JUDICIAL-AFFIDAVIT

I, MELEZA PELESCO BONGCAYAO, of legal age, single,

Filipino, and a resident of Brgy. Catbawan, Pintuyan, Southern Leyte,
most respectfully submit this Judicial Affidavit in question and
answer form conducted at PAO Office, Bulwagan ng Katarungan,
Sogod, Southern Leyte by Atty. JOSE JULIUS P. OBUS, Public
Attorney II. I have answered the following questions asked of me fully
conscious that I do so under oath and that I may face criminal liability
for false testimony or perjury:

1.Q: Are you the same MELEZA PELESCO BONGCAYAO, the

petitioner in this instant petition?
A: Yes sir.

2.Q: Since this is a case for correction of entries, what are the
documents that are erroneous that needs to be corrected?
A: My Certificate of Live Birth with the LCR of Pintuyan and of
NSO.

3.Q: Do you have a copy of the said Documents?

A: Yes, Sir.

4.Q: If it will be shown to you, will you be able to identify it?

A: Yes, Sir.

5.Q: Showing to you a copy of Certificate of Live Birth isued by LCR

of Pintuyan, Southern Leyte, proposed to be marked as Exhibit
“I”, kindly go over and tell me if this is the one you have
mentioned?
A: This is the one sir.

6.Q: Tell me where in this documents are erroneous that needs to be

corrected?

A: The entry no. 1 with the mark as middle name which is P.
which should be PELESCO and the entry no. 6 which is entered
as EMERITA P. BONGCAYAO instead of EMERITA TIO
PELESCO.

7.Q: Anything else in this document?

A: Nothing more.

8.Q: Showing to you a copy of a Certificate of Live Birth from the

NSO with the name MELEZA P. BONGCAYAO, which is
proposed to be marked as Exhibit “J”, kindly go over and tell me
if this is the document you earlier mentioned?
A: Yes this is it sir.

9.Q: Tell me where in this documents are erroneous that needs to be

corrected?
A: The same with the LCR sir, the entry no. 1 with the mark as
middle name which is P. which should be PELESCO and the
entry no. 6 which is entered as EMERITA P. BONGCAYAO
instead of EMERITA TIO PELESCO.

10.Q: Do you have any proof to prove the true and correct maiden
name of your mother and of your true middle name?
A: Yes sir.

11.Q: If it will be shown to you, will you be able to identify it?

A: Yes sir.

12.Q: Showing to you a copy of the Certificate of Marriage of Luis

Bongcayao and Emerita Pelesco, issued by the Civil Registry of
Pintuyan, proposed to be marked as Exhibit “K”, kindly go over
and tell me if this is the one you have mentioned?
A: Yes this is the one sir.

13.Q: So, it is shown here in this document that your mother

EMERITA PELESCO is married to your father LUIS
BONGCAYAO and that the mother of EMERITA PELESCO is
Flesidaria Tio, are these entries true and correct?
A: Yes sir.

14.Q: Do you mean to say that your true and correct middle name is
PELESCO and your mother’s true and correct maiden name is
EMERITA TIO PELESCO?
A: Yes sir.

15.Q: Showing to you a copy of the Marriage Contract of Luis

Bongcayao and Emerita Pelesco, issued by the NSO, proposed to
be marked as Exhibit “L”, kindly go over and tell me if this is
also one that you have mentioned?
A: Yes sir.

16.Q: So, it is also shown here in this document that your mother
EMERITA PELESCO is married to your father LUIS
BONGCAYAO and that the mother of EMERITA PELESCO is
Flesidaria Tio, are this entries true and correct?
A: Yes sir.

17.Q: What complete name are you using?
A: MELEZA PELESCO BONGCAYAO sir.

18Q: Do you have proof of such use?

A: Yes sir, my school records and E-1 record of the SSS sir.

19Q: Showing to you a Form 137-A issued by the Pintuyan National

Vocational School, proposed to be marked as Exhibit “M” and
SSS Personal Record form E-1, with the name MELEZA
PELESCO BONGCAYAO, proposed to be marked as Exhibit “N”,
kindly go over and tell me if this is what you meant?
A: This is it sir.

20.Q: Since when did you use the name MELEZA PELESCO
BONGCAYAO?
A: Since childhood sir.

21.Q: Do you have any pending case before any court of law or
tribunals?
A: No sir.

22.Q: Do you have a proof to that?

A: Yes sir, an NBI Clearance.

23. Q: Showing to you an NBI clearance with the name

BONGCAYAO, MELEZA y PELESCO, proposed to be marked as
Exhibit “O”, kindly go over and tell me if this is it?
A: Yes it is sir.

24. Q: What do you ask from the Honorable Court?

A: I ask that my birth record with the LCR of Pintuyan and of the
NSO, be changed particularly my middle name from P. to
PELESCO and the mother’s maiden name from EMERITA P.
BONGCAYAO to EMERITA TIO PELESCO.

25.Q: Anything else you want to add?

A: No more sir.
