Prime Minister:

Human Immunodeficiency Virus (HIV is a virus spreading through certain body


fluids that attacks the body’s immune system. In which it attacks the cells, a special cell
that protects the body from having diseases, without this cells the body can no longer
fight the virus, in result the virus will keep producing and spreading trough out the body
causing hiv or worst aids.
In the Philippines today, the number of new HIV infections continues to increase month
per month and estimates now run to 14 new HIV cases every day. In 2013, the United
States Preventive Health Services recommended that clinicians screen ALL adolescents
and adults ages 15 years-65 years for HIV and younger adolescents or older persons who
are at increased risk as well as all pregnant women including those who present in labor.
They cited strong evidence that such mandatory screening tests have benefits since
screening identifies those who have HIV but otherwise may not feel ill, and if they are
infected then they can start with medicines that can make them have better chances of
staying healthier and thus delaying AIDS, the final stage of HIV.

Testing yourself for HIV is important for your health, your relationships, your life and
your future. The fact is that HIV is preventable, and you can reduce or eliminate your
risk. And early detection can lead to early treatment and better outcomes. Many people
live long, normal lives with early detection and proper care, because the advancements
in HIV options have been significant.

Hiv test is to give awareness to a certain person who Is hiv positive and also it is very
helpful to the coworkers to stop the spreading of hiv in a workplace. For workplace
should be healthy as well as the employees in order to be efficient and effective in their
perspective jobs and field
Identifying HIV infections early will cut down the burden of complications that the
health service has to treat.

As controversial as it may seem, I think it will be a big step towards awareness if


companies will oblige their employees to take the hiv test. And companies should be
accountable the confidentiality of the result. Testing is not as bad as it seems, in actual
helps break the stigma that surrounds STDs and that way, you can keep track of your
employee's health and give attention to those who need it.
It should be mandated for the reason that it will give awareness among the employees,
aside from that it is less hassle unlike going to a clinic wherein money is involved.

ARTICLE I 
EDUCATION AND INFORMATION

Section 6. HIV/AIDS education in the workplace. – All government and private employees,


workers, managers, and supervisors, including members of the Armed Forces of the Philippines
(AFP) and the Philippine National Police (PNP), shall be provided with the standardized basic
information and instruction on HIV/AIDS which shall include topics on confidentiality in the workplace
and attitude towards infected employees and workers. In collaboration with the Department of Health
(DOH), the Secretary of the Department of Labor and Employment (DOLE) shall oversee the anti-
HIV/AIDS campaign in all private companies while the Armed Forces Chief of Staff and the Director
General of the PNP shall oversee the implementation of this Sec..

ARTICLE III 
TESTING, SCREENING AND COUNSELLING

Sec. 18. Anonymous HIV testing. — The State shall provide a mechanism for anonymous
HIV testing and shall guarantee anonymity and medical confidentiality in the conduct of
such tests.

ARTICLE VI 
CONFIDENTIALITY

Sec. 30. Medical confidentiality. – All health professionals, medical instructors, workers,


employers, recruitment agencies, insurance companies, data encoders, and other custodians of any
medical record, file, data, or test results are directed to strictly observe confidentiality in the handling
of all medical information, particularly the identity and status of persons with HIV.

Section 32. Release of HIV/AIDS test results. – All results of HIV/AIDS testing shall be confidential
and shall be released only to the following persons:

(a) the person who submitted himself/herself to such test;

(b) either parent of a minor child who has been tested;


(c) a legal guardian in the case of insane persons or orphans;

(d) a person authorized to receive such results in conjunction with the AIDSWATCH program
as provided in Sec. 27 of this Act;

(e) a justice of the Court of Appeals or the Supreme Court, as provided under subSec. (c) of
this Act and in accordance with the provision of Sec. 16 hereof.

ARTICLE VII 
DISCRIMINATORY ACTS AND POLICIES

Sec. 35. Discrimination in the workplace. – Discrimination in any form from pre-employment to


post-employment, including hiring, promotion or assignment, based on the actual, perceived or
suspected HIV status of an individual is prohibited. Termination from work on the sole basis of
actual, perceived or suspected HIV status is deemed unlawful.

THE POSITIVE ACTION FOUNDATION PHILIPPINES

PAFPI is geared towards assisting patients and affected family members


through counselling and psychological support services, providing education
and care for AIDS symptoms at home. They run a regular soup kitchen at the
HIV ward of San Lazaro Hospital, and have established a drop-in center
called Bahay Kanlungan, which provides temporary shelter to people living
with HIV (PLHIV).

Mandatory is something that has to be done morally. But Compulsory is something that has
to be done no matter what, there can be no excuse for that.

Anonymous: HIV antibody testing is available at anonymous HIV test sites in some California
counties. Anonymous testing means that absolutely no one other than you has access to your
test results since your name is not recorded at the test site. It is always a good idea to contact
the testing clinic directly to confirm what type of test is available.

Confidential: HIV antibody testing means that you and the health care provider know your
results, and it may be recorded in your medical file at the testing site. Some clinics offer
confidential testing to make it easier for the patient to access their own results at a later date, or
to make it easier to track the number of unique new cases that are being found. In some places,
the government requires confidential instead of anonymous as a condition of funding. This
makes it easier for agencies to distinguish new HIV infections from cases of someone testing
positive in multiple locations.
