SUBJECT: Supply of Underground Drill Bits (Coal & Stone) for use at ECL.
REFERENCE: Our RC No ECL/PUR/04/UG DRILL BITS/RC/14-15/ 740 Dated: 16.07.2014
Please arrange to supply the following Underground Drill Bits (Coal & Stone) against our Rate Contract
No ECL/PUR/04/UG DRILL BITS/RC/14-15/ 740 Dated: 16.07.2014
Scope of Supply: Drill Bits (Coal & Stone)
Tungsten Carbide tipped Rotary Coal Drill Bits 1.11/16” (42.86mm) suitable for drilling holes in coal and stone to be
used in conjunction with the drill rods of 1.9/16”(39.687mm) dia. The tungsten Carbide tipped bits under discussion
shall be suitable for under noted application while used in conjunction with Rotary Drill having speed at the chuck in
the region as mentioned against each. Drill bits should be as per relevant ISS: 8166/1988 OR BSS: 2593/1964 as
amended up to date.

Terms and Conditions:
1) Price: The above prices are on FOR destination (door delivery) basis and will remain firm till execution of order.
2) Excise duty: NIL, as Excise Duty is exempted to you.
3)Sales Tax:Shall be paid extra at actual at the time of supply within scheduled delivery period. Present rate of
CST is 2% against form “ C”.
4). Packing, Forwarding & insurance Charges: Inclusive in Basic Price.
5).Freight Charges: Inclusive in Basic Price.
6).Delivery: 50% of ordered quantity shall be supplied within 2(Two) months from the date of placement of order
and balance 50% within 3(three) months from the date of placement of order. Date of placement of order shall be
reckoned from the 10th day from the date of issue of order.
7). Payment Terms: Full payment shall be made within 21 days from the date of receipt and acceptance of
materials by the consignee or submission of bills, whichever is later.

will also be mentioned in the purchase order to be issued by DDO.

10).Security Deposit: Exempted since you are registered with NSIC (which is valid till 03.07.2015). However in case
your NSIC registration is not valid at the time of supply against orders placed against this rate contract, you will have to
deposit security money in Indian rupees only in the form of bank guarantee in our prescribed format (annexure A) or in
the form of Bank Draft of any scheduled/Nationalized Bank payable at Asansol drawn in the favour of “Eastern
Coalfields Limited” for 10% of the ordered landed value without having any ceiling. The Bank Guarantee should be
kept valid till execution of Order, complete in all respects but minimum validity should be for 6months. The Security
deposit will be refunded to the firm within 30 days of satisfactory execution of contract. For unsatisfactory performance
and /or contractual failure, the security money shall be forfeited.
Two week time shall be given in order to furnish the security deposit. In Case your NSIC registration is renewed and
valid at the time of supply, then the same shall have to be submitted duly attested by notary public along with your
bills.
11). Inspection: Shall carried out by the authorized representative of the consignee at consignee’s end upon receipt of
the materials. The items found defective or not in accordance with the supply order/specification will be rejected and
intimated to you for free replacement within 30 days from the date of receipt of intimation.
12). Submission of Bill: The duly stamped and pre-receipted bills in 5 Copies as per terms of the contract must be
submitted to the Consignee who after endorsement of the bills, 3 copies of the same (including the Original) and any
other requisite documents to be provided to the paying authority.
Additional information to be incorporated in Invoice as per Central Excise Act so that ECL may avail CENVAT Credit
under Rule 11(2) of Central Excise Rules.

13). Guarantee/Warranty:- The materials must have guarantee/warranty for 12 months from the date of installation and
commissioning or 18 months from the date of receipt and acceptance of materials whichever is earlier against any
manufacturing defects/bad workmanship. If the product is found inferior in quality or defective during the
guarantee/warranty period the supplier must replace defective materials immediately at their cost. A certificate along
these lines should be furnished by the firm along with each consignment and bill/invoice.
14). Price Fall Clause: The prices charged for the stores supplied under this contract shall in no event exceed the
lowest price at which you sell the stores or offer to sell the stores of identical description to any party/organization
during the period of contract. If you at any time during the period of contract reduce the sale price of such stores or sell
to any other organization or offer to sell to any other organization at a price lower than the price chargeable under this
contract, you shall forthwith notify such reduction to us and the price payable under this contract , after the date of
coming into force of such reduction in sale price, shall stand corresponding reduced. You shall also be responsible for
intimating the same to us. You shall submit a certificate to this effect.

17). Liquidated Damages : Delay in execution of order would entail imposition of Liquidated Damages as below :-
In case of failure to deliver the materials as per delivery period, ECL reserves the right to any or all the following:-
a) To recover from the successful tenderer as agreed, Liquidated Damages @ ½% (half percent) of the price of
any stores, which the successful tenderer has not been able to supply for each week or part of the week during
which the delivery of such stores may be in arrears limited to 10% (ten percent). Where felt necessary, the limit of
10% (ten percent) can be increased to 15% (fifteen percent).
b) To purchase elsewhere, after due notice to the successful tenderer on their account and at the risk of the
defaulting supplier, the stores not supplied or other materials of a similar description without canceling the supply
order in respect of the consignment not yet due for supply. OR
c) To extend the delivery period with or without penalty, as may be considered fit and proper. The penalty imposed
shall not be more than the agreed liquidated damages referred to as clause (a) above OR
d) To cancel the supply order or a portion thereof if ECL decides purchase of stores at the risk and cost of the
defaulting supplier and also
e) To forfeit the security deposit received in full or in part. OR
f) Whenever under this contract any sum of money is recoverable from any payable by the supplier, ECL shall be
entitled to recover such sum by appropriating, in part or in whole by deducting any sum or which at any time
thereafter may become due to the successful tenderer in this or any other contract. Should this sum be not
sufficient to cover full amount recoverable, the successful tenderer shall have to pay to ECL on its demand the
remaining balance. The successful tenderer shall however not be entitled to any gain on any such purchase.
18). Manufacturer’s test and Guarantee Certificate:- Should be provided with each supply.
19). Shortage, Damages & demurrage etc: Any Shortage/Damages reported by the consignee shall be made
good/replaced within 30 days of receipt of intimation from DDO’S. The consignee shall take open delivery of the
consignment found damage at the time of taking delivery. In case of shortage found in such case, shortage
certificates will be obtained by the consignee from the carriers and submitted to you. Any demurrage, wharfage
payable due to your fault will be to your account.
20). Despatch instruction: Material properly packed to prevent loss/damage during the transit are to be delivered to
the consignee by Road transport on Door delivery basis.
21). After Sales Services: You shall provide after sales services promptly as an when required by ECL.
26). Marking: Your manufacturing identification/ Trade mark “NSA” should be embossed / engraved on a visible
place of the materials so that it may be distinguished from other Make.
27). Brand Name: “NSA”.
29).Except under specific instructions delivery to stores is restricted upto 3.00 PM on all working days except
Saturdays.
30). Road Permits/ Way Bills: Road Permits/ way Bills if necessary, should obtained directly from the consignee.
31). The court of Asansol only will have jurisdiction to deal with or decide any legal matter of dispute whatsoever
arising out of this contract.
32). This Rate Contract is subject to ECL’S General Terms and conditions of Supply of Stores attached as
Annexure-B unless otherwise specified herein.
33). Duplicate copy of this order, duly signed should be returned within 15 days as a token of acceptance.

DETAILED TECHNICAL SPECIFICATION FOR COAL/STONE DRILL BITS
