PETITION

COMES NOW, the Petitioner by undersigned counsel and into this Honorable Court,
respectfully alleges:

1. That the petitioner is of legal age, married, Filipino citizen and residing at
Himamaylan Cty, Negros Occidental;

2. That the respondent is the public officer in charge, among others of the official
records/documents registered in the city of Himamaylan including the records of
birth and marriage certificates;

3. That respondent Lucille Titular is of legal age, a Filipino citizen, single and a resident
of Himamaylan. Negros Occidental;

4. That the Petitioner was married on January 4, 1978 with Pablo Sicad Braza, Jr as
stated in the Marriage Contract. Copy of the Marriage Contract is hereto attached as
“ANNEX C”;

5. That Pablo died on April 15, 2002 in a vehicular accident in Bandung, West Java,
Indonesia;

6. That during the wake, Lucille Titular appeared and introduced Patrick Alvin Titular
Braza as her and Pablo’s son;
7. That upon inquiries, petitioner obtained Patrick’s birth certificate from the local civil
registrar of Himamaylan City, Negros Occidental stating that Pablo Braza was the
father of Patick Titular and was legitimated by virtue of subsequent marriage. Copy
of the Birth Certificare is hereto attached as “ANNEX A”;

8. That Petitioner likewise obtained a copy of the marriage certificate showing that
Pablo and Lucille were married on April 22, 1998. Copy of the Marriage Contract is
hereto attached as “ANNEX B”;

9. That Patrick Titular could not have been legitimated by the supposed marriage
between Lucille and Pablo, said marriage being bigamous on account of the valid
and subsisting marriage between Ma. Cristina and Pablo.

WHEREFORE, premises considered, it is most respectfully prayed of this Honorable

Court that the instant petition be GRANTED for the correction of the entries in Patrick’s
birth record with respect to his legitimation, the name of the father and his
acknowledgement, and the use of the last name “Braza”; directive to Leon, Cecilia and
Lucille, all surnamed Titular, as guardians of the minor Patrick, to submit Patrick to DNA
testing to determine paternity and filiation; and the declaration of nullity of the
legitimation of Patrick as stated in his birth certificate and, for this purpose, the
declaration of the marriage of Lucille and Pablo as bigamous.

I, Ma. Cristina Torres Braza, of legal age, Filipino, widow, and a resident of
Himamaylan, Negros Occidental, Philippines, after being sworn to in accordance with
law, hereby depose and say:

That I am the petitioner in the above-entitled case; That I have caused the
preparation of the above petition and I have read the same and knows the contents
thereon; That the allegations contained therein are true and correct of my own personal
knowledge.

That I further certify that: (a) I have not theretofore commenced any other
action or proceeding or filed any claim involving the same issues or matter in any court,
tribunal, or quasi-judicial agency and, to the best of my knowledge, no such action or
proceeding is pending therein; (b) if I should thereafter learn that the same or similar
action or proceeding has been filed or is pending before the Supreme Court, the Court
of Appeals, or any other tribunal or quasi-judicial agency, I undertake to report such fact
within five (5) days therefrom to the court or agency wherein the original pleading and
sworn certification contemplated herein have been filed.
