W
hile the Supreme Court issued its acquittal of Hu-
bert Webb and company from the charge that they
perpetrated the crime called “Vizconde Massacre”
that took place 20 years ago, it actually overshad-
owed to obscurity two acquittals and allowed
these to pass off secretly.
After waking up from the shock struck hard by the end-
ing of the saga that haunted the pro and the con in Hubert’s
case, the Filipinos were led to other shockers: the acquittal
of Hayden Kho from the charges arising from the sex video
scandal and the virtual acquittal of the corrupt ex-general
Carlos Garcia.

The policemen led by
the city police chief, Supt.
Reynaldo Mendieta Maclang,
cased in a radio reporter who
bombastically insulted the
law enforcers for failure to

about 11:30 in the evening of
October 29, 2010, the police-
men took turns in mauling
him.
The opinion of Dyaryo
Magdalo is this: When the
mauling was noticed by
a newly-elected barangay
chairman who then took vid-
eo shots of the incident, the
mauling stopped. But the cops
justified their acts by making
it appear they caught the ra-
dioman, Ryan D. Uy, selling a
sachet of shabu and possess-
ing five more.
The police called in their
allied reporter, their allied rep-
resentative from the Depart-
ment of Justice, and their al-
lied elected barangay official
to sign as the witnesses to the
inventory of drugs. This in-
ventory and the witnesses are
specifically required by law.
Maclang and his men made it
a point to give an impression
of compliance in order to le-
gitimize what they did.
Still not contented of what
they did, Dyaryo Magdalo
learned that these policemen
arrested the barangay chair-

Getting rich quick?
Records at the Customs
bureau show that Vicencio
is relatively very new at the
bureau, which happens to be
looked down to as the most
corrupt agency in the country.
He was a presidential ap-
pointee of Gloria Macapagal

him the cellular phone he
used in taking the footage of
the video.
In an interview with Dyaryo
Magdalo, this newly-elected
barangay chairman, Moman
Apura, disclosed that while
he was peeing under a tree, he
noticed the mauling incident,
prompting him to come closer
to take video shots.
Apura told Dyaryo Magda-
lo that when he was seen by
the cops, they arrested him
and took the cellular phone
from him.
Thereafter, Apura said
that he saw the radioman un-
conscious that the cops even
bodily carried this journalist
to a police vehicle.
Apura said that he was
made to sit beside Uy and he
closely noticed that indeed the
radioman was almost lifeless.
After arriving at the city
police station, Apura said he
was made to sit and he did not
know what happened to Uy.
He only learned later that the
journalist was literally thrown
inside the detention cell.
After detaining him for
several hours, Apura said he
was freed upon the interven-
tion of a board member of
Zamboanga del Norte board
member.
In a separate interview of
Dyaryo Magdalo with Maria-
no Uy Sr., the father of Ryan,
he said that when he learned
of his son’s fate he immedi-
ately went to the police station
to visit him.
Mariano recalled that the
city police prevented him
from seeing his son, prompt-
ing him to call their lawyer,
Atty. Cres Palpagan.
When Atty. Palpagan re-
quested to see his client, still
the police refused.
This prompted the two to
seek the help of Zamboanga
del Norte Gov. Rolando Ye-
bes, who promptly responded
to the police station.
Only then that they were

now, he is still the chief of
the CIIS. Why he is not re-
placed can only be answered
by Customs Commissioner
Angelito Alvarez.

that Vicencio has a fleet of
vehicles, an armory, units of
house and lot, pricey stalls
in public markets, and large
tracks of farm lands.

tion further show that these

acquired in 2009 and 2010,
all dates falling during his
service as chief of CIIS, the
law enforcement group of
the bureau.

boost tourism in the country
should not be silenced by the
taking of all the blame and
resignation by Tourism for-
mer undersecretary Vicente
Romano.
The mystery probe should
not stop with Romano’s own-
ing up of responsibility. Don’t
stop the hammer from falling
letting others who were part
of the project to remain holy
and unscratched.
The P4.8 million, as re-
flected on vouchers signed by
Romano and Tourism Secre-
tary Alberto Lim, was spent
for one occasion, on the night
when the project was launched,
November 15, 2010.
The money that Lim de-
nied of having a hand for
release was spent for invita-
tions, sound system, food,
drinks, and public relations.
Lim left all the blame to
Romano who acted gentle-
manly by resigning from the
post of underscretary. Who
will believe when Lim said:

networking sites on the In-
ternet, saying “Pilipinas Kay
Ganda” logo was lifted from
Poland’s own tourism cam-
paign, Polska.
A check with the offi-
cial travel website of Poland
showed that indeed, their logo
has a striking similarity to
P2.6 million.
The same report says that
Vicencio maintains five to ten
security escorts.
Is he a thief?
If all these documents
are true, there is no reason
why Dyaryo Magdalo has to
change its opinion that Mr.
Filomeno C. Vicencio Jr. is
another “thief” among the
Customs’ chiefs.

The prosecutors must have
thought that it was not the act

The prosecutors must have
known that there was no crime

did not know about the video-
taking at the time the sex tryst
was being shot. The crime
did not occur at that time be-
cause there was no violence
yet that occurred, for violence
on women occurs only when
she is hurt, and in this case
Halili will be hurt only if she
knows of the scandal.
As such, while the judge
correctly ruled for the dis-
missal of the charge against
Kho, Dyaryo Magdalo does
not accept the court’s reason
that Halili could have known
of the video-taking. As ex-
plained, it is regardless of
the knowledge or the lack of
knowledge of Halili that made
up the crime, but it was the act
of publishing the sex video by
means of uploading it to the
Youtube.
Who are to blame in Garcia’s
virtual acquittal?
In any criminal case, plea-
bargaining is a part of the pro-
ceedings but opportunity for
invoking this comes before
the trial and during the so-
called “pre-trial” conference.
If the plea-bargaining was
invoked after the pre-trial it is
highly improper.
In the case of ex-general
Garcia, it was reported that he
filed a petition for bail and it
was denied. If it was denied,
then it means that the evidence
was strong against Garcia.
The procedures in the fil-
ing of a petition for bail re-
quire the prosecutors to pres-
ent their evidence, including
the witnesses. Usually, the
prosecutors present all evi-
dence in hand with the objec-
tive of forestalling the bid of
the accused to get temporary
freedom by means of a bail
and with the view of adopting
the same presented evidence
as part of the regular evidence
in the case.
So that it is very clear that
the prosecutors in Garcia’s
case were already aware of
how strong their evidence
were against Garcia, consid-
ering alone the fact that the
Sandiganbayan denied Gar-
cia’s prayer to be allowed to
post bail.

million pesos and to agree
with the offer was to make
Garcia profit by such amount
despite the despicable act of
stealing.
So that for the prosecutors
to agree is to this proposal
make them the ones stealing
168.27 million pesos from the
government.
However, all actions of the
Special Prosecutors cannot be
valid without the approval of
the Ombudsman or Tanodbayan
Merceditas N. Gutierrez.

gay Treasurer and Barangay

der No. 332 also provided
that the rates of honorarium

(a) of R.A. No. 7160 may
be increased or adjusted
based on the Internal Rev-
enue Allotment a certain
barangay is given. This is
the reason some barangay
chairmen and their officials
are receiving as much as
P60,000 month, depending
on the IRA of their specific
barangay.
Aside from honorarium,
barangay officials are also
entitled to the following

by Lauro Vizconde, the fa-
ther of the massacre victims.
The reputation of the
Webb family has long been
damaged beyond repair that
the patriarch, Freddie Webb
lost his reelection bid to the
detention cell inside the po-
lice station fifty (50) times. As
they were following the order
out of fear, the three said that
Maclang smashed their hands
and fingers with a rattan stick.

per-views, though it would

that fight right, because of

will move the needle a lot.
That will be a pretty high

A fight with Berto may
make sense because he is a
natural welterweight. Pac-

Berto has beaten -- Juan Ura-

Estrada, Steve Forbes, and

earn a shot at Pacquiao, he
needs to beat a world-class
opponent convincingly. But

In a joint effort with local
media men, Publishers Asso-
ciation of the Philippines, Inc.
(PAPI) has organized a press
freedom summit at the world-
famous Dakak beach, located
near Dipolog.
PAPI president Johnny
Dayang, who collaborated
with NPC in conducting in-
vestigations into the matter,
has gathered mediamen from
different provinces of the
country to talk about media
suppression, including the
current press freedom crisis in
Zamboanga del Norte and the
Maguindanao Massacre.
Almost daily indignation protest
The local media in Di-
polog, particularly those be-
longing to Zamboanga del
Norte United Correspondents
(ZNUC) are conducting al-
most a daily protest to compel
the city leadership and the city
police to stop the harassment
to them.
The protest actions were fur-
ther fuelled by the complaints of
several of them that they were
being stalked by the mayor’s

people will not agree to
Marquez’s demand.

WHEN pound-for-pound
king Manny Pacquiao pound-
ed Antonio Margarito for his
eighth world title in as many
divisions, the boxing world
seems to be looking for the
best fighter that will give Pac-
man a run for his money.
The current and most fa-
miliar faces who are most
eligible to challenge Pacquiao
belong to Floyd Mayweather
Jr., Shane Mosley, Andre Ber-
to, and Juan Manuel Marquez.
The list does not stop here.
There are still unknown and
fairly good fighters but not
that good at pay-per-view.
Pretty Boy Floyd
Mayweather Jr.
Several years ago, the
world thought that the come-
back of Mayweather Jr. would
put the fight of the century to
happen, pitting him against the
hottest current superstar of the
ring Pacquiao. But demands
ranging from prize share to
urine test to mudslinging on
either camp made the fight
went down the drain.
But let us forget about
Mayweather Jr. for now be-
cause he is not interested in
the fight and might be wearing
a prison uniform for assault
and two other charges soon.
Or maybe Pretty Boy
Floyd might be pondering his
next defense of his undefeated
record right inside the exercise
yard of a state penitentiary.
It is however pretty obvi-
ous that all issues raised by
Floyd are statements of fear to
taste defeat for the first time.
Sugar Shane Mosley
The most successful
among the names mentioned
is Shane Mosley. Not only is
he the strongest possible op-
ponent to Pacquiao but he is
the best fighter in his era.
Winning three world titles
in three different divisions,
Mosley has enjoined him-
self to the exclusive group of
world champions that reigned
in the same number of titles
in the same number of weight
classes.
He was a 5-time US cham-
pion in the lightweight and
light welterweight division
with an amazing 96-3 win-
loss card during his amateur
years.
He went on to fight profes-
sionally in 1993. By the year
2000 he had fought 34 times
and winning all of them there-
by making a boxing record for
himself. He fought the unde-
feated Phillip Holiday to win
the IBF Lightweight crown in
1997 via a unanimous deci-
sion.
He successfully defend-
ed his lightweight title nine
times.
He had a flourishing ca-
reer when he thought he has
no more competition in this
weight category and deemed
it necessary to move up two
divisions higher to challenge
the multi-titled champion Os-
car De La Hoya.
Sugar Shane and The
Golden Boy met on June 17,
2000 in Los Angeles, Cali-
fornia for the WBC and IBA
Welterweight titles. After 12
rounds of boxing, Mosley
emerged victorious via a split
decision.
During the fight neither
Mosley nor De La Hoya was
in danger of going down, but
both had badly swollen faces
at the end and De La Hoya
was bleeding from the nose
for several rounds.
After three years, the two
protagonists met again at the
MGM Grand Garden Arena in

and “the cream”, both are de-
signer steroids.
In 2003, Mosley told a
grand jury that he injected
himself with the doping agent
EPO as he prepared for that
fight against De La Hoya.
Andre “The Beast”
Berto
On June 21, 2008, Andre
Berto captured the vacant
WBC Welterweight title by
defeating Miguel Rodriguez
in the seventh round by tech-
nical knockout at the FedEx
Forum in Memphis, Tennes-
see.
Berto knocked Rodriguez
down twice in the seventh
round, before the referee
stopped the bout with 47 sec-
onds left as Berto continually
hurt Rodriguez with a barrage
of punches.
His first title defense of his
belt occurred on September
28, 2008 against Steve Forbes
at the Home Depot Center in
Carson, California. Berto con-
sistently outpunched Forbes
right from the opening bell to
win by unanimous decision.
On January 17, 2009, Berto
made his second title defense
versus WBA welterweight
champion Luis Collazo at the
Beau Rivage in Biloxi, Mis-
sissippi. Berto got off to a
rough start as he was hurt in
the first round and had a point
deducted in the fourth round
for holding Collazo’s arm. In
round seven, Berto opened a
cut over the left eye of Col-
lazo. Berto won the fight by
a controversial unanimous
decision.
Berto was to defend his
title against Mosley  for a
WBC, WBA welterweight
title unification bout on Janu-
ary 30, 2010. However, Berto
announced that he was with-
drawing from his title unifi-
cation bout against Mosley
on January 18, 2010 due to
family loss in the Haiti earth-

April 10, 2010. Despite injur-
ing his left biceps during the
bout, Berto went on to win by

“Dinamita” Marquez
In May 2004, Marquez
fought Pacquiao in a contro-
versial bout that was scored a
draw. In the first round Mar-
quez was caught cold, as he
was knocked down three times
by a more lively Pacquiao.
However, Marquez
showed great heart to recover
from the early knockdowns,
and at the end of a very close
second round it was clear that
this would be a long night for
Pacquiao.
Marquez was able to coun-
terpunch effectively, winning
the middle rounds and effec-
tively countering Pacquiao in
closely fought later rounds.
The fight was ultimately ruled
a draw.
The final scores were 115-
110 for Márquez, 115-110 for
Pacquiao, and 113-113. One
of the judges (who scored
the bout 113-113) later ad-
mitted to making an error
on the scorecards because
he had scored the first round
as “10-7” in favor of Pac-
quiao instead of the standard
“10-6” for a three-knock-
down round.
On March 2008, Marquez
challenged Pacquiao again
only to lose his Super Feath-
erweight Championship to
Pacquio via a split decision.
Marquez suffered a knock-
down in the third round
that proved to be the dif-
ference in the decision as
the remaining rounds were
scored dead even.
On February 28, 2009,
Marquez defeated IBO cham-
pion, and former WBA, IBF,
and WBO Lightweight cham-
pion Juan Diaz by knockout.
Diaz controlled the fight
early in the bout as the two
boxers exchanged punches.
Diaz opened a cut above Mar-
quez’s right eye, and looked to
control the bout, but Marquez
responded by opening a gash
above Diaz’s right eye and
stunning him with a left hook
before the end of the round.
Marquez landed two hard
rights to Diaz’s face in a
three-punch combination that
knocked Diaz down in the
ninth round. Diaz rose, but
seconds later, Marquez fol-
lowed with a right uppercut
to the chin that knocked Díaz
down for a second time. The
referee waved an end to the
fight.
After the fight, Marquez
expressed his interest in fight-
ing Mayweather Jr.
Marquez moved up to the
welterweight division, and
fought undefeated and for-
mer number one pound-for-
pound  champion Mayweath-
er, Jr. The fight was scheduled
to take place at 144 lbs. on
July 18, 2009 at the MGM
Grand Arena. The bout was
postponed due to a rib injury
sustained by Mayweather and
has been rescheduled for Sep-
tember 2009.
During the official weigh-
in for their 144  lb bout,
Marquez weighed-in at
142  lbs and Mayweather, Jr.
weighed-in at 146 lbs thereby
incurring a financial penalty
as he was 2 pounds over the
catchweight.
Marquez looked slightly
fleshy and uncomfortable with
the move up in weight but
despite being knocked down
in the 2nd round, showed
great heart to go the distance
against Mayweather, Jr. May-
weather, Jr. defeated Marquez
by unanimous decision.
Business in Boxing
It seems that the long list
of Paquiao’s next opponent
is getting longer every day.
All are aching to have a hand
with the Philippines’ box-
ing icon. Majority of boxing
media and lovers of the sport
pick Mosley as the most likely
opponent of the world’s best
