AGREEMENT TO SELL A PLOT ( BIANA)

PLOT No. 572 St/Lane No. Sect Boulevard-4 Sect A Phase 1 Society DHA Peshawar

By this deed of agreement made on 5th day of March 2019

BETWEEN

Col Muhammad Farid (Retd) S/W/D/O Mr. Muhammad Hanif Khan R/O House no.64 St-4 Al Amin
Society Bedian Road Lahore Cantt holding CNIC No. 38403-5786978-3, hereinafter called the Seller of
the one part.

AND

Mr. Nemat Ullah Khan S/W/D/O Mr.Muhammad Ali Gul R/O Cosmo Computer Works Gul Haji Plaza
University Road Peshawar holding CNIC No.17301-7042371-3, hereinafter called purchaser of the other
part.

1. That the Seller affirms and confirms that he/she is the absolute owner of the plot no 572
St/lane no Sect Boulevard Sect A Phase 1 measuring 500 sq yds , situated in DHA Peshawar
vide allotment/intimation/ allocation letter no OLO/B/RES/4389 & membership no ______.
2. That the Seller further affirms that the said plot is free from all encumbrances, charges, dues &
litigation of all sorts & there is no loan against the said property.
3. That the Seller is selling & the purchaser is purchasing the above said plot at price of
Rs.10,200,000/- ( Rupees ten million and two hundred thousand only). Out of which
Rs.1,000,000/-(Rupees ten lac only) has been paid as BIANA and Rs.2,000,000/-(Rupees
twenty lac only) through cash/pay order/cheque no. on line, as part of payment.Remaining
amount of Rs. 7,569,000/- (rupees seventy five lac and sixty nine thousand only) shall be paid on
or before 20-03-2019.

4. That the seller will make himself/herself available and will sign all the documents which he/she
is called upon to sign by the purchaser in concerned with the transfer of said plot in favour of
the purchaser or any of his nominees.
5. That the seller will be responsible to clear all the dues of the said property i.e cost of
land,security charges,non utilization charges,debries charges.land charges,gain tax and
charges imposed by the Authority if any and other surcharge etc of the said plot on or before
due date of transfer. If the above said charges are cleared by the purchaser on behalf of the
seller then this amount shall be deducted from the balance amount.
6. In case the purchaser fails to pay the balance amount within the stipulated period his/her Biana
(earnest money) will be considered as forfeited likewise if the seller refuses or denies to transfer
the plot, the purchaser will have the right to get double of the paid Biana (earnest money) or get
execution of the said plot in his/her favour through court of law on the expenses of Seller.
7. That the purchaser shall be entitled to enter into an agreement to sell the said plot to any other
party he likes on the prevailing market value or at any other consideration he/she deems fit and
the Seller will have no objection to sign the papers for such party during Biana period.
8. That the seller and the purchaser herein before used shall include their respective heirs, legal
representatives, successors, assignees and nominees.
9. That 1 % commission each of total cost will be paid by the “ Seller” and “ Purchaser” to the
property dealer.
10. If transfer fee or taxes are increased before the transfer of plot, the Seller and Purchaser both
are bound to pay them.

IN WITNESS WHEREOF the parties hereto mentioned have signed this DEED on the date mentioned
above.
