REGULATION OF THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA

CONCERNING
ADJUSTMENT FOR GOODS CLASSIFICATION AFFECTED BY PROVISIONS OF
EXPORT AND IMPORT LIMITATION AND PROHIBITION
BASED ON GOODS CLASSFFICATION SYSTEM

BY THE GRACE OF THE ALMIGHTY GOD

THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering : a. that the new goods classification system has been stipulated by the
Government through the Regulation of the Minister of Finance
Number 6/PMK.010/2015 concerning Stipulation of Goods
Classification System and Imposition of Import Duty Tariff upon
Imported Goods so that it is necessary to adjust goods classification
affected by provisions of export and import limitation and prohibition
based on the new goods classification system; ;
b. that based on consideration as intended in letter a and to increase the
effectiveness of supervision and implementation of goods export and
import affected by provisions of export and import limitation and
prohibition, it is necessary to stipulate Regulation of the Minister of
Trade concerning Adjustment for Goods Classification Affected by
Provisions of Export and Import Limitation and Prohibition Based on
Goods Classification System;
In view of : 1. Law Number 7 of 1994 concerning Legalization of Agreement
Establishing The World Trade Organization (State Gazette of the
Republic of Indonesia of 1994 Number 57, Supplementary State
Gazette of the Republic of Indonesia Number 3564);.
2. Law Number 10 of 1995 concerning Customs (State Gazette of the
Republic of Indonesia of 1995 Number 75, Supplementary State
Gazette of the Republic of Indonesia Number 3612) as amended with
Law Number 17 of 2006 concerning Amendment on Law Number 10
of 1995 concerning Customs (State Gazette of the Republic of
Indonesia of 2006 Number 93, Supplementary State Gazette of the
Republic of Indonesia Number 4661);
3. Law Number 39 of 2008 concerning State Ministry (State Gazette of
the Republic of Indonesia of 2008 Number 166, Supplementary State
Gazette of the Republic of Indonesia Number 4916);
4. Law Number 7 of 2014 concerning Trade (State Gazette of the
Republic of Indonesia of 2014 Number 45, Supplementary State
Gazette of the Republic of Indonesia Number 5512);
5. Presidential Regulation Number 7 of 2015 concerning Organization of
State Ministry (State Gazette of the Republic of Indonesia of 2015
Number 8);

concerning Stipulation of Goods Classification System and Imposition
of Import Duty Tariff upon Imported Goods (State Gazette of the
Republic of Indonesia of 2017 Number 176);

HAS DECIDED:

To stipulate : REGULATION OF THE MINISTER OF TRADE CONCERNING

ADJUSMENT FOR GOODS CLASSIFICATION AFFECTED BY
PROVISIONS OF EXPORT AND IMPORT LIMITATION AND
PROHIBITION BASED ON GOODS CLASSIFICATION SYSTEM.

Article 1
The exported and imported goods classification must be in accordance with the
description of goods and Tariff Post/HS containing in Goods Classification
System of 2017 stipulated through the Regulation of the Minister of Finance
concerning stipulation of goods classification system.

Article 2
In the event of Regulation of the Minister of Trade regulating prohibition and
limitation of goods export and import the adjustment of goods and Tariff
Post/HS description has not been conducted in accordance with Goods
Classification System of 2017, the implementation of goods export and import
shall refer to Goods Classification System of 2017.

Article 3
Export and import licensing issued by the Ministry of Trade before 1 March
2017 in which the adjustment of goods and Tariff Post/HS description has not
been conducted in accordance with Goods Classification System of 2017, shall
remain in effect to the termination of the permit validity.

Article 4
This Regulation of Minister shall come into effect on 1 March 2017.
 For public cognizance, ordering the promulgation of this Regulation of
Minister in the Official Gazette of the Republic of Indonesia.
