, costs, charges and expenses whatsoever
arising out of or in relation to any such matters.

 The contractor shall use every reasonable means to prevent any of the highway and
bridges communicating with or on the routes to the site from being damaged or injured by
any traffic of the contractor or any of his sub-contractors and in particular shall select
routes, choose and use vehicles and restrict and distribute loads so that any such extra
ordinary traffic as will inevitably arise from the moving of the plant and material from and
to the site shall be limited as far as reasonably possible so that no unnecessary damage
or injury may be occasioned to such highways and bridges. For any damage caused to
the bridge hereof, the contractor shall be solely responsible.

 Where the nature of the work is such as to require the use by the contractor of water
borne transport the forgoing provisions of this clause shall be constructed as through
“highways” included a lock, dock, sea wall or other structure related to a waterway and
“vehicles” included craft and shall have effect accordingly

 On the completion of the work all rubbish, debris, kilns, vats, tanks, materials, and
temporary structures of any sort of kind used for the purpose of or connected with its
constructions are to be removed by the contractor and all pits and excavations filled up
and the site handed-over in a tidy and workman like conditions and no final payments in
settlement of the accounts for the said work shall be held to be due or shall be made to
the contractor till such site clearance shall have been effected by him and such clearance
may be made by the purchase at the expense of the contractor in the event of his failure
to comply with this provision within seven days after receiving notice in writing from the
customer to have the site cleared as indicated above, at the expense of the contractor,
the customer shall under no circumstances be held liable for any losses or damages to
such of the contractor’s property as, may be on such site due to such removal therefrom,
when removal may be affected by means of public sale of such materials and property or
in such way seems fit and most convenient to the customer.

 The contract shall be responsible for the safety of his workmen and employees. All
accidents to them on construction are to be immediately reported to the required
authorities. The contractor shall be responsible that all such accidents, however, and

wherever occurring on his works are reported without delay to the customer and the
customer will provide necessary assistance that may be required to the best of his ability.

 The contractor shall comply with the provisions of the payment of Wages Act and the
rules made thereunder in respect of all employees employed by him in carrying out this
contract as he himself and not the customer, is responsible under the said act for the
compliance thereof.

 The use of sale of ardent spirits or other intoxicating beverages upon the work, or in any
of the buildings, boarding houses, encampments, or other tenements owned occupied by
or within the control of the contractor or any of his employees, is strictly forbidden and the
contractor shall exercise his influence and authority to the utmost extent to compliance
with this conditions.

 The contractor must take sufficient care in moving his construction plant and equipment
from one to another so that they may not cause any damage to the property of the
customer, particularly to the overhead and underground cables and in the event of his
failure to do so, the cost of such damages including eventual loss of working hours in any
plant as estimated by the purchaser is to be borne by the contractor.

 The contractor shall not in the performance of the contract work in any manner endanger
the safety or unlawfully interfere with the convenience of the public.

19. DUE DATES OF PAYMENT

 Payments shall be due and payable by the customer within a responsible period which
will not normally exceed one month from the date of the receipt of each invoice by him
supported by requisite certificates issued by the customer / his agent.

20. DEDUCTION FROM CONTRACT PRICE

 The customer shall be entitled to recover all costs, charges, damages or expenses which
the customer may have paid, for which under the contract, the contractor is liable, by
appropriating in part or whole, the security deposited by the contractor. In the event of
the security being insufficient then the balance shall be deducted from any sum then due
or which at any time thereafter may become due to the contractor under this or any other
contract with the customer. Should this sum, be not sufficient to cover the full amount
recoverable, the contractor shall pay to the customer on demand the remaining balance
due.

21. LIQUIDATED DAMAGES FOR LATE DELIVERY AND ERECTION

 Time and date stipulated in the contract for completion of the work shall be deemed to be
the essence of the contract. If the contractor fails in the due performance of his contract
to deliver complete the erection within the time fixed by the contractor or any extension
thereof and / or fulfill his obligations in time under the Agreement, he shall be liable to as
agreed liquidated damage, and not by way of penalty, a sum, of one percent of the
contract value per ½ month or part thereof by which the erection has been delayed. The
contractor’s liability for the delay in erection shall not, in any case, exceed 5% of the
contract value.

 If the contractor shall fail to complete erection within one month of the expiry of the
appointed time or extended time as may be provided for in the contract and after the
maximum penalty shall be operated.

 The above shall not, apply if the delay in delivery or erection is due to causes beyond
and control of the contractor, such as acts of God, war, enemy action, embargoes,
blockages, fires, floods, civil commotion, riots and strikes.

22. NEGLIGENCE

 If the contractor shall neglect to execute the work with due diligence or expedition or shall
refuse or neglect to comply with any reasonable orders given to him in writing by the
customer in connection with the work, or shall contravene the provisions of the contract,
the purchaser may give notice in writing to the contractor calling upon him to make good
the failure, neglect or contravention complained of within such time as may be deemed
reasonable and in default of the compliance with the said, notice, the customer without
prejudice to his rights may cancel the contract, holding the contractor liable for the
damages that purchaser may sustain in this behalf.

 Should the contractor fail to comply with such notice within a reasonable period from the
date of serving thereof, the cause of failure, neglect or contravention capable of being
made good within that time or otherwise within such time as may be reasonably
necessary for the same making good, then and in such case without prejudice to the
customer’s right, the customer shall have the option and he is at liberty to take the work
wholly or in part out of the contractor’s hands and ma shall have the option and he is at
liberty to take the work wholly or in part out of the contractor’s hands and may complete
the work envisaged in the contract either departmentally or may reconstruct at a

reasonable price with any other person or persons to execute the same or any part
thereof and provide other materials, tools, tackle or labor for the purpose of completing
the work or any part thereof.

 In such event the customer shall, without being responsible to the contractor for fair wear
and tear of the same, be entitled to seize and take possession and have free use of al
materials, tools, tackle, or other things which may be on the site for use at any time in
connection with the work to the exclusion of any right of the contractor over the same and
the purchaser shall be entitled to retain and apply any balance sum which part thereof as
may be necessary, to the payment of the cost of execution of such work as aforesaid.

 If the cost of executing the work as aforesaid shall exceed the balance due to the
contractor and the contractor fails to make good the deficit, the said materials, tools,
tackle, construction plant or other things, the property of the contractor as may not have
been used up in the completion of the works, may be sold by the purchaser and the
proceeds applied towards the payment of such difference and the cost of and incidental
to such sale. Any outstanding balance existing after crediting the proceeds of such sale
shall be paid by the contractor on the certificate of the purchaser, but when all expenses,
cost and charges incurred in the completion of the work are paid by the contractor, all
such materials, tools, tackle, construction plant or other things not used in the completion
of the works and remaining unsold shall be removed by the contractor.

 CONSTRUCTION OF CONTRACT

 The contractor shall be governed by the laws in NEPAL

 This contract and the Article thereof shall be interpreted and applied solely according to
their wording. This contract shall in all respects be constructed and operated as a
contract as defined in the Contract Act, and save as otherwise expressly provided herein
shall be governed by the provisions of the said Act.

23. TIME FOR COMPLETION AND FORCE MAJEURE

 The time stipulated for erection or completion as the case may be, dates from the day the
contractor receives the purchaser’s letter of acceptance or from any other date
specifically stipulated in the contract. Should progress or delivery be delayed by strikes,
lockouts, fire accidents, delay in approval of drawings, or any cause whatsoever beyond
the reasonable control of the contractor and whether such delay or impediment occurs

before or after the time or extended time for dispatch or completion as the case may be,
a reasonable extension of time shall be granted. Should one or both parties be prevented
from fulfilling their contractual obligations by a state of force majeure lasting continuously
for a period of at least 6 months, the two parties should consult each other regarding the
further implementation of the contract with the provision that if no mutually satisfactory
arrangement is arrived at within a period of 3 months from the expiry of 6 months referred
to above the contract shall be deemed to have expired at the end of the said 3 months
referred to above. The above mentioned expiry of the contract will imply that both the
parties have the obligation to reach an agreement regarding the winding up and financial
settlement of the contract.

24. RIGHTS OF THE PURCHASER TO VARY, SUSPEND OR CANCEL THE CONTRACT

 The customer shall have the power to vary or alter the extent, scope and / or technical
character of the work under the contract and the contractor shall be bound thereby as if
the same occurred in the contract specifications.

 Any amount to be allowed in respect of any variation or alteration of the contract work
effected by the customer under this Article shall be added to or deducted from the
contract price as the case may be.

 If any additional work or variation of work caused by the customer necessitates an


alternation of delivery time, the customer shall allow such extension of time as may be
reasonably required by the contractor to complete such additional or modified work.

 The customer may at any time temporarily stop the work under the contract or any part
thereof by notice in writing to the contractor. All work so stopped shall be resumed by the
contractor based on a schedule to be mutually agreed upon between the customer and
the contractor.

 The customer will not pay the contractor for any work covered by the suspension which is
performed during such an interval of suspension, and the customer will not be liable to
the contractor for any damages or loss caused by such a suspension work.

 The customer shall have further power to cancel the contract if the contractor fails to duly
perform and complete the contract or if it appears, for valid reason that he will fail to fulfill
his obligations under the contract for reasons other than those relieving him from his
responsibility under any other provisions of this contract. In such event, without prejudice
to any claims under this contract of the customer, there shall be an equitable settlement
of the obligations arising out of this contract.

25. ARBITRATION

 If any time any question, dispute or difference whatsoever shall arise between the
customer and the contractor upon, or in relation to, or in connection with the contract,
either party may forthwith give to the other, notice in writing of the existence of such
question, dispute or difference, and the same shall be referred to the adjudication of two
arbitrators, one to be nominated by the customer and the other to be nominated by the
contractor, or in the case of the said arbitrators not agreeable, then to the adjudication of
an Umpire to be appointed by the arbitrators or of the Umpire appointed by them in the
event of their not agreeing shall be final and binding on the parties and the provision of
the Arbitration Act and of the rules thereunder and any statutory modification thereof shall
be deemed to apply to and be appointed in this contract.

 Work under the contract shall be continued by the contractor during the arbitration
proceedings, unless otherwise directed in writing by the customer or unless the matter is
such the decision of the arbitrators of the Umpire, as the case may be, is obtained and
save as those which are otherwise expressly provided in the contract, no payment due
payable by the customer shall be with held on account of such arbitration proceedings,
unless it is the subject matters or one of the subject matters thereof.

 The venue of the arbitration shall be the place / office from which “Acceptance if Tender
is issued or such other place”, the customer at his discretion may determine.

26. NON-WAIVER OFF DEFAULTS

 Failure of the customer to insist upon strict performance of any terms and conditions of
the contract will not be deemed a waiver of any rights or remedies that the customer may
have and will not be deemed a waiver of any subsequent default under the terms and
conditions of the contract. No right or remedy of the customer will be exclusive of any
other right or remedy and the customer will have all rights and remedies given under the
contract. Receiving of payment from the customer for the plant under this contract will
not be deemed a waiver of the right for any prior failure by the contractor to comply with
any of the provision of the contract.

27. GENERAL DIRECTION OF WORK

The contractor shall normally obtain instructions for carrying out the work pertaining to the
contract from the customer.

ANNEXURE II : SPECIAL CONDITIONS OF CONTRACT


1. GENERAL

The Special Conditions of Contract shall be read in conjunction with the drawings, General
Conditions of Contract, Specifications, Schedule of work and / or other supplementary
documents detailing the work.

Provided that where any provision of the General Conditions of Contract is repugnant to or at
variance, unless a different intention appears, the provision of the Special Conditions of
Contract shall be deemed to override the provision of the General Conditions of Contract and
shall to the extent of such repugnance or variation prevail.

2. WORK & SERVICES TO BE PROVIDED BY THE PURCHASER

 Water

Water required for the work will be made available to the Contractor free of cost at one
point within the plant site. Necessary temporary storage facilities for water sufficient for
at least two days' requirements shall be provided by the Contractor at his cost. The
Contractor shall make his own arrangements for drawing water from this point and
further distribution at his own cost with the approval of the Consulting Engineers.

 Power

Electric power will be supplied to the Contractor free of cost at one point at the plant site
400V +/-10%, 60 Hz +/-2%, 3 Ph, A.C. supply, for the purposes of minor fabrication
incidental to erection work and lighting only. Further distribution, installation of
switchboard, necessary connections etc., shall be arranged by the Contractor at his own
cost. All the electric installations together with wiring installed by the Contractor shall be
removed by him on completion of work. He shall reinstate and make good any work
disturbed by the temporary power lines to the satisfaction of the Purchaser.

 Roads

The Contractor shall provide and maintain at his own cost all necessary temporary minor
roads if required for his work / worker's hutment's etc. All major roads have already been
constructed by Purchaser

3. CONSTRUCTION STORE & EQUIPMENT

Suitable areas near the site of work will be allocated to the Contractor for storing his
equipment, plant, materials etc. He will however be solely responsible for watching and
guarding his property and materials.

The Contractor shall make his own arrangements to procure all constructional plant,
equipment and tools necessary for his work. All materials, construction plants, tools and
equipment etc., once brought by the Contractor on the site are not to be removed from there
without the written authority from the Purchaser. The Contractor shall also have adequate
stock of spare parts for the equipment on the site and work shall not be delayed on this
account. Similarly, all enabling works built by the Contractor for the main construction
undertaken by him, are not to be dismantled and removed without the written authority from
the Purchaser.

4. LABOUR & SUPERVISORY CAMP

A site will be indicated to the Contractor for constructing temporary hutments for his laborers,
who will not be allowed to reside at any other site in the Purchaser's property. The
Contractor shall include in his rates the cost of construction, maintenance and removal of
such temporary accommodation for the laborers and also suitable water supply
arrangements therefor. The construction of the temporary accommodation shall be on the
lines approved by the Consulting Engineers.

The Contractor shall provide at his own cost adequate closet and sanitary accommodation
for workers employed on the site, in accordance with the rules and regulations of Local
Authorities or Public Bodies. The lavatories and sanitary accommodation shall always be
maintained in good sanitary, working and disinfected conditions.

5. DRAWINGS FOR TEMPORARY WORKS

The Contractor shall submit to the Consulting Engineers in triplicate drawing of all temporary
buildings, pipe lines, power lines, offices, stores and such other works he proposes to
construct with particulars of materials of construction and other details for his approval before
commencing the site work. Approval of the Consulting Engineers of all or any of the
drawings shall not in any way relieve the Contractor of his responsibilities.

6. WORK AND SERVICES TO BE PROVIDED BY THE CONTRACTOR

The following major items of work and services shall be included in the works to be provided
by the Contractor:

1) Provision of all erection tools and tackle and sundry equipment required by the
erection personnel.

2) All skilled and unskilled labor under direct supervision of one or more supervisors.
The Contractor however shall not employ persons below the age limit prescribed by
the local law.

3) A site representative authorized to act on behalf of the Contractor.

4) Arrangements to draw electricity and water from the selected locations indicated by
the Purchaser at the site of erection.

5) All consumable materials for erection, welding, gas cutting, jointing, riveting etc.

6) All ladders, platforms, temporary supports, scaffolding etc. required for the erection.

7) Any other facilities required to carry out the work stipulated in the contract.

7. AUTHORISED AGENT

If the headquarters of the Contractor is elsewhere than the town nearest to Construction site,
the shall have duly authorized agent there from the commencement of the work until
completion of the work. Such agent shall be authorized to act on behalf of the Contractor, to
accept services of notice under the Contract and to agree to extras, omissions and varied
items of work and rates for the same. Such agent shall maintain on his staff a qualified
engineer and such other personnel as may be required for the efficient execution of the work.
Any notice under the contract shall be deemed to have been served on the Contractor if
served upon such agent or sent by registered letter to his address. Such agent shall not
leave the town during the currency of the Contract unless the consent of the Purchaser shall
have been previously obtained. If the Consulting Engineer / Purchaser shall require the
Contractor to carry out any rectifications under the terms of Contract after the work is
complete, the Contractor shall send the same or another duly authorized agent to the town
when such rectifications are being carried out.

The successful tenderer shall send a duly authorized competent representative to meet the
Consulting Engineers at Construction site, whenever called upon in writing to do so by the

Consulting Engineers and any instructions, directions or explanations given by the Consulting
Engineers to such representative shall be held to have been given to the Contractor.

8. SAFETY

The Contractor shall be responsible for provision of safety arrangements and protective
clothing for all operatives on the site whether or not engaged in actual operation or
supervision. The Contractor shall also be responsible for safety arrangements of all
equipment used for erection and shall employ trained workmen conversant with safety
regulations. The Contractor shall use only tested equipment and tools and shall periodically
renew tests to the satisfaction of the Consulting Engineers. All test certificates shall be made
available to the Consulting Engineers at the site of the work. If at any time, in the opinion of
the Consulting Engineers, this provision is not complied with, the Contractor shall forthwith
replace such equipment and tools.

The Contractor shall display notices and arrange proper fencing at such places where
hazardous work is being carried out. The Contractor shall provide at his own expense on the
works to the satisfaction of the Consulting Engineers at such places, proper and sufficient
firefighting, first aid appliances etc. which shall at all times be available for use.

9. CLEARANCE OF SITE ON COMPLETION

On completion of the works, the Contractor shall clear away and remove from site all
construction plant surplus material, rubbish and temporary works of very kind and leave the
whole of the site and works clean to the satisfaction of the Purchaser.

10. RETURN OF SURPLUS MATERIALS

Notwithstanding anything contained to the Contrary anywhere in this Contract wherever any
materials for the execution of the Contract are procured with the assistance of the Purchaser
either by issue from Purchaser's stocks or purchase made under orders or permits of
licenses issued by the Purchaser, the Contractor shall use the said material economically
and solely for the purpose of the Contract and not dispose of them without the permission of
the Purchaser and shall return to the Purchaser all surplus and unserviceable materials left
over after the completion of the contract. In the event of breach of the aforesaid condition,
the Contractor shall be liable to the Purchaser all moneys, advantages or profits resulting or
which in the usual course would have resulted to him by reason of such breach.

11. RIGHT TO TAKE OVER

The Purchaser shall have the right to take possession of or use any completed or partially
completed part of the work. Such possession or use shall not be deemed to be an
acceptance of any work in accordance with the Contract.

12. CO-OPERATION WITH OTHER CONTRACTORS

The Contractor shall execute his work in phased manner as directed by the Consulting
Engineers / Purchaser from time to time so as not to obstruct or retard the work being
executed simultaneously by other agencies.

13. PROGRAMME OF WORK

The Contractor shall schedule his work to meet the specified targets and ensure that
drawings, materials, equipment and services required from others are requisitioned well in
advance of the requirement at any site, so as to meet the demands of the erection schedule.
Delays which may affect the progress of the work shall be brought immediately to the notice
of the Consulting Engineers / Purchaser in writing. The Contractor shall reschedule the work
and / or perform overtime work at his own cost as may be necessary to meet the required
construction programme.

14. CONSTRUCTION SCHEDULE AND PROGRESS REPORT

Time is the essence of the Contract. The Contractor shall complete the whole of the work to
the satisfaction of the Consulting Engineers within Three (3) months from the issue of the
Letter of Intent / any other such period specified therein. The Contractor shall undertake the
work according to further priorities indicated by the Consulting Engineers from time to time
and shall complete the same as per time schedule fixed by the Consulting Engineers.

The Contractor shall submit at such times as may be requested by the Consulting Engineers,
schedules showing the program and order in which the Contractor proposes to carry out the
work with dates and estimated completion times for various parts of the work. Such
schedules shall be prepared in consultation with the Consulting Engineers and shall be
approved by the Consulting Engineers.

During the progress of the work, the Contractor shall furnish the Consulting Engineers with
fortnightly progress reports and such other reports on the erection work and organization as
the Consulting Engineers may require.

Throughout this contract, the words "Project Manager of the Purchaser" shall replace the
words "Consulting Engineers" in case it is so desired by the Consulting Engineers /

ANNEXURE VIII : GROUTING OF EQUIPMENTS

Only Non-Shrink grout mix is recommended to be used. Readymade mixes are preferred due to
the reliability offered by factory controlled mixing of correctly selected ingredients. Water to
cement ratio and other instructions as advised by manufacturers must be adhered to during the
use. The grout eliminates the shrinkage problem associated with conventional cement grouts and
ensures effective contact and support. The grout develops rapid strength and relatively higher
ultimate strength.

Important Notes on use:-

1. Surface Preparation

Foundation surface must be clean and reasonably rough. All surface laitance and unsound
concrete must be chipped away so that strong sound surface is provided. All surfaces must be
free from oil, grease and dust, this particularly applies to underside of bed plates, bolts, pipes or
other materials which may have surface contact with the grout. After cleaning, saturate the
concrete surface with clean water. Ensure that no free standing water is present on the surface
of foundations or in bolt holes before grouting.

2. Mixing

Add clean water to Non-Shrink grout-mix in Water / Powder ratio recommended by the
manufacturer. Use as little water as is required for ease of placement within the range specified.

Job placement conditions, including ambient temperature and water temperature may require
adjustments for practical purposes, therefore small trial batches to ascertain the best working
consistency for the grouting operation are recommended. Technical services of manufacturer’s
representative during the initial use can be very helpful.

3. Mixing Equipment

Use mechanical mixer. Hand mixing rarely achieves the desired result, so it should be adopted
only for light duty. Thorough mixing is essential for achieving good results. Mixing time should
be as recommended by manufacturers (generally ~ 5 minutes).

4. Pouring the Grouting

The mortar must be rodded into restrained sections and packed by trowel, tamping by hardwood
tools. Where large volume has to be placed, the mortar can be pumped by using a heavy duty
diaphragm pump.

5. Curing

After the initial hardening of the grout between 3-5 hours depending upon the temperature and
humidity conditions, all exposed surfaces must be cured by water application or under wet
hessian for a minimum period of 10 days (21 days curing preferred).

required at the time of erection of equipment in adequate nos. of 2 ton – 10 ton capacity

5 Adequate no. of Winch with required capacity shall be supplied by the Contractor’s for
erection of equipment.

6 Adequate no. of all necessary cutting set required including grinding machine, angle
grinding machine, straight grinding machine etc. required for erection shall be supplied
by the contractor.

7 Adequate no. of all tools and tackles are in contractor’s scope required for erection shall
be supplied by the contractors.

8 Adequate no’s of Jacks of 10 – 100 tone capacity of 25mm, 5mm & 100mm height and
apart from these regular higher capacity jacks of 100-200 ton capacity with max. Puller
of 5 – 10 ton capacity.

9 Slag Scanner and torque wrench in adequate no. shall be supplied by contractor at site
according to requirement.

10 Adequate no. of DG Operated welding sets shall be supplied in the scope of contractor

Contractor shall also propose any other services, which will be essential for erection, testing &
commissioning.
